Ramsey, Deceased Petition for Family Meeting: Filed August 16, 1881 To the Hon. Judge of the 3rd. Dist. Court of Union Parish State of Louisiana. The Petition of Mrs. Susan A. Ramsey wife of William Collins and William Collins who joins his said wife herein and authorizes her herein and Mary E. Ramsey, wife of John Poston and John Poston who joins his said wife and authorizes her herein and Franklin P. Ramsey and Mary F. Ramsey Tutrix to the minors Humphrey Ramsey, Willis C. Ramsey and John Ramsey, these minors being the sole heirs and representatives of the late John A. Ramsey, Deceased, all residents of the Parish of Union, La. respectfully represents unto your Hon. Court that petitioner Susan A. Ramsey is the widow and partner in community with the late James Ramsey who died at his residence in Union Parish, La. about the [blank] day of [blank] 1863, that petitioners Mary E. Ramsey Franklin and said minors representing their said father John A. Ramsey are the legitimate children and sole heirs of the said James Ramsey, Deceased. That at his death the said James Ramsey left a small succession consisting principally of the following described land which belonged to the community which existed between him and his said wife Susan A. Ramsey to wit: The SE ½ & S ½ of NE ¼ & S ¼ of NW ¼ & NW ¼ of NW ¼ of Sec. 36 & SE ¼ of NE ¼ of Sec. 35 all in T. 22 North R. 2 West. Petitioners represent that the above described property is all that now remained belonging to said succession of James Ramsey and that said succession owes no debts, and an Administration of the same would be entirely unnecessary. Petitioners aver that they are all desirous that a partition of said property, be made and as an heirs share of said property is owned by said minors it is necessary that said partition be ordered by your Hon. Court, and that a family meeting composed of the relatives of said minors be duly convoked to deliberate as to the interests of said minors and decide whether or not they will recommend the sale of said minors share of said property in order to effect a partition as said land cannot be conveniently divided in kind. Wherefore petitioners pray that W. W. Heard, Notary Public in and for Union parish, La. be authorized and commanded to convoke a family meeting composed of the relatives of said minors to deliberate concerning the interest of said minors as to whether or not their interest in a part said land should be sold at private sale to effect a partition and whether or not they be permitted to buy certain portions of said land at private sale at a price not to be less than the appraisement and that said partition be ordered. Petitioners pray for all other orders necessary and for general. Jas. A. Ramsey, Atty. Process Verbal of Family Meeting: Filed August 16, 1881 State of Louisiana Parish of Union I do solemnly swear that I will faithfully and impartially give my advise touching the interest of the minors Humphrey Ramsey, Willis C. Ramsey, John A. Ramsey, heirs of John A. Ramsey, Decd. to deliberate as to the interest of said minors concerning the partition of the land described in the petition for the partition and recommend whether or not the interest of said minors in any of said land shall be sold to effect a partition at private sale and also whether or not Mrs. Mary A. Ramsey, Tutrix of said minors may buy from the other heirs of James Ramsey, Decd. One Thousand Eight Hundred and Eighty one (1881), pursuant to an order issued from the Honorable, the 3rd Judicial District Court in and for Union Parish, La., of date August 16th A.D., 1881 and to me William W. Heard, Notary Public, etc. in and for said parish and State directed, authorizing and commanding me to convoke a family meeting composed of the following named male citizens of the Parish of Union of lawful age and being relatives of the minors herein after named, who are not interested in this matter, for the purpose of giving their advise and to deliberate as to the interest of said minors concerning the partition of their interest in the land described in the petition for the partition and as set forth on the inventory of the tutorship of said minors being even date herewith and recommend whether or not the interest of said minors in any of said land shall be sold to effect a partition at private sale and also whether or not Mrs. Mary F. Ramsey, Tutrix to said minors may buy from the other heirs of James Ramsey, Decd., their interest in any portion of said land at private sale in order to effect a partition. Now therefore, I, William W. Heard, Notary Public etc. as aforesaid have caused to come before me at my office in the town of Farmerville viz.: S. W. Ramsey, D. M. Ramsey, Jas. A. Ramsey, J. K. Ramsey and John Poston, who being duly sworn by me proceeded to deliberate and advise on the subject matter herein set forth, and after mature deliberation, they advise and recommend unanimously, that the Tutrix Mrs. Mary F. Ramsey sell at private sale the interest or any part of the interest of said minors in said land in order to effect a partition of same, and that the be permitted to buy at private sale, the interest of the other heirs of any portion of said land, so that said minors may have the full ownership of a certain portion of the land to the amount of their share of same and the other heirs become the full owners of the remainder of the land, said minors share not to sell for less than the appraisement on the inventory this day made, and the Tutrix to buy any of said land for more than said appraisement, and they further recommend that said partition be made of said land. In testimony whereof, I have caused said members to sign this process verbal on the day and date above written together with the Under Tutor (John Austin) who is also present and concurs in the foregoing deliberations, and signs showing his consent and approval in the present of Jas. M. Smith and William A. W. Heard, Notary Public for Union Parish, La. be and he is