The petition of Daniel Payne, a resident of your said Parish and State respectfully represents unto your Honour that John A. B. Nash, late merchant died intestate in the Town of Farmerville on the seventh of September leaving a considerable amount of property real and personal consisting of Dry goods &c and Town lots in the Town of Farmerville. Petitioner represents that the heirs or most of them of the said J. A. B. Nash are absent from and not represented in the State, that his estate is vacant and that your petitioner is a creditor to a considerable amount. Wherefore he prays your Honour that an inventory be taken of the effects of said Succession and after said inventory has been taken that your Honour appoint a provisional guardian for said property until curators can be legally appointed. Petitioner further represents that being the creditor of said Nash as afore stated, he prays your Honorable to be appointed Curator of the Estate of said Decedent and for all such other orders as may be necessary and just and your petitioner as in duty bound &c. May & McGill, Atty. State of Louisiana Probate Court Parish of Union The foregoing and within application of Daniel Payne to be appointed Curator of the vacant Estate and Succession of John A. B. Nash being advertised according to law by advertising and posted up at the Court House door in the Town of Farmerville from the 18th day of September to the 2nd day October AD 1845 and no opposition having been made thereto. It is therefore ordered that Daniel Payne be appointed Curator of the vacant Estate and in succession of John A. B. Nash upon his taking the oath and giving bond according to law and that letters of Curatorship issue accordingly and it is further ordered that an inventory and appraisement of said Estate and Succession be made by Thomas VanHook, a Notary Public according to Law. Done and signed in Open Court on this the 2nd day of October 1845. John Taylor Probate Judge And that Needom Bryan, Attorney at Law be appointed to the absent Heirs. State of Louisiana Court of Probate Parish of Union This is to Certify that Needom Bryon, Attorney at Law, has been duly and legally appointed Counsel to the absent Heirs of John A. B. Nash desks and drawers in the said apartments and also all other goods, demands, accounts and property which came to our knowledge as appears in the foregoing letters and figures contained in the proceeding twenty one pages which appraisement all together amounts to four thousand one hundred and ninety six dollars and eighty nine and half cents as appears at the foot of the said Inventory and Appraisement and having completed the said Inventory and Appraisement of property of the said John A. B. Nash, we proceed to close the same by the said parties being present and signing these proceedings, Thos. VanHook and Robert Lassiter objecting to their accounts as Inventoried. The Petition of Daniel Payne, a resident of Union Parish, State above named and Curator of the Estate of John A. B. Nash, Deceased with respect sheweth that John A. B. Nash left at his decease a considerable amount of property. He says he was appointed Curator of said Estate. He says said property or a considerable portion is or might be liable to waste and that the said property is at a continual expense and that a portion of it cannot be put under lock and key and might be taken off or destroyed by many accidents. Therefore he prays your Honor, to cause the effects comprising said succession both real and personal to be advertised and sold as follows. All amounts under the sum of ten dollars to be cash and all over that amount sold on a credit of a few months, say all of said amounts to be due by the first of March next with eight per cent interest after due till paid with notes and approved security. He prays that the same may be allowed and Homologated after due and legal advertisement and that he be allowed to pay the same in due course of administratorship for general relief in the premises as in debt bound.
