The Petition of Needham M. Bryan, a resident of your said Parish and State with respect represents unto your Honor that William Wolf Pou, formerly a resident of Lounds County in the State of Alabama died in or about the year 1835 intestate leaving a considerable amount of property consisting of real and personal Estate that he left his widow Elizabeth Pou and two minor heirs viz., Mary Matilda and John William Pou. That the said Estate has been administered upon in Lounds County, Alabama. That before a division of said Estate took place said minor John William Pou died about the year 1836 leaving but one minor heir and the said Elizabeth Pou to inherit said Estate. That a partition of said Estate has taken place between the wife of the said William Wolf Pou, Decd. and said minor heir Mary Matilda Pou. That said minor heir’s portion consist of about fifteen hundred dollars in money, one negro fellow valued at about seven hundred dollars and one hundred and sixty acres of land valued at about twelve hundred dollars making in all the sum of thirty four hundred dollars. Petitioner avers that said minor is now in Union Parish, Louisiana and that her property is in Lounds County, Alabama, that she has no legal guardian or Tutor in this state to manage her Estate. Wherefore petitioner prays your Honor to convoke a family meeting to assemble in the Town of Farmerville consisting of the relations and in case of not being relatives enough, their near neighbors and friends of said minor to deliberate for the best interest of said minor. He asks that Henry R. Bryan be appointed Under Tutor to preside at said meeting. He further prays that he be appointed Tutor to said minor with full power to administer her Estate and bring the same into this State. Petitioner prays that Letters of Tutorship upon the recommendation of said family meeting upon the Petitioners complying with the law in such case made and provided he prays for all orders to issue that may be necessary in the premises as in duty bound &c. N. M. Bryan In proper person State of Louisiana Parish of Union Let the prayer of Petitioner be granted and it is further ordered that a family meeting be convoked to advise and recommend who shall be appointed tutor to be composed of Elijah Grooms, Henry B. Lassiter, Malcomb McFarland, Thomas VanHook and Daniel Payne and that the Under Tutor Henry R. Bryan be present and that said meeting take place today the 17th day of February AD 1846. Done and signed in Chambers this the 17th day of February 1846. John Taylor Judge of Probates State of Louisiana Parish of Union Know all persons that I, Elizabeth Bryan alias Pou alias Groom have and do hereby renounce all my rights to the Tutorship of the minor Mary Matilda Pou, my daughter, and renounce all the rights that the Law gives me as Natural Tutor to my minor child and recommend Needham M. Bryan my own brother as Tutor to my child Mary Matilda Pou, February the 17th 1846. Elizabeth Groom State of Louisiana Parish of Union Be it remembered that on the 17th day of February AD 1846 in pursuance of an order of the Honorable Probate Court in and for said Parish and State to me directed. I have caused Elijah Groom, Step father to the said minor, Henry B. Lassiter, cousin of said minor, Malcomb McFarland, Thomas VanHook and Daniel Payne neighbors and friends to said Mary Matilda Pou, minor child of William Wolf Pou, Deceased, issue by his marriage with Elizabeth Bryan alias Pou, now wife of Elijah Groom met according or by consent of the Court at the residence of N. M. Bryan in the town of Farmerville in said Parish to advise and recommend who shall be appointed Tutor to said minor who after due deliberation and nature reflection do advise and recommend that Needham M. Bryan, the own uncle of said minor child shall be appointed Tutor to said minor and who after being duly sworn by me Judge agree as above. John Taylor, Judge State of Louisiana Parish of Union Know all men by these presents that Needham M. Bryan as principal and Henry R. Bryan, his security are held and firmly bound unto John Taylor, Probate Judge in and for the Parish of Union, State of Louisiana and his successors in office in the just and legal sum of Seven thousand dollars in good and lawful currency of the United States of America which amount well and truly to be paid. We bind ourselves our heirs executors, administrators and assigns firmly by these presents. Done and signed on this the 17th day of February AD 1846. The conditions of the above bond or obligation is such that whereas the said Needham M. Bryan has this day been appointed Tutor to Mary Matilda Pou, a minor female daughter of William W. Pou, deceased and Elizabeth Bryan, former wife of said Pou, but now the wife of Elijah Groom. Now if the said Needham M. Bryan shall all and singular and fully discharge his duty as Tutor as aforesaid and make legal returns of all his acts and doings in the premises as Tutor of the aforesaid minor and do and act in all things in the premises as aforesaid then this obligation to be null and void or else to remain in full force and virtue.