hereby authorized and commanded to convoke a family meeting composed of the following relatives of the said minors who are present to wit: S. Their interest in any portion of said land at private sale in order to effect a partition and that a process verbal of the proceedings of said family be returned to this court. C. etc. Order Homologating Proceedings of Family Meeting: Filed August 22, 1881 State of Louisiana 3rd District Court Parish of Union The petition for a partition of the land owned in part by said minors having been filed and considered and by the further reason of the family meeting duly convoked on the 16th day inst. Having recommended that a partition of said land be had and that the Tutrix to said minors be authorized to buy and sell the interest of said minors in any portion of their said land in order to effect a partition—it is hereby ordered and decreed that the proceedings of said family meeting be and the same are hereby approved and homologated in all their parts. And that Mrs. Mary F. Ramsey, Tutrix to said minors be and she is hereby authorized to sell at private sale said minor’s interest in any part of the land owned by the heirs of James Ramsey, deceased, in order to effect a partition and she is also authorized to buy for said minors at private sale the interest of the other heirs in any part of said land to effect a partition so that said minors may become the full and sole owners of a part of said land to the amount of their share, and may sell to the other heirs their interest in all the rest of the land. The minors interest not to be sold for less than the appraisement, and the Tutrix not to purchase the interest of the other heirs for said minors for a price more than the appraisement. Thus done and signed officially on this the 22nd day of August 1881. Jas. M. Smith, Clerk, D. C. etc. Petition for Inventory and Tutorship: Filed August 16, 1881 To the Honorable Judge of the 3rd District Court of La. in and for the Parish of Union. The petition of Mrs. Mary F. Ramsey, a resident of Union Parish, La., with respect would show that petitioner is the widow of the late John A. Ramsey, deceased, who departed this life at his residence in Union Parish, La. in Marcy 1879, leaving a small Estate in community with petitioner and one heir’s interest in the Succession of James Ramsey, Deceased, who died at his residence in Union Parish about the [blank] day of [blank] 1863. That petitioner has three minor children issue of her marriage with the said John A. Ramsey, decd. viz: Humphrey Ramsey, Willis C. Ramsey and John A. Ramsey. That said minors are heirs to the Succession of the said James Ramsey by representation of their said father john S. Ramsey, that they are without a tutor and in order to protect their rights, it is necessary that a tutor be appointed to them, and as petitioner is their mother and natural Tutrix, she is legally entitled to be appointed as such. Wherefore petitioner prays that an order issue from your Hon. Court authorizing and commanding W. W. heard, Notary Public for Union Parish, La. to make an inventory and appraisement of the Succession of the said John A. Ramsey, Decd. and also of his interest in the Estate of James Ramsey, Deceased, and that petitioner be duly appointed and qualified Natural Tutrrix to said minors and that John Austin be appointed and qualified Under Tutor to said minors and for all other orders necessary and for general relief. Heard, Notary Public for Union Parish, La. be and he is hereby authorized and commanded to make an inventory and appraisement of all the property, rights and credits belonging to the succession of John A. Ramsey, Deceased and also his interest in the succession of James A. Ramsey, Deceased and that S. W. Ramsey and John Austin be and they are hereby appointed appraisers to assist in taking said inventory. And it is further ordered that Mrs. Mary Ramsey be and she is hereby appointed Natural Tutrix to Humphrey, Willis C. and John Ramsey, minor heirs of John A. Ramsey, decd. and John Austin is hereby appointed Under Tutor. And that letters do issue to them upon their complying with the law. Done and signed officially on this the 16th day of August, 1881. Ramsey being duly sworn says, that she will well and faithfully discharge and perform all and singular the duties incumbent on her as Natural Tutrix of the minors Humphrey, Willis C., and John A. Ramsey, heirs, of the Estate of John A. Ramsey, Decd. according to law, and according to the best of his knowledge and understanding. So help him God. Mary F. Ramsey praying that she might be appointed Natural Tutrix to the minors Humphrey, Willis C. and John A. Ramsey heirs of the Estate of John A. Ramsey, Decd. Now know ye, that Mrs. Mary F. Ramsey has been and she is hereby appointed Natural Tutrix to the said minors and that she has fulfilled all the requisites of the law. Smith, Clerk of the 3rd Judicial District Court etc. in and for Union Parish, La. do hereby certify that the amount of property belonging to the minor heirs of John A. Ramsey, Decd. as shown by the inventory now on file in my office as taken by Wm. W. Heard, notary Public etc. for said Parish & State is the sum of One Hundred and Eight & 33 1/3/100 (108.33 1/3) Dollars that the real property or rather the Undivided) one sixth interest in the following real property belonging to said Estate as shown by said inventory is described as follows to wit: The South East quarter and South half of North East quarter, and south half of North West Quarter and North West Quarter of the North West Quarter of Section Thirty six (36) and south East quarter of North East quarter of Section Thirty five (35) all in Township # Twenty Two (22) North Range Two (2) West—the undivided one sixth interest in said being appraised at Eighty three & 33 1/3 Dollars & that the remaining effects of said Estate is personal property consisting only of household and kitchen furniture appraised at Twenty five ($25) Dollars.
