The petition of Martha E. Nickolson, a resident of your Parish with respect represent that her husband W. O. Nickolson died in Stuart County, Georgia in November AD 1873 leaving your petitioner his surviving widow and three minor children the issue of your petitioner and W. O. Nickolson, decd. Your petitioner further represents that there is one hundred acres of land situated in the County of Stuart, State of Georgia belonging to the Estate of W. O. Nickolson, Decd., that your petitioner is the Natural Tutrix of her minor children, but before letters of Tutorship can issue it is necessary for an inventory to be made. Wherefore your petitioner prays that an order issue from your Honorable Court directing W. C. Smith, Recorder and Ex Officio Notary public to make an Inventory of the property belonging to the Estate of W. O. Nickolson, Decd. and that after said inventory has been made, that letters of Tutorship issue according to law. Ellis & Roberts, Attys. Parish of union Parish Court State of Louisiana Premises considered, it is hereby ordered and decreed that W. C. Smith be ordered to make an inventory of all the property belonging to the Estate of W. O. Nickolson, Decd. and make return of the same to this office and after said inventory let Martha E. Nickolson be permitted to qualify as Natural Tutrix of her minor children, Marcellus, Mary and Marcus and letters of Tutorship issue accordingly and Samuel P. Leggett be appointed Under Tutor. Thos. C. Lewis Parish Judge I do solemnly swear that I will faithfully and impartially appraise the property that may be presented to me belonging to the Estate of W. O. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 23rd day of January AD Eighteen hundred and seventy three (1873) by virtue of an order of the parish Judge in and for the Parish of Union, La. and to me William C. Smith, Recorder and Ex Officio Notary Public in and for the Parish of Union and State aforesaid directed authorizing and commanding me to make an inventory and appraisement of the property composing the Succession of W. O. Nickolson, Decd. late of Stuart County in the State of Georgia and whereas being assisted by G. H. Ellis, A. T. Lott, males of lawful age and domicil who being duly appointed and sworn by me as appraisers and in presence of lawful and competent witnesses proceeded to make said inventory and appraisement as herein after set forth. The only property presented belonging to the Estate is one hundred acres of land situated in Stuart County, Georgia pointed out by Mrs. Martha E. Nickolson and valued by the appraisers to be worth according to the information received Five hundred dollars ($500.00). Thus done and signed in my office in the present town of Farmerville on this the day and date first above written in presence of the undersigned lawful and competent witnesses who sign with said appraisers and me Recorder and Notary. Nickolson has been duly and legally appointed Natural Tutrix of her following Minor children to wit: Marcellus, Mary and Markus Nickolson heirs of the Estate of W. O. Nickolson, Deceased and she has taken the oath prescribed by law. Now therefore, the said Martha E. Nickolson is hereby duly and legally authorized and empowered to do and perform all the act appertaining to the said appointment according to law. Reid Clerk, District Court State of Louisiana Parish of Union To the Judge of the Parish and Probate Court of Union Parish, La. The petition of Martha E. Nikolson of said Parish and State respectfully shows that she is the mother of Marcellus, Mary, Marcus and Walker Nickolson, minors and orphans of William O. Nickolson, late of the County of Stuart, State of Georgia, Decd. and that said minors and orphans are entitled in their own right as heirs of their deceased a considerable estate amounting in value to the sum of Two hundred dollars or like sum which Estate is in money and in the hands of James W. Lowe, Administrator of the Estate of said William O. Nickolson, Deceased and resident of said County of Stuart. That said minors reside with the petitioner and have in said State of Louisiana, no representative of said Estate. Petitioner further shows that it is important to the interest of said minors that their said Estate be turned over by said Administrator resident of said county of Stuart, State of Georgia who is ready to turn over and deliver the same to the proper representative of Estate of said minors resident of said Parish of Union, State of Louisiana. Your petitioner therefore prays that she may be appointed such representative of the said Estate of her minor children upon taking the oath and giving the bond and security required by law. Martha E. Nickolson Petitioner State of Louisiana Parish Court Parish of Union Upon hearing and considering the foregoing petition of Mrs. Martha E. Nickolson, mother of Marcellus, Mary, Marcus and Walker Nickolson, minors and orphans of William O. Nickolson, late of the County of Stuart, State of Georgia, Deceased and no cure being shown to the contrary. It is ordered that the said Martha E. Nickolson be and she is hereby appointed Natural Tutrix of said minors and orphans upon giving bond with good security to the proper authority in this State for the faithful execution of such duties incumbent upon her in her said capacity of Natural Tutrix aforesaid in double the amount of the value of the property of said minors in the State over and above the sum in which she may be bound for the transfer of property of said minors now in the State to wit, in the sum of four hundred dollars and upon taking the oath required by law. Leggett, security acknowledge ourselves bound unto the Honorable Thos. C. Lewis, Judge of the Parish court of Union Parish, La. and unto his successors in office in the sum of eight hundred dollars for the true payment of which we bind ourselves, heirs &c subject to the condition that if the said Martha E. Nickolson shall well and faithfully execute her duty as the Natural Tutrix of the said minors and representative of Wm. O. Nickolson, decd. of the property she may hereinafter receive as such from James W. Lowe, Administrator of the Estate of William E. Nickolson, late of the county of Stuart, State of Georgia, Deceased, to which Marcelleus, Mary, Marcus and Walker Nickolson minors and orphans of said Deceased are entitled. Nickolson has taken the oath and given bond and security in terms of the law as the Natural Tutrix of the property of which Marcellus, Mary, Marcus and Walker Nickolson minors and orphans of William O. Nickolson, late of Stuart County, State of Georgia be and is entitled to receive from James W. Lowe, the Administrator of the Estate of said deceased and resident of said county. Now therefore, the said Martha E. Nickolson is hereby duly and legally authorized and empowered to do and perform all the acts and duties pertaining to her appointment as such, Natural Tutrix according to law. Nickolson, late of Stuart County, George deceased is entitled to receive from the Administrator of the Estate of said deceased resident of said county.
