The petition of James Lowery, a resident of the Parish of Union, State of Louisiana with respect represents that his mother Elizabeth Lowery, late of the Parish of Union died intestate, in the Parish aforesaid on the 19th of May 1862 leaving a considerable estate situated in said Parish. He avers that his Mother left the following descendants, who are her sole heirs to wit: James Lowery, your petitioner, Mary, wife of Frank McClenden, Robert, James, Elizabeth, and Nancy, Bevins, Benj. and Emily Bennett, children of Nancy Lowery, deceased, Daniel, Rebecah, wife of Richard Pulliams, Thomas, George, Francis, Larkin and Elizabeth, wife of William Patton. He avers that an Administration is necessary and that as the oldest beneficiary heir, he should be preferred to any other. Wherefore he prays that he may be appointed Administrator of the succession of the said Mother, Elizabeth Lowery, and that an order be granted directing the Recorder of the Parish to make an inventory of the effects of the succession according to law. He further prays that his application be published according to law and for all other necessary orders in the premises and for general relief &c. Jas. T. Ludling, Atty. State of Louisiana 11th District Court Parish of Union It is ordered that the within application of James Lowery be advertised according to law. It is further ordered that Wm. C. Smith, Parish Recorder &c be and he is hereby authorized to make and inventory and appraisement of the property belonging to the Estate of Elizabeth Lowery, Decd. and due return thereof make to this office without delay. I, William C. Smith, Parish Recorder and Ex Officio Notary Public in and for said Parish duly commissioned and qualified, I repaired to the late residence of Elizabeth Lowery, Decd. or the residence of her son Larkin Lowery in said Parish of Union for the said purpose of making an inventory and appraisement of the property rights and credits belonging to said estate of said Elizabeth Lowery, Decd. being assisted by William Hopkins and William Tubbs, true, good and lawful citizens of the Parish of Union, who being duly appointed and sworn by me the said Recorder as appraisers and in the presence of two lawful and competent witnesses, we proceeded to make the following inventory and appraisement. Having completed the following inventory and appraisement, I have on this the 13th day of June closed the same, in testimony whereof, I have cause said appraisers to sign their names hereto in the presence of O. H. Youngblood and T. J. Oliver, two lawful and competent witnesses called for the purpose, who have also signed their names with said appraisers and me said Recorder on this the day and date above written, viz. Smith, Recorder State of Louisiana Parish of Union Know all men by these presents that we James Lowery as principal and Daniel Lowery, Francis McLelland as his securities are held and firmly bound unto W. B. Egan, Judge of the 11th District Court in and for the Parish and State aforesaid for the time being or to his successors in office in the full and just sum of nine thousand eight hundred and seventy dollars, the true and faithful payment thereof will and truly be made, we bind ourselves, our heirs and assigns, and legal representatives firmly by there presents. Dated at Farmerville, Louisiana June 17th 1862. The condition of the above obligation is such that whereas the above bounden James Lowery has been duly and legally appointed Administrator of the Estate of Elizabeth Lowery, Decd. and he has taken the oath in accordance with the Law. Now, therefore, if the said James Lowery shall faithfully and impartially discharge all the duties incumbent on him in said capacity as Administrator of said Estate and shall faithfully account to the Judge of the said court for all monies or other property belonging to the said Estate received from this or any other state and shall render a true and faithful account to the Judge of all his acts and doings in and about said Estate and whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature belonging to said Estate of proper person or persons to receive the same. Then, the above obligation to be null and void. Otherwise, to remain in full force and virtue. Done and signed in office the day and date above written. ATTEST: James Lowery Jas. L. Guthrie, Clerk Francis McLelland Daniel Lowery State of Louisiana 11th Judicial District Court Parish of Union I, James Lowery, do solemnly swear that I will faithfully and impartially discharge all and singular the duties devolving on me as Administrator of the Estate of Mrs. E. Lowery, Deceased State of Louisiana 11th District Court Parish of Union Whereas, James Lowery has this day been duly and legally appointed Administrator of the Estate of Elizabeth Lowery, Decd. and he has given bond with good lawful security according to law. Now therefore the said James Lowery is hereby duly and legally empowered to do and legally perform all the duties incumbent on him as Administrator of the above succession and appertaining to the said appointment according to law. Guthrie Clerk, District Court To the Honorable the Judge of the 11th Judicial District Court in and for Union Parish, State of Louisiana. The petition of James Lowery, a resident of said Parish, Administrator of the Estate of Elizabeth Lowery, Decd. late of said parish respectfully represents unto your honor, that the property of said estate was unproductive at present and expensive to keep and subject to waste and that it is also necessary in order to effect a partition amount the heirs, that the land should be sold. He therefore prays that an order may issue directing the sale of the real and personal property of the said Estate and that he be authorized to act as Auctioneer in making said sales and for such other and further orders in the premises as the case may require. Petitioner believing that it may be to the interest of the Estate prays that the land sale may be made on a credit of twelve months for all sums over ten dollars. H. Rebenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union Let the prayer of the within petitioner be granted and it is ordered and decreed that all the property both real and personal belonging to the Estate of Elizabeth Lowery, Decd. be sold under the articles of the Code of Practice regulating such sales. It is further ordered that James Lowery the Administrator of the said Estate be and he is hereby authorized to make said sale and to act as auctioneer therein and that said property be sold on a credit of twelve months for all sums over ten dollars.
