The petition of Alvin W. McCormick, a resident of your Parish and State aforesaid, respectfully shows that sometime since his mother Mrs. Sarah McCormick departed this life in your said Parish and State Intestate, that she left general heirs residing in Union parish and others absent from the State together with a small property consisting of some land as well as some perishable property and also leaving some debts to be paid. The following heirs Henrietta McCormick (wife of Lewis Reppond), Mary McCormick (wife of Boyett) now deceased but represented by minor children, Emily (wife of Chas. Dildy), Henrietta (wife of James Jeter) deceased but represented by minor heirs, together with your petitioner resides in Union Parish, Louisiana, while Terresa McCormick (wife of Nathan Griffin) and Sarah McCormick (wife of Wm. McBroom) are both deceased while residing in Tennessee, and Ann McCormick (wife of James Shenault) has deceased in the state of Mississippi. Petitioner adds that an administrator is necessary and that an inventory ought to be made and that being the only male heir of age or represented in the State, he has the right to administer. Wherefore he prays that after the usual advertisement and delays that he, your petitioner, be appointed administrator of said Estate for all order and decrees necessary in the premises for general relief &C. Carson, Deputy Recorder To the Honorable the Judge of the Clerk of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana The petition of Alvin McCormick, a resident of your said Parish and State respectfully shows that he has been duly appointed and qualified by your Honorable Court as Administrator of the Estate of Sarah McCormick, deceased, that an inventory of said Estate has been made. It is on file in your court from said inventory. It appears that there is certain perishable property belonging to said Estate which property if kept would deteriorate in value, that the debts due by the same Estate are not pressing, that it would be better to sell the said property (consisting of these: 9 head cattle, 1 gun, 1 pistol, household and kitchen furniture and carpenter’s tools and sundry other things to many to mention) on a credit till say January 1st 1862. Wherefore petitioner prays for all orders of your Honorable court authorizing him as Administrator to sell all of the perishable property of the Estate of Sarah McCormick, Decd. according to law on a credit til January 1st 1863 for all sums over five dollars. Purchasers giving their notes with approved security and bearing eight percent interest from date of sale and sums under five dollars Cash. The petition of Alvin W. McCormick, a resident of your Parish and State aforesaid respectfully shows that some time since his mother Mrs. Sarah McCormick departed this life in your aforesaid Parish and State intestate that she left several heirs residing in Union aforesaid and others absent from the State together with a small property consisting of some Land as well as some personal and perishable property and also leaving some debts to be paid. That he has completed the administration of said Estate and herewith files his final account showing a balance against himself of four hundred and ninety Dollars and eighty four cents for which he will account to the heirs on a partition of said Estate. Wherefore he prays that this his first account be advertized according to law and after the legal delays the same be approved and homolgated in all its parts and for his bond to be cancelled and for general relief &c. Lewis, Clerk of the District court sworn says, that the final account was filed in the Clerk's office on the 3rd day of March AD 1864 and has been legally advertized in the following manner to wit: by posting a copy of the advertizement at the Court House doors in the Town of Farmerville and by handing a copy of said advertizement to L. Kern to be posted at Downsville in the said Parish of Union and by handing a copy thereof to W. D. Slayton to be posted at Shiloh and that said account has been advertized for more than thirty days and there has been no opposition filed to the Homolgation of the same up to the present date. State of Louisiana 11th Judicial District Court Parish of Union By reason of the law and the evidence in this case and by further reason of the proper advertizement having been made and no opposition being filed to the homolgation of the foregoing final account, it is ordered, adjudged and decreed that this the final account of Alvin W. McCormick as Administrator of the Estate of Sarah McCormick, Decd. be and the same is hereby homolgated in all its parts according to law. It is further ordered and decreed that the heirs of the said Estate of Sarah McCormick, Decd. do have and recover of the said Alvin