The petition of Thos. M. Everett, a resident of said Parish and State respectfully represents that Matilda A. Masterson departed this life on or about the second day of November AD 1862 at her residence in said Parish leaving five heirs, one of whom is a minor, also a considerable Estate consisting of land, slaves, personal property, rights, credits and debts. Petitioner represents that he is the husband of one of the heirs and prays that an inventory and appraisement may be made according to law and that after due proceeding had, he may be appointed administrator of the said estate and for such other orders and decrees in the premises as may be necessary. Everett to be appointed Admr. of the Estate of Matilda A. Masterson, Decd. be advertised according to law. It is further ordered that the Recorder of the Parish of Union be authorized to make an inventory and appraisement of all the property of said Estate and return thereof make to this offic3 without delay. Everett as principal and John P. Everett and W. D. M. Bruton his securities are held and firmly bound unto W. B. Egan, Judge of the 11th Judicial District Court in and for the Parish and State aforesaid for the time being and unto his successors in office in the full and just sum of Six thousand seven hundred twenty nine dollars 38/100, the true and faithful payment whereof well and truly to be made. We bind ourselves, our heirs, assigns, Administrators, Executives and legal representatives firmly by these presents dated at Farmerville on this the 19th day of November AD 1862. The condition of the above obligation is such that whereas the said Thos. M. Everett has been duly and legally appointed Admistrator of the Estate of Matilda A. Masterson, Decd. and has taken the oath prescribed by law. Now therefore, if the said Thos. M. Everett shall faithfully and impartially discharge all and singular the duties incumbent on his as Admr. of said Estate and shall faithfully account to the Judge of the said Court for all monies or property received by him belonging to said Estate from this or any other state and shall render a true and faithful account of all his acts and doings in and about said Estate to the Judge of said court and whenever legally required so to do, to pay over all sums of money and deliver all the property of whatever nature belonging to said Estate to the proper person or person to receive the same, then the above obligation to be null and void. A. Masterson, Decd. Pursuant to an order of the 11th Judicial District Court to me directed authorizing a sale of all the property of the Estate of M. A. Masterson, Decd. by me as Admr. of said Estate after having advertised said sale according to law on the 10th day of December 1862 at the residence of said Madelyn [sic] A. Masterson, decd. between the legal hours of sale I offered all the personal and perishable property of said Estate to the highest bidder at public auction for cash and having cried the same for a sufficient length of time all of said property was struck off to sundry parties purchasers for the aggregate sum of Twelve hundred and thirty one dollars and eighty seven cents and the purchasers having complied with the terms of sale. M. Everett, a resident of the Parish Sterling T. Cooper of Union, respectfully represents to the Judge of the parish Court that he the legally appointed Administrator of the Estate of Mrs. M. A. Masterson, Deceased has fully administered the same and has herewith filed in your honorable court his final account of his said Administration from which account it fully approved, that after returning to the said succession the land and sundry other assets as therein set forth said Estate is due the petitioner the sum of Four Hundred and Forty two and 62/100 dollars. Wherefore he prays that his final account be advertised according to law and that Mrs. Eliza M. Gothright and her husband Spencer Gothright as well as Stirling T. Cooper (the husband of Jane M. Cooper) they being heirs of said Estate be duly notified, and after the legal delays that the said final account be approved and homologated and that petitioner have judgment against the heirs of said Estate for four hundred and forty two and 62/100 dollars with legal interest from date of Judgment and that the bond of the administrator be cancelled for all orders and decrees necessary in the premises and for general & equitable relief &c. Masterson, Decd, by reason of the law and evidence in the premises being in favor of the same and by the further reason that this account has been advertised for according to law for more than ten days and no opposition having been filed thereto. It is hereby ordered, adjudged and decreed that the aforesaid account be approved and homologated and that T. M. Everett, Admr. have judgment against the heirs of the Estate of Mrs. M. A. Masterson, Decd. in solido for the sum of four hundred and forty two dollars and sixty two cents with 5% interest from the date and that the bond of the Admr. be cancelled.
