The petition of Charles Absent, a resident of your said Parish of Union, State of Louisiana, showeth that Susan F. Absent, wife of Charles E. Johnston departed this life April 12th 1861 leaving a small estate and one minor child to wit: Charles Johnston. Petitioner represents that it is necessary that the natural Tutor of said minor be recognized and that an Under Tutor be appointed. Therefore, he prays that Charles E. Johnston be duly recognized as Natural Tutor and petitioner be appointed as Under Tutor in accordance with Law. J. E. Trimble, Atty. State of Louisiana 11th District Court Union Parish The premises considered and by further reason of the law, it is hereby order that Charles E. Johnston be appointed and conformed Natural Tutor of his minor child as prayed for in the foregoing petition, and that Charles Absent be and he is hereby appointed Under Tutor upon the m taking the oath required by law. Johnston do solemnly swear that I will faithfully and impartially discharge all the duties incumbent on me as Natural Tutor of my following named minor child to wit: Charles A. Johnston is hereby duly and legally authorized and empowered to do an perform all the acts appertaining to the said appointment according to law. The Petition of Charles A. Absent, Under Tutor duly appointed according to Law for Charles A. Johnston with respect represents unto your Honorable Court that he believes the Interest of the said Charles A. Johnston minors are [unreadable] by the acts of his natural Tutor Charles E. Johnston in this. The said Charles A. Johnston has failed to cause an Inventory of the effects belonging to the succession of Susan F. Absent, Decd. to be filed as required by law and that said effects are still used by the said Charles E. Johnston without authority and to the jeopardy of Charles A. Johnston, the only legal heir and representative of the said Susan F. Absent, Decd. Further that the property of the said Susan F. Absent, Decd. having been received the said Charles E. Johnston as husband and by him reduced to possession is now subject to be seized and sold to satisfy claims against the said Charles E. Johnston to the great injury of the said minor heir. Wherefore, petitioner prays your honorable court that an order issue commanding the Recorder of the parish of Union to cause and Inventory of the Estate of Susan F. Absent, Decd. to be taken and there the said Charles E. Johnston be duly notified thereof and upon a refusal to comply that Tutor Ad hoc be appointed to prosecute the removal of the said Charles E. Johnston from the tutorship of the said minor Chas. A. Johnston and for general relief &c. J. E. Trimble, Atty. State of Louisiana 11th District Court Parish of Union The premises considered, it is ordered that W. C. Smith, Parish Recorder and Ex Officio Notary Public be and he is hereby authorized and commanded to make an Inventory and Appraisement of all the property belonging to the Estate of Susan F.
