To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana The Petition of John P. Everett, a resident of said Parish respectfully represents unto your honor, that Duncan McBride Late of said Parish departed this life at his residence on or about the last of October AD 1862 leaving an Estate consisting of land and personal property right and credits. Petitioner represents that it is necessary that some person should administer on said Estate and therefore prays that an Inventory and appraisement be made according to law, and that after due proceedings having been had he may be appointed Administrator of the said Estate and for such other orders and decrees in the premises as may be necessary. H. Regenburg, Atty. State of Louisiana 11th Judl. Dist. Court Parish of Union The premises considered it is ordered and decreed that the application of John P. Everett to be appointed Administrator of the Estate of Duncan McBride, Decd. be advertized according to law. It is further ordered that the Recorder of the Parish of Union be authorized to make an Inventory of said Estate and return thereof make to this office without delay. Done and signed in office this 11th day of November AD 1962. W. C. Smith, Deputy Clerk State of Louisiana 11th District Court Parish of Union By reason of the law and the evidence and by further reason of proper advertizement having been made and no opposition being filed, it is ordered and decreed that John P. Everett be and he is hereby duly and legally appointed Administrator of the Estate of Duncan McBride, Decd. and upon his giving bond with good and sufficient security and taking the oath required by law that letters do issue to him according to law. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 17th day of November One Thousand Eight Hundred and Sixty Two, in pursuance of an order of the Honorable 11th District Court to me William C. Smith, Parish Recorder and Ex Officio Notary Public in and for said Parish, I repaired to the late residence of Duncan McBride, Decd. late of the Parish of Union and being assisted by George W. Murphy and James Watkins, two lawful citizens of the Parish of Union, who being duly appointed and sworn by me as appraisers proceeded to make an Inventory and Appraisement of all the property belonging to the Estate and Succession of Duncan McBride, Dec. as follows to wit: 100 Bushels Corn more or less apprd. @ $125.00 29 Head of hogs apprd. @ 125.00 1 Yoke of Oxen apprd. @ 50.00 3 Head Cattle apprd. @ 23.00 1 Mare and Colt apprd. @ 150.00 1 Lot Farming Utensils 10.00 Household and Kitchen furniture 40.00 1 box Carpenter's Tools apprd. @ 50.00 4000 pounds Seed Cotton more or less apprd. @ 80.00 30 Gal. Molasses more or less apprd. @ 15.00 50 Lbs. Sugar more or less apprd. @ 5.00 160 acres of land situated in Union Parish numbered as following, the SE ¼ of the SW ¼ of the W ½ of SE ¼ of SE ¼ of Section 15 and the SW ¼ of NE ¼ Sec. 15 Township No. 23 Range No. 1 East apprd. @ __$960.00 Total Amount $1633.10 Having completed the foregoing Inventory and appraisement I have on this the 17th day of November AD 1862 closed the same. In testimony whereof I have cause said appraisors to sign their names hereto in the presence of the undersigned lawful witnesses, who have also signed their names with said appraisors and me the said Recorder on this the day and date above written. Everett has this day been duly and legally appointed Administrator of the Estate of Duncan McBride, Decd. and he has given bond with good Security and taken the oath prescribed by law. Now therefore the said John P. Everett is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to law. Buckley as his securities are held and firmly bound unto W. B. Egan, Judge of the 11th Judicial District Court in and for the Parish and State aforesaid for the time being or to his Successors in office in the full and true Sum of Two Thousand and forty six Dollars, the true and faithful payment whereof will and truly to be made. We bind ourselves, our heirs, assigns, Administrators, Executors and Legal representatives firmly by these presents. Dated at Farmerville this the [blank] day of November 1862. The condition of the above obligation is such that whereas the said John P. Everett has been duly and legally appointed Administrator of the Estate of Duncan McBride, Decd. and has taken the oath prescribed by law. Now therefore if the said John P. Everett shall faithfully and impartially dismiss all and singular the duties incumbent on him as Administrator of said Estate and shall faithfully account to the Judge of the said Court for all moneys or property received belonging to said Estate from this or any other state, and shall render a true and faithful account of all his acts and doings in and about said Estate to the Judge of said court and whenever legally required so to do to pay over all sums of money and deliver all the property of whatever nature belonging to said Estate to the proper person or persons to receive the same, then the above obligation to be null and void, otherwise to be rendered in full force and effect against the principal and his said securities. Everett, Administrator of the Estate of Duncan McBride respectfully represents that the said Estate is indebted to an amount that makes it necessary that all the property of the same should be sold. He therefore prays for an order to sell all the property real and personal of said Estate. The personal property for Cash and the land on a credit of twelve months, that he be authorized to make the sale and for such other orders as may be necessary. H. Regenburg, Atty. Further that the Administrator be authorized to make said sale on the following terms to wit: the personal property for cash and the land &c on a credit of twelve months. Petitioner prays that this accounting be filed and advertised and after due proceedings had, that it may duly homolgated and allowed in all its parts, and that Judgement may be rendered accordingly and that his bond as Administrator be canceled and for general relief. H. Rebenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered it is ordered and decreed that the within final account of John P. Everett as Administrator of the Estate of D. McBride, Decd. be advertised according to law. Done and signed in office on this the 5th day of April AD 1864. Thos. C. Lewis, Clerk Succession of Duncan McBride, Decd. Homolgation of the final account filed by Jno. P. Everett as Admr. of the Estate of Duncan McBride, Dec. 1st vouchers filed with said account. 2nd Thomas C. Lewis, Clerk of the District court sworn says that the said final account was filed in the Clerk's office on the 5th day of April AD 1864 and has been duly advertized for more than thirty days prior to this date, and that no opposition has been filed to the homolgation of the same. Smith, Parish Recorder I hereby certify the above and foregoing to be all the evidence adduced on the homolgation of the final account filed by John P. Everett as Administrator of the Estate of Duncan McBride, Decd. Given under my hand and seal of office this the 3rd day of September AD 1964. Thos. C. Lewis Clerk, Dist. Court State of Louisiana 11th Judl. Dist. Court Parish of Union By reason of the law and the evidence in the matter of the homolgation of the final account filed by Jno. P. Everett as Administrator of the Estate of Duncan McBride, Decd. and by reason of the proper advertizement having been made and no oppositions being filed to the homolgation of the same, it is therefore ordered, adjudged and decreed that the said final account be allowed, approved and homolgated in all its parts according to law. It is further ordered and decreed the heirs of said Estate do have and receive of the said Jno. P. Everett, Admr. the sum of seven hundred and thirty nine and 42.100 dollars $739.42 and that the bond of said Administrator be cancelled upon his producing and filing a receipt for the same.
