The petition of William L. Spears of said Parish and state respectfully represents unto your Honorable Court that Burrell J. Pye, late of said Parish departed this life on or about [blank] at his residence leaving an estate consisting of real and personal property, rights and claims. Petitioner represents that he is a creditor of the Estate and that no one has as yet within his knowledge applied for the administration nor has an inventory and appraisement been made. Petitioner therefore prays that an order may issue directing the Recorder to make an inventory and appraisement of the property of said Estate and that after due proceedings and legal delays may be appointed administrator of the said Estate and for such other orders and decrees in the premises as the case may require and for general relief. H. Regenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered it is ordered and decreed that the above application of William L. Spears to be appointed Administrator of the Estate of Burrell Pye be advertised according to law. It is further ordered that William C. Smith, Parish Recorder &c be and he is hereby authorized to make an inventory and appraisement of all the property belonging to the said Estate and due return thereof make to this office. The petition of John Hollis, a resident of said Parish respectfully represents unto your Honorable Court that Burrell J. Pye, late of same resident departed this life on or about [blank] at his residence leaving an estate consisting of real and personal property. That some two months ago William L. Spears applied for letters of administration authorizing him to administer on said Estate, also to have an Inventory of the property of said Estate taken and that accordingly on the 3rd of October 1865 William C. Smith, Parish Recorder and Ex Officio Notary Public did make an Inventory of the same which was duly filed in your Honorable Court on the 4th day of same month. Petitioner represents that said Spears now declines to give bond and be qualified as administrator which leaves the Estate without an administrator. Petitioner represents that the surviving widow of deceased requests him (your petitioner) to apply for the administration wherefore petitioner prays your honor that after due advertisements and all other legal delays he be appointed Administrator of said Estate upon his giving bond &c and finally for general relief. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 3rd day of October AD 1865 pursuant to an order issued from the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. I, William C. Smith, Recorder and Ex Officio Notary Public in and for said Parish directed and being assisted by H. W. Ramsey and John P. Spears, male citizens of the Parish of Union of lawful age who being duly appointed, and sworn by me as appraisers proceeded to make an inventory and appraisement of the property belonging to the Estate of Burrell J. Pye, Decd. late of the Parish of Union as follows: A tract of land situated in the Parish of Union known as the late residence of the said Decd. containing 114 acres more or less apprd. @ $1.00 per acre $114.00 11 head sheep more or less apprd. @ $2.50 27.50 6 head cattle more less apprd. @ $5.00 30.00 200 bushels of corn more or less apprd. @ $.50 per bushel 100.00 1 wagon apprd. @ 30.00 1 yoke of oxen apprd. @ ____40.00 Total amount $341.40 Having completed the within inventory, I have on this the 3rd day of October 1865 closed the same. Hollis has been duly and legally appointed and confirmed as Administrator of the Estate of Burrell J. Pye, Decd. and he has given bond with good security and has taken the oath prescribed by law. Now, therefore, the said John G. Hollis is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Dated at Farmerville, Louisiana on this the 30th day of November AD 1865. The condition of the above obligation is such that whereas the above bound John G. Hollis has been duly and legally appointed and confirmed as Administrator of the Estate of Burrell J. Pye, Decd. and he has taken the oath prescribed by law. Now therefore the said John G. Hollis shall faithfully and impartially do all the duties incumbent on him as Administrator aforesaid and shall render to the Judge of the said county a true and correct account of all his acts and doings in and about said Estate and shall whenever legally so to do pay over all sums of money and deliver all the property of whatever nature in his possession belonging to the said Estate to the proper person or persons to receive the same, then and in that case this obligation to be null and void, otherwise to be and remain in full force and virtue against the principal and his said security. Pye, Decd. To the Honorable Judge of the 11th District Court for Union Parish, Louisiana. The petition of John Hollis, a resident of your said Parish and State respectfully represents unto your honor that petitioner is the Administrator of the Estate of Burrel J. Pye, late of said Parish and that same Estate is considerable in debt and that it is necessary to sell all the property belonging to said Estate which consists exclusively in land to pay the debts. Wherefore petitioner prays your Honor that an order issue from your Honorable Court authorizing the Administrator to sell according to law after due advertisement &c all the property belonging to same Estate and for all other orders & decrees necessary in the premises and for general relief. State of Louisiana 11th Judicial District Court Parish of Union Let the prayer of Petitioner be granted and it is ordered and decreed that all the property real and personal belonging to the Estate of Burrel J. Pye be sold for the Purpose of paying the debts of the said succession. Audit is further ordered that John Hollis the Administrator make the said sale in accordance with Articles 990,991,992 of the Code of Practice and due return thereof make to this office. Done and signed in office this 10th day of January AD 1867. J. W. Reid Clerk, District Court State of Louisiana Parish of Union Be it remembered that on this the 16th day of February AD 1867 I, Jas. G. Hollis, Administrator of the Estate of Burrel J. Pye, Decd. offered for sale pursuant to an order from the 11th Judicial District for Union Parish at public auction to the last and highest bidder in accordance to acts 990,991 & 992 of C.P. after having advertised the sale for more than thirty days in the Union Record, a newspaper published in the parish all the property belonging to said Estate of Burrel J. Pye, Decd. Whereupon the following named persons became purchasers, is hereinafter set forth. A. M. Hollis purchased the following described tract of land: The NE ¼ of Sec. No. 4 Township No. 22, R3@ the S ½ of SE ¼ of Sec. 33 S 23 N of R3@ and the NW ¼ of NE ¼ and SE ¼ of NE ¼ Sec. No. 4 T 22 R3@ containing in all one hundred and eighty acres more or less together with all the improvements thereon for one dollar & 11/100 per acre amounting to $325.80. There being nothing else belonging to said Estate to offer the aforesaid A. M. Hollis purchaser having complied with the terms, I sold John G. Hollis, Administrator of said Estate by virtue of the authority vested in me do by these presents transfer, sell, deliver and adjudicate unto said A. M. Hollis guarantee to said A. M. Hollis all the right [unreadable] to said tract of land with all improvements thereto unto belonging to said Estate [unreadable]. In testimony whereof I hereto sign my name officially in the presence of R. W. Futch and James King lawful witnesses on this the day and date above written. ATTEST: James King J. G. Hollis R. W. Futch To the Honorable Judge of the 11th District Court in and for the Parish of Union, State of Louisiana. The petition of John Hollis, Administrator of the Succession of Burrell J. Pye, Decd and a resident of your Parish and State respectfully represents unto your honor that be an advertisement of said succession and begs herewith the final amount hereinafter. Administrator charges himself with amount of process verbal of sale $325 He represents that the [unreadable] of personal property which appears on the Inventory never came into his possession. Said Inventory having been taken under the direction of a former applicant for the Administration. Administrator asks court for the following privileged claims which he has paid to extent offered on hand. 1. Clerk’s fee 2. Recorder’s fees 3. Printer’s fees 4. Attorney’s fees $30.00 5. Claim presented by surviving spouse of Decd. for cash and by his said Decd. was $950.00 A number of ordinary debts have come to the knowledge of the Administrator against the succession but there is not money enough to pay the privileged claims. It was [unreadable] useless to take any notice of said debts. Petitioner prays that this account be advertised according to law and homologated in all its parts and the Administrator discharged from the administration, his bond canceled and for all other orders and decrees necessary in the premises and for [unreadable] general relief.
