Mayes apparently died prior to 1860, for on the 1860 census, his widow A. D. Mays lived near Farmerville in the household of T. S. Thompson. Living with her were her children, Felix Mayes (born about 1850), Agnis (born about 1852), Ader (born about 1854), and Matthew (born about 1856). ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court holding sessions in and for the Parish of Union, State of Louisiana. The Petition of Augusta D. Mays, a resident of your said Parish and State with respects represents that she is the surviving wife of Mathew D. Mays, Deceased, who died in your above said parish and State intestate leaving four [sic] minor children, Phillip [sic - records below show his name was actually "Felix"] G., Agnes A. and Ada Mays issue of his said marriage with your petitioner. She represents that all the property of said succession one town lot and dwelling thereon situated in the Town of Farmerville, said Parish and State. That there are no debts due the Succession and none due by the same. Petitioner further represents that she is the Natural Tutrix of the said minors above named, that as such she has a right to be confirmed according to law. She further represents that said dwelling and premises are becoming dilapidated and destroyed to the prejudice and injury of the minors and heirs of said succession as aforesaid and that it is to the interest of the same that the property be sold. Wherefore the premises considered, your petitioner prays that she may be confirmed as Natural Tutrix of the said minor children of aforesaid issue of the marriage with her said deceased husband as aforesaid. She further prays that an order from your Honorable Court for the purpose of causing a family meeting to take the necessary steps for selling and disposing of the property above mentioned and direct to the Recorder of the Parish of Union ant that in absence of Relations of said minors that the following friends be convoked and appointed as members of a family meeting to wit: Hugh C. Glasson, Sterling C. Lee, James H. Thompson, Robert P. Lyle and William A. Glasson. Petitioner further prays for such other and further orders in the premises as the necessities of the case may require and duly bound. Ford & Brigham, Attys. State of Louisiana 11th Judicial District Court Parish of Union It is ordered and decreed that Augusta D. Mays be and she is hereby appointed Natural Tutrix of her following minor children to wit: Felix G., Agnes A. and Ada Mays and that upon her taking the oath required by law that letters do issue to her. It is further ordered that James W. Thompson be and he is hereby appointed Under tutor of said minors and that upon his taking the required oath that letters as such do issue to him. C. Smith, Parish Recorder and Ex Officio Notary Public in and for Union Parish, La. on Monday the 26th day of February 1866 at 12 o’clock AM consisting of Hugh C. Glasson, Sterling C. Lee, James H. Thompson, Robert P. Lyle and Wm. A. Glasson, relatives and friends of the minor heirs of the Estate of Mathew D. Mayes, Decd. to deliberate and decide upon the matters and things set forth in the said petition touching the interest of said minors and that due return of the proceedings thereof be made to this office without delay. Lewis Clerk, District Court Tutorship of the minor heirs of M. D. Mays, Decd. State of Louisiana 11th Judicial District Court Parish of Union Whereas, Augusta D. Mays has been duly and legally appointed Natural Tutrix of her following minor children to wit: Felix G., Agnes A., and Ada Mays and she has taken the oath prescribed by law. Now therefore the said Augusta D. Mays is hereby duly and legally empowered to do and perform all the acts appertaining to said appointment according to law. Thompson has been duly and legally appointed and confirmed as Under Tutor of the following named minor heirs of the Estate of M. D. Mayes, Decd. to wit: Felix G., Agnes A., and Ada Mays and he has taken the oath prescribed by law. Now therefore, the said James H. Thompson is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to said appointment according to law. Lewis Clerk, District Court To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of Augusta D. Mays, a resident of the Parish and State above and Natural Tutrix to her following named minor children to wit: Felix G., Agnes A. and Ada Mayes, heirs of the Estate of M. D. Mayes, Decd. respectfully represents unto your honor, that on the 26th day of February AD 1866 in pursuance of an order from your Honorable Court, a family meeting was convoked and held before Wm. C. Smith, Parish Recorder & Ex Officio Notary Public for said Parish for the purpose of deliberating and advising as to the propriety of selling a certain lot and the dwelling thereon situated in the Town of Farmerville belonging to the above named minors. The said family meeting recommends the sale of the said property as will fully appear from the process, verbal hereto annexed. Petitioner prays your honor that the proceedings of said family meeting being homologated and that an order issue from your Honorable Court authorizing petitioner to sell said Town lot and the dwelling thereon after due and legal advertisement and for all other orders and decreed necessary in the premises and for general relief. A. D. Mayes State of Louisiana 11th Judicial District Court Parish of Union By reason of the law and the evidence in this case and by further reason of the recommendation and advice of a family meeting, it is ordered, adjudged and decreed that the Town lot and dwelling thereon situated in the Town of Farmerville, La. belonging to the Estate of Mathew D. Mayes, Decd. be sold for cash in accordance with Articles 990, 991 & 992 of the Code of Practice and that Mrs. A. D. Mayes, Tutrix be authorized to make the said sale. It is further ordered and decreed that the proceeding of the family meeting in this case be approved and homologated in all its parts according to law. Done and signed in office this 20th day of July AD 1866. Thos. C. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 25th day of February AD one thousand eight hundred and sixty six pursuant to an order of the Honorable 11th Judicial District Court in and for the Parish and State aforesaid bearing date February 15th 1866 and to me William Smith, Recorder and Ex Officio Notary Public in and for said parish directed commanding me to convoke a family meeting consisting of J. H. Thompson, W. A. Glasson, H. C. Glasson, Sterling C. Lee and R. P. Lile, relatives and friends of the heirs of the Estate of Mathew D. Mayes Decd. to deliberate and decide upon the matters and things set forth in the Petition of Mrs. Augusta D. Mayes touching the interest of said minors, said members being convoked by me at my office in the Town of Farmerville this day and after being duly sworn by me proceeded to deliberate and advise touching the subject matter as set forth in said petition and after mature deliberation, they advise and recommend that the property belonging to the Estate of Mathew D. Mayes, Decd. as set forth in said petition, be sold and that Mrs. Augusta D. Mayes, Natural Tutrix for her minor children be authorized to make said sale or be made by the Sheriff of Union, La. according to law in such cases made and provided. Thus done and signed in my office in the Town of Farmerville in the presence of David Arent and John Bearden witnesses of lawful age and domicile who signs with said members and me recorder this the day and date above written.
