Court sworn says that the account final has been filed in the clerks office and that it has been duly advertised according to law for more than thirty days. I hereby certify the aboce to be all the evidence adduced on the trial of the Homolgating of the final account of W. C. Smith as Admr. Of the Estate of Samuel Montgomery, Decd. this 1st Decr. Disct Court Parish of Union By reason of the law and the evidence in this case being in favor of petitioner and by further reason of the proper advertisement having been made and no opposition filed thereto. It is ordered adjudged and decreed that the within and foregoing account of Wm. C. Smith as administrator of the Estate of Samuel Montgomery be allowed approved and homolgated in all its parts according to law. Done and signed in office on this the 1st dayof December AD 1860. Thos. Lewis Clerk of Said Court ================================================================================== Union Parish Louisiana Succession Book E, pp. 753 - 755 ================================================================================== To the Honorable the Judge of the 12th Judicial District Court within and for the Parish of Union and State of Louisiana. The petitioner James P. Montgomery, a resident of your said Parish respectfully represents unto your honor that Saml. Montgomery, his father, died in the Parish of Union on or about the 28th day of June 1855, leaving a widow, the mother of petitioner, and several minor children. Your petitioner being one of the number and that his mother Catharine Montgomery was appointed by your Honorable Court Administratirx and Natural Tutrix to her children. Petitioner further represents that Catharine Montgomery departed this life in the Parish of Union on or about the 4th day of October 1855, and that Wm. C. Smith was appointed Administrator of said Estate by your Honorable Court and after due course of Administrations, the said Wm. C. Smith filed his final account of said Estate showing that the said Admr. is indebted to said Estate in the sum of nine hundred and ninety two and 78/100 dollars. Petitioner further represents that four of his sisters are still minors and one at this time is without a Tutor. Petitioner prays that he may be appointed Tutor of his three minor sisters viz. Louisa F., Catharine V. and Martha E. Montgomery and for all other orders in the premises and for general relief. James P. Montogmery State of Louisiana 12th Judicial District Court Parish of Union The premises considered it is ordered and decreed that James P. Montgomery be and he is hereby appointed Tutor to his three minor sisters to wit: Louisa F., Catharine V. and Martha E. Montgomery, heirs of the Estate of Saml. Montgomery decd., and upon his giving bond and good security and taking the oath prescribed by law that letters do issue to him. Done and signed in office on this the 22nd day of March AD 1861. Thos. C. Lewis, Clerk State of Louisiana 12th Judicial District Court Parish of Union Know all men by these presents that we James P. Montgomery as principal and James Edwards as his security are held and firmly bound unto R. W. Richardson, Judge of the 12th Judicial District Court in and for the Parish and State aforesaid for the time being or to his successors in office in the full and just sum of six hundred and thirty Dollars, the true and faithful payment whereof well and truly to be made. We bind ourselves, our heirs, assigns, administrators, Executives and legal representatives firmly by these presents. Date at Farmerville, Louisiana March 22nd 1861. The condition of the above obligation is such that whereas the said Jas. P. Montgomery has been duly and legally appointed Tutor of the minor heirs of the estate of Samuel Montgomery, Decd. to wit: Louisa F., Catharine V. and Martha E. Montgomery and he has taken the oath prescribed by law. Now therefore if the said James P. Montgomery shall faithfully and impartially discharge all the duties incumbent on him in his said capacity and shall faithfully account to the Judge of said Court for all monies or property received from this or any other state and shall render yearly to the Judge of said Court a true and faithful account of all his acts and doings in and about said matters of Tutorship and shall faithfully look after the body of said minors and study their interest in all things and shall whenever legally required so to do, pay over all sums of money and deliver all the property of whatever nature to the said minors or to their legal representatives or to the proper person or persons to receive the same, then the above obligation to be null and void. Otherwise to be and remain in full force and effect against the principal and his said securities. James Montgomery James Edwards Done, signed and acknowledged on the day and date above written. Montgomery do solemnly swear that I will faithfully and impartially perform all the duties incumbent on me as tutor to the following minor heirs of the Estate of Saml. Montgomery, Decd. to wit: Louisa F., Catharine V. and Martha E. Montgomery according to the best of my ability and understanding. So help me God. James P. Montgomery is hereby duly and legally authorized and empowered to do and perform all the duties appertaining to said appointment according to law.
