McFadin, Decd. To the Honorable the Judge of the Probate and 12th Judicial District Court in and for the Parish of Union, State of Louisiana. The Petition of Jane A. McFadin and James A. Creath Co Administrators of the Estate of Thos. M. McFadin, Deceased residents of your said Parish and State respectfully represents unto your honor that there is of the said Est. a considerable amount of perishable personal property that the material interest of the Succession require to be sold. That their interest of the Estate demand the selling of such property on terms of Cash for all sums under Ten dollars and on a credit until the first day of March 1861 for all sums over ten dollars. Wherefore they pray you Hon. Court or the Clerk thereof for an order of sale in conformity with the above obligation on the 24th day of November 1860 and for such other orders as the premises may require and for general relief &c. Jno. W. Thomas, Atty. State of Louisiana 12th Judl. Dist. Court Parish of Union Succesion of T. M. McFadin, Decd. The petition considered it is ordered that the prayer of petitioners be granted. It is further ordered that all the perishable personal property belonging to the Estate of Thomas M. McFadin, Decd. be sold on the following terms for all sums of ten dollars and over on a credit until the first day of March 1861, purchasers giving their notes with approved security having Eight per cent Interest from date until paid. All sums under ten dollars, Cash. It is further ordered that Jane A. McFadin and James A. Creath, Co Administrators of said Estate be authorized to make said sale on the 17th day of November AD 1864. Over $10.00 on a credit until the first day of March 1861 giving their notes with approved and good security bearing 8 per cent interest from day of Sale, Nov. 17th 1860. Made, prepared and signed in this the 17th day of November AD 1861 in the Parish and State aforesaid in presence of Jno. W. Thomas & good and lawful witnesses domiciliated in the said Parish and State. ATTEST: Jane A. McFadin [blank] James A. Creath Jane A. McFadin and James A. Creath Co Administrators in account with the Estate of Thomas M. McFadin, Decd. The administrators charge themselves with the amount of the Inventory of said Estate made by Wm. C. Smith, Recorder and filed in the Clerk’s office on the 25th day of August AD 1859 viz. Twelve Thousand Two hundred and Thirteen & 50/100 Dollars $12213.50 They further charge themselves with the net proceeds of the Cotton Crops of 1859, 28 Bales 1167.73 The Administrators herewith return the following found upon the Inventory for which they claim a credit as follows: They return the whole of the land 600 acres more or less @ $4.00 per acre 2400.00 Also the Negro Woman Rachel @ 1300.00 Also Man Robert Carter @ 1600.00 Also Man Anthony @ 1500.00 Also Man Gillis @ 1425.00 Also 1 Gun Stand @ ____50.00 Amount returned as belonging to the Estate $8275.00 They also ask for a credit for two Negroes claimed by the widow as her separate property and appraised as such, Matilda appraised @ $1250.00 And Jack 66 appraised @ ___800.00 Amount of separate property returned $2050.00 They also claim a credit for the difference between the appraised value of the property of the Estate sold and the actual amount for which said property sold (it selling for less than the appraisement by the sum of four hundred & fifty seven 50/100 Dollars) 457.50 The administrators have paid debts of the Estate as follows for which they claim a creit viz. The petition of Jane A. McFadin and James A. Creath, both of your aforesaid Parish and State, respectfully represents that they have been appointed joint and Co Administrators of the Estate of T. M. McFadin, decd., that they have administered the same and have filed the foregoing as a full and complete and final account of their said administration. All of the debts of the said Estate have been paid. From the foregoing account, it appears that the Estate is due the admrs. the sum of Six hundred and Seventy seven & 69/100 Dollars, the whole of the Estate is community property (except the two slaves appraised as paraphernal property and belongs to the surviving widow of your petitioners jointly with her two minor children, the said heirs of the Estate of T. M. McFadin aforesaid of which said minor children your petitioner Jane A. McFadin has been recognized by your Honorable Court as the Natural Tutrix and the whole property rightfully belongs in her hands where it now is. Wherefore your petitioners pray that the foregoing final account be advertised according to law and after the legal delays there the same be approved and homolgated in all its parts. That there be judgment in favor of your petitioner Jane A. McFadin and against the Estate for the balance shown to be due her by said accounts. That the bond of the Administrators be cancelled and they released from all further responsibility upon the same and for general relief &c. Jno. L. Barrett, Atty. State of Louisiana Parish of Union The premises considered it is hereby ordered and decreed this the foregoing account of Jane A. McFadin and James A. Creath be advertised according to law. McFadin, Co Administrators of said Succession 1st Vouchers filed with the final account 2nd Thos. C. Lewis, Clerk of the District Court sworn said that the final acct. was filed on the 5th day of February 1864 and has been legally advertised in the following manner, by posting a copy of the advertisement at the Court House door in the town of Farmerville and by handing two copies of the advertisement to David Arent to be posted in two other public places in the Parish of Union, that said advertisements has been posted for thirty days and that there has been no oppositions filed to the Homolgation of said final account. Thos. C. Lewis, Clerk W. C. Smith, Recorder 3rd David Arent sworn says that Thos. C. Lewis handed him two copies of the advertisement, which he handed to [blank] to be posted at [blank] and to [blank] to be posted at [blank] in said Parish of Union. D. Arent Sworn to and subscribed before me on this the 2nd day of April 1864 Thos. C. Lewis, Clerk I hereby certify the above to be all the evidence adduced on the homolgation of the final account in the Estate of Thos. M. McFadin, Decd. Given under my hand and seal of office on this 3rd day of April AD 1864. Thos. C. Lewis, Clerk. Homolgation of the final account filed by Jane A. McFadin and James A. Creath, Co Administrators of the Estate of Thos. M. McFadin, Decd. State of Louisiana 11th Judl. Dist. Court Parish of Union By reason of the law and the evidence in the case and by reason of the said final account having been filed and duly advertised for more than thirty days and no opposition being filed thereto, it is ordered, adjudged and decreed that this final account be approved and homolgated in all its parts and that the bond of the aforesaid Admrs. be cancelled and they be released from all further responsibility in the administration. It is further ordered that there be Judgment against the Estate of the said Thomas M. McFadin and in favor of Mrs. Jane A. McFadin for the sum of Six hundred and seventy seven & 69/100 dollars $677.69. Done and signed in office in this the 2nd day of April AD 1864. Thos. C. Lewis Clerk, Dist. Court A True Record.