W. Mccormick, Admr. the sum of four hundred and ninety Dollars and eighty four cents and that upon his producing and filing a receipt for the same that his bond as Admr. be cancelled. The petition of Alvin W. McCormick and Henrietta Reppond (a force sole [sic]) Fennetta McBroom, wife of James McBroom who joins herein to aid and authorize his said wife, Emily Dildy, wife of Charles Dildy who joins herein to aid and assist and authorize his said wife, all residents of the Parish and State aforesaid respectfully shows that they together with their five others to wit: Mancy Boyt, Frances Jetter, Sarah McBroom, Teresia Griffin and Ann Sheppard all of whom are now deceased, but represented by their descendants (which descendants are all scattered and personally unknown to petitioner in consequence of which their values and residences cannot now be specially set forth) are the legal heirs of the estate of Sarah McCormick, Decd. which said Estate has been legally administer4ed and is now ready to be partitioned among the heirs according to law, that said Estate consists of land and notes which cannot be partitioned in kind but a Judicial Partition is desired. Wherefore Petitioners prays that the legal representatives of the said Nancy, Francis, Teresia, Sarah and Ann McCormick be duly cited according to law to answer hereto and that they with petitioners be recognized as the legal heirs of the Estate of Sarah McCormick, decd. That a sale of the property be ordered and that an inventory of the property as 2well as q partition of the said estate, that W. C. Smith, Parish Recorder together with [blank] and [blank] except be induced to make the said partition that a curator ad hoc or attorney for the absentees be appointed on whom service may be made for all further orders and decrees necessary in the premises be made and that the Estate bear the cost of the partition and for general relief &c Jno. McCormick vs. heirs of Mary Boyt et. al for a partition of the property of the Estate of Sarah McCormick, decd. the premises considered and the District Judge being absent from the Parish, it is hereby ordered, adjudged and decreed that J. E. Tremble be and he is hereby appointed Attorney Ad Hoc for the absentees set forth as defendants in the foregoing partitions. Done and signed in office this September 3rd 1866. J. W. W. McCormick, Mrs. Henrietta Reppond, Fenetta McBroom, wife of James McBroom, Emily Dildy, wife of Charles Dildy, Mary McCormick Boyt, decd. Francis McCormick Jetter, decd., Sarah Mccormick McBroom, decd. Teresia Griff, Decd., Ann McCormick, Decd. the last five representatives by their children are hereby recognized as the sole legal heirs of the Estate of Sarah McCormmick, decd. and it is further ordered that there be a partition of the said Estate among the said heirs and an Inventory of the property to be had, also be ordered and also a sale of the said property for the purpose of affecting said partition and that A. W. McCormick the former Administrator be authorized to make said sale according to law and it is further ordered that W. C. Smith, notary public make the aforesaid Inventory and Appraisement. Also, after the sale that the make the said partition among the heirs and that [blank] and [blank] be and they are hereby appointed experts to assist in making said partition and that the cost of all these proceedings be bound by the Estate. McCormick, Mrs. Henrietta Reppond, Fenetta McBroom, wife of James McBroom, Emily Dildy, wife of Charles Dildy, Mary McCormick Boyt, decd., Francis McCormick Jetter, decd., Sarah McCormick McBroom, Deceased, Teresia Griffin, Decd. and Ann McCormick, Decd. making in all nine heirs which are recognized ad the sole heirs of Sarah McCormick, decd. and being represented as follows: A. W. McCormick presents and James E. Tremble, attorney representing the absentees. Amount retained in the hands of the Administrator to pay the following debts: To Union Record, printers fees $9.00 To Clerk, District Court 13.50 To Wm. C. Smith, Recorder 10.00 To Taxes paid for Estate 9.25 To Attorney’s fees __25.00 Amount sixty six & 75/100 dollars 66.75 After paying the above debts the assets of said Estate consists in cash three hundred twenty six and 85/100 dollars $326.85 Charles Dildy notes with interest up to date 227.17 Wm. T. Porter note with interest __59.00 $663.62 There being nine heirs each distribution shows is seventy three & 73/100 dollars, thirty six and 31/100 dollars in cash, U. S. Treasury notes and thirty seven and 42/100 dollars in the above described notes. In testimony whereof, I have caused said experts to sign these presents with me , Recorder together with A. W. McCormick one of the heirs and James E. Tremble, attorney for the absent heirs, in the presence of David Arent and James A.
