To the Honorable the Judge of the 11th, Judicial District Court, in & for the Parish of Union Louisiana. The petition of A. J. Alphin, a resident of said Parish, respectfully represents, that Graham Kinard of said Parish, departed this life on or about the seventh day of January A.D. 1862, at his residence in said Parish, leaving a considerable estate of real & personal property, slaves, rights credits and debts out standing, also leaving Eve Kinard, widow in community and the following heirs to wit M. L. Kinard, Danl. Kinard (decd) represented by his children, William Kinard decd., represented by his children, Tempe, widow of Danl. Webb, Rebecca widow of Wm. Webb decd. Mary, wife of Ansel Sawyer, Sarah wife of Alex D. Shaw, Elisabeth wife of John W. Bruce Jacob Kinard, Nancy wife of David H. Fairies, Polly, wife of Calvin F. Melvin, Catherine, wife of Russel Brazel, Elisa L. wife of Andrew J. Alphine (petitioner). Petitioner prays that an inventory and appraisement may be made according to law, and after due and legal proceedings having been had, that he may be appointed Administrator of the said Estate, and for such other orders and decrees as shall be necessary in the premises. Alphin be and he is hereby appointed Administrator of the Estate mentioned in the within petition. STATE OF LOUISINA PARISH OF UNION The premises considered it is ordered adjudged and decreed that the within application of A. J. Alphin to be appointed Administrator of the Estate of Graham Kinard deceased be advertised according to Law. It is further ordered and decreed that William C. Smith Parish Recorder and Ex Officio Notary Public in and for said Parish be and he is hereby authorized and empowered to make and inventory and appraisment of the property belonging to said Estate of Graham Kinard, and due return thereof make to this office without delay. STATE OF LOUISIANA PARISH OF UNION Know all men by these presents that we A. J. Alphin as principal and C. T. Melton & Jacob Kinard as his security are held and firmly bound unto W. B. Egan Judge of the 11th. Judicial District Court in and for the Parish & State before mentioned to his successors in office in the just & full sum of six thousand six hundred and fifty dollars, to the true and faithfull payment thereof well and truly to be made we bind ourselves our heirs and legal representatives firmly and in solido, by these presents. Dated at Farmerville, February 6th. A.D. 1862. The condition of the above obligation is such that whereas the said A. J. Alphin has been duly and legally appointed Admr. of the Estate of Graham Kinard Deceased, and he has taken the oath prescribed by law. Now therefore if the said A. J. Alphin, shall faithfully and impartially administer said Estate and shall render a correct and faithful account to the Judge of said Court for all moneys or other property belonging to said Estate, and shall render a true and faithful account of all his acts in and abut said Estate to the said Judge and whenever legally required so to do pay over all sums of money & deliver all the property or whatever nature belonging to said Estate to the proper person or persons to receive the same, then the above obligation to be null & void, Otherwise to be and remain in full force and virtue against the principal and his said Securities. Alphin has been duly and legally appointed Administrator of the Est. of Graham Kinard decd., and he has given bond & taken the oath required by law. Now therefore the said A. J. Alphin is hereby duly and legally authorized to do and perform all acts appertaining to said appointment in accordance with law. STATE OF LOUISIANA PARISH OF UNION The premises considered it is ordered and decreed that the within petition be granted, it is further ordered that the administrator be authorized to make said sale, upon the following terms t owit: All sums of five dollars and over to be sold on a credit of twelve months purchasers giving their notes with approved security and bearing eight per cent interest from date and all sums under five dollars cash reserving a mortgage & vendors privilege upon the land sold to secure the payment of the same.
