The petition of Alexander Nelson of the aforesaid Parish and State respectfully states on or about the 23rd February AD 1861, Ashley S. Nelson departed this life at his residence in the Parish of Union, aforesaid intestate leaving a considerable Estate and with it some debts. He also left a surviving widow together with your petitioner, his son, which is a major and seven other children, all minors and all the issue of the marriage of Decd. with Nancy M. Nelson, his aforesaid surviving widow to wit: George W., Noel, Thos. B., John H., Ashley B., Ambrose and Nancy Anna Matilda Nelson. Petitioner asks that an administrator of the Estate is necessary in order to liquidate and pay the debts of said Estate and that he being the only son of age and respectfully prescribed in the State is of a right entitled to the said administrator. Wherefore he prays that this his petition be advertised according to law, and after due and legal delays upon petition executing, bind according to law, he be appointed administrator of the Estate of Ashley B. Nelson, Decd. and that letters of Administration do issue to him according to law and he further prays that an inventory and appraisement of the said Estate be made according to Law and for all orders and decrees necessary in the premises and for general relief &C. State of Louisiana 12th District Court Parish of Union The premises considered it is ordered and decreed that the within application of Alexander Nelson to be appointed administrator of the Estate of Ashley B. Nelson, Decd. be advertised according to Law. It is further ordered that William C. Smith, Parish Recorder & Ex Officio Notary Public in and for said Parish and State be and he is authorized to make an inventory and appraisement of the property belonging to the Estate of Ashley S. Nelson, Decd. and upon his giving bond and good security taking the oath prescribed by law that letters be issued him. Done and signed in office on this the 16th of March AD 1861. Thos. C. Richardson, Judge of the 12th District Court in and for the Parish and State aforesaid or to his successors in office in the sum of Twenty Three Thousand Seven Hundred Dollars to the true and faithful payment thereof. We bind ourselves our heirs and assigns in sole on this the 14th day of March AD 1861. The condition of the above obligation is such that whereas the said Alexander Nelson, has been duly appointed administrator of the Estate of Ashley S. Nelson, Decd. and he has taken the oath prescribed by Law. Now therefore if the said Alexander Nelson shall faithfully administer said estate and shall do and perform all the acts in and about said Estate and shall render a true and exact account to the Judge of said Court or to his successors in office or to the legal heirs of said Estate wherein required legally so to do, then this obligation to be null and void otherwise to be and remain in full force and effect against the principals and his said Securities. Nelson, deceased, late of the Parish of Union, La. I, Wm. C. Nelson respectfully shows to your Honorable Court that A. S. Nelson, her late husband departed this life about the 23rd of February last 1861 leaving seven minor children all the issue of the marriage of said A. S. Nelson with your petitioner, said minor, to wit: George W., Noel, Nancy Ann Matilda, Thos. B., John H., Ashley B., Ambrose Nelson being the lawful children of Petitioner. She suggests that she is their Natural tutrix and she prays that she be confirmed as Natural tutrix to the said minors and that letters of Tutorship do issue to her on her taking the oath prescribed by law for all orders and decrees necessary in the premises and for general relief &C. Reid, Clerk and to me as Sheriff of said Parish and State directed bearing date the 17th day of November 1866, I did proceed on the same day and date to advertise by posting at the court House door, and by causing the same to be made known in the Union Record a newspaper published in Union parish, la. by Tompkins and Lewis all the property belonging to the Estate of Ashley S. Nelson, Decd. to sell on this 20th day of December 1866 at public outcry at the domicile of said named Decd. whereas on said day, I did repair to the domicile just named and within the legal hours after reading the advertisement and order as well as the certificate of mortgage furnished me by W. I did proceed to the sale of all the property on the Inventory of said Estate which resulted as is herein after specified the personal property selling for cash and the land on twelve months credit purchasers giving their notes with approved security bearing 8 per cent interest per annum from maturity which said land I do hereby sell and adjudicate to the purchaser named below at the same time retaining a mortgage with vendors privileges upon the land to secure the punctual payment for the same. Nelson, decd. made by Wm. C. Smith, Notary Public on 13th March 1861 and dates filed in the district clerks office March 15th 1861 to wit, the sum of Eighteen thousand nine hundred and fifty three dollars. 18953.00 The Admr. aforesaid is entitled to the following Credits: Credits First, all of the land of said Estate viz. 1383 acres more or less is hereby returned to the Estate for which he should be credited the amount of its appraised value to wit Four thousand one hundred and forty nine dollars 4149.00 Second the Admr. is charged with the value of certain negro property belonging to said Estate on amounting as per said Inventory to Eleven thousand nine hundred and fifty dollars and said negroes having been emancipated by the Government, the said Admr. is entitled to a credit in this account for the said amount with which he has been charged 11950.00 The Admr. having kept the said Estate together during and made it more than self sustaining now, returns all of the personal property of said Estate much increased in value by his labors and he is entitled to a credit for the amt. of its appraised value to wit, Two thousand eight hundred and fifty four dollars 2854.00 The Admr. has paid the following debts of the Estate during his term of Administration knowing them to be just and believing the Estate to be solvent [?] general favor. Fees for filing the account as well as for all previous services rendered by Jno. L. Barrett, Atty. for A. Nelson, Admr. Also a large sum to N. Bretton, a large sum to A. H. Boyd and various small debts but that the assets of the Estate are amply sufficient to pay all its liabilities. Therefore Pettioner prays that the foregoing final account of Alexander Nelson, Admr. of the Estate of A. S. Nelson render by petitioner as Admr. of Alexander Nelson Estate be advertised according to law, that the heirs be duly notified and after the legal delays the same be approved and homologated in all its points and that the bond of said A. The petition of Amanda Sellars nelson, Admx. Of the Estate of Alexander Nelson, Decd. a resident of your aforesaid Parish and State respectfully shows that she has herewith filed a full and complete and final account of the Administration of the Estate of Ashley S. Nelson, Decd. by Alexander Nelson having failed to render said account during his life. From said account, it appears that said A. Nelson, Administrator was chargeable with the amount of Inventory to wit: $18953.00, that he should be credited with the land returned to the $4149.00, also with the appraisement of Negroes $11,950.00. And he should also be credited with the personal property which he herewith returns with some few slight exceptions and these exceptions entirely the result of keeping the property together during the war. The personal property returned, therefore Petitioner claims the credit of the appraisement of $2854.00 which leaves the Administrator and the Estate just even. There is no claim made for the services of the Administrator in as much as he with his brothers and sisters were the sole heirs of the Estate and as the property was kept together and managed by him until his further mutual benefit of all of them. Petitioner further represents that the said Alexander Nelson paid debts of the Estate as appears from said account.
