The petition of Avory Breed of the said Parish of Union with respect represents that in the State of Alabama from which your petitioner recently removed, he was duly appointed and recognized as Guardian of the minors Louvenia, Calvin, Sarah, Silvester, Armsted, Christopher and Francis Norman. That he has removed said minors to said parish with him with a portion of their property consisting of Negroes that he is advised and believes it necessary to secure the interest of said minors. That a Tutor or Tutors should be appointed for the heirs and that an inventory of their property should be made. Wherefore your petitioner prays your Honor that a family meeting may be convened to deliberate on the propriety of appointing your petitioner or some other good and competent person Tutor of said minor. That your petitioner may be thus appointed Tutor. That an Under Tutor may be appointed and an inventory of the property of said minors made and for such other and further reliefs may be granted and such other and further proceedings had as the nature of the case may require. State of Louisiana Probate Court Parish of Union Let the prayer of the within petitioner be granted and it is ordered that an inventory and appraisement made and a family meeting be convoked and there advice that Avery Breed be appointed Tutor and William Norman be appointed Under Tutor of said minors and that letters issue. John Taylor Parish Judge State of Louisiana Parish of Union Be it remembered that on this 6th day of April AD 1841 that I, John Taylor, Parish Judge and Ex Officio Notary in and for said parish and State having received official information of property being in this Parish rightfully belonging to the minor heirs of Armstead Norman Deceased, who departed this life in the State of Alabama as set forth in the petition of Avery Breed who has recently moved and settled with him, Lavenia, Calvin, Sarah, Silvester, Arstead, Christopher and Francis Norman, minor heirs and the property to this State and for the purpose of making an inventory and appraisement of said property. I have repaired to the residence of said Avery Breed and for the purpose as aforesaid. I have appointed Robert Webb and A. C. McAfee, residents and freeholders of said Parish, appraisers to appraise said property and after being duly sworn by me the said Judge well and truly to do an perform all and singular the matters and things herein according to law, have proceeded as follows together with me the said Judge and Avery Breed who give in the property and undersigned witnesses and parties to wit: Inventory Appraisement Jacob, a fellow aged 45 years $650.00 Phillis, a Negro woman aged 35 years 550.00 Elias, a boy aged 4 years 250.00 Debila, a girl aged 14 years 650.00 Abram, a boy aged 17 years 600.00 Jeminia, a girl aged 11 years 400.00 Joe, a boy aged 7 years 350.00 Easter, a girl aged 5 years __250.00 Amounting to $3700.00 In testimony whereof said parties appraisers have signed their names together with Avery Breed who gave in the property and William Norman and F. John Taylor Parish Judge State of Louisiana Parish of Union Be it remembered that I, John Taylor, Parish Judge and Ex Officio Notary Public in and for said Parish and State have on this 6th day of April Ad 1841 nominated and appointed the following person domiciliated in said Parish relatives and friends to the minor heirs of Armstead Norman, Deceased, to wit: William C. Norman, a brother of said minors, Robert Webb, A. C. McAffee, John J. Butler and F. L. Gipson not interested to compose a family meeting to deliberate on the interest of said minors and give their opinion whether or not Avery Breed is a suitable person to be appointed tutor to said minors and recommend some suitable persona as Under Tutor. We the undersigned and appointed persons do concur in opinion that Avery Breed is a suitable person as Tutor for the minor heirs of Armstead Norman, Deceased. Now therefore he is hereby authorized and fully empowered to discharge and perform all and singular the duties appertaining to the said appointment according to law. In testimony whereof, I have hereunto signed my name and affixed my seal of office on this 6th day of April AD 1841. McAffee his securities of the State of Louisiana are held and firmly bound unto John Taylor, Judge of Probates in and for said Parish of Union or to his successors in office in the sum of forth six hundred and twenty five dollars current money of the United State of America which we promise to pay to him or his successors in office for the faithful performance of which we bind ourselves and each of us our and each of our heirs, executors and administrators jointly and severally by these presents renouncing all benefit or division or discussion whatsoever sealed with our seals this 6th day of April AD 1841. The conditions of the above obligation is such that if the above bounden Avery Breed, Tutor for the minor heirs of Armstead Norman, Deceased does well and truly according to law administer the same and does further make and under a true just and perfect account of all his actions and doings when thereunto lawfully required either by the aforesaid Judge or his successors in office agreeably to law or by the heirs of said deceased or their lawful attorney or attorneys or by the duly appointed and authorized Executor or Executors then this obligation to be void or else to remain in full force and virtue. McAffee State of Louisiana Court of Probates Parish of Union Know all men by these presents that we Avery Breed as principal and James Killam his security of the State of Louisiana are held and firmly bound unto John Taylor, Judge of the court of Probates in and for the Parish of Union or to his successors in office in the sum of fifteen thousand dollars current money of the United States of America which we promise to pay to him or his successors in office for the faithful performance of which we bind ourselves and each of us our and each of our heirs, executors and administrators jointly and severally firmly by these presents renouncing all benefit or division or discussion whatsoever. Sealed with our seals this twenty first day of December in the year of our Lord one thousand eight hundred and forty one. The conditions of the above obligation is such that if the above bounden Avery Brees, Testator for minor heirs of Armstead Norman, Deceased does well and truly according to law administer the same and does further make and render a true, just and perfect account of his actions and doings when thereunto lawfully required either by the aforesaid Judge or his successors in office, agreeably to law or by the heirs of said deceased or their lawful attorney or attorneys or by the duly appointed and authorized executor or executors of the last will and testament of the said deceased should it hereafter appear that any such will or testament was by the said deceased made, then this obligation to be void or else to remain in full force and virtue.
