J. Raney, Deceased Petition for Appointment of Administrator: Filed August 13, 1874 To the Honl. The Parish Judge in and for the parish of Union, State of Louisiana. The petition of H. E. Mosley, a resident of your said Parish of Union, State of Louisiana, with respect represents unto your Honorable Court that William J. Raney, late a resident of your said Parish of Union, State aforesaid departed this life at his late residence in the Parish of Union on or about the twenty seventh day of the month of June Anno Domini one thousand eight hundred and seventy four intestate; petitioner farther represents that at the time of his death that he was possessed of some considerable estate consisting of real estate and personal goods. Petitioner also avers that said Estate is largely indebted and indeed insolvent. And that he is among the creditors & one of the largest and is entitled to the Administrations. Petitioner shows that an Administration is necessary in order to settle up the debts of said estate as the law directs and to take charge of sand manage the efforts of said succession to the best advantage for the parties interested. Wherefore the premises considered, petitioner prays that an order for and a commission issue directed to Wm. C. Smith, Recorder and Ex Officio Notary Public authorizing and empowering him to take an inventory of all the property within the Parish of Union belonging to said Estate and to make an appraisement of the same as the law directs. Petitioner farther prays that this application for appointment & confirmation of Administrator be duly advertised in the Union Record in manner & form directed by law and that after all legal delays necessary in the matter that your petitioner be appointed & confirmed Administrator of the Estate of William J. Raney, deceased and that letters issue accordingly; petitioner farther prays for all orders which may be found incidental hereto and for all commission to take inventories in the matter of this estate may be found necessary. In the matter of the above and foregoing petitioner after mature deliberation and by reason of the law it is hereby ordered that this application of H. e. Mosley for the Administration of the Estate of Wm. J. Raney, decd. be duly advertised in the Union Record of the Parish of Union as the law directs and it is farther ordered that a commission issue directed to Wm. C. Smith, Recorder of Union Parish so authorizing him to make a true inventory of all the Estate real and personal goods, Chattels, rights & credits belonging to the Succession of Wm. J. Raney, deceased and found within the Parish of Union and to make an appraisement of the same according to law and that [blank] and [blank] be appointed appraisers to appraise the same. Raney and resident of your said Parish and State with respect represents unto your Honl. Court that said estate is indebted to a considerable amount and that in order to pay the debts of said Estate and settle the affairs of the same, it is necessary that all of said estate real & personal, rights and credits be sold for cash. Wherefore the premises considered petitioner prays that an order for and a commission issue directed to your petitioner authorizing him to sell all of the property of said estate for cash after the necessary legal delays required by law. Mosley, Admr. of Estate of W. J. Raney, died late of the Parish of Union. You are hereby commanded to sell in pursuance of an order of the Honl. This Novr. 26th 1874. J. W. Reid Clerk, Dist. Court Petition for Sale of the Property on a credit: Filed February 9, 1876 To the Honl. Parish Judge in and for the parish of Union, State of Louisiana. The petition of Henry e. Mosley who is a resident of the parish of Union, State of Louisiana and Administrator of the Estate of Wm. J. Rainey with respect represents unto your Honl. Court that all of said Estate that now appears upon the inventory has been offered for sale about twelve months ago and that considerable portion of the real Estate failed to sell at that time, it having been advertised to sell in Union Record, a newspaper published in Union Parish, La. also a small portion of the personal property. Your petitioner farther avers that the said property has been advertised & offered for sale, for cash. Petitioner avers that there are many debts unsettled & that the sale of all the Est. is necessary in order to affect a settlement and pay said debts or affect such settlement as the estate will be able to make. Wherefore petitioner prays that the same be sold at public auction on a credit of twelve months after due and lawful notice of the same and for general relief the premise. W. R. AD 1876. Succession Sale. In pursuance of an order from the Judge of the Parish Court of Union Parish, La. and to me directed, I will sell for cash the following described land belonging to the Estate of Wm. J. Rainey, decd. to wit: the South West quarter of Section four, and lot four of Section nine in Township Twenty North of Range four East and the North East ¼ of the North West ¼ of Section 14 and the South East ¼ of Section 10, also the South East quarter of Section 11 all in Township Twenty N. of Range three East. Also on fourth interest in the following described land. The South West ¼ of North East ¼ and East ½ of North East ¼ of North West quarter of Sec. 4 T. 21 Range Two West. Sale to take place at the court house door in the Town of Farmerville, La. on Saturday the 20th day of January AD 1877. H. E. Mosley Administrator State of Louisiana Recorder’s Office Parish fo Union I, W. C. Smith, Recorder in and for the Parish and State aforesaid, do hereby certify that the mortgage herein after expressed appears on Record in this office against the land described in the annexed advertisement of the Estate of W. J. Raney, decd. First: A Conventional Mortgage from W. J. Raney to John L. Barrett made on the 18th day of May 1874, for the sum of six hundred and twenty two & 40/100 dollars with 8% interest from March 1st 1874, for which the said Raney executed his promissory note for six hundred and twenty two & 30/100 dollars with 8% interest from March 1st 1872, and payable Oct. 1st 1874 said mortgage recorded in Mort. Book “C” Page 24 on the 19th day of May 1874. Second: Judicial Mortgage, case entitled J. R. Goyne vs. No. 578 W. J. Raney in the sum of Two hundred and fifty dollars with 8% from June 25th 1859 and all costs of suit less a credit of One hundred and thirty six dollars June 7, 1869 with a stay of execution till Oct. 20, 1874 when if this judgment is not satisfied execution may issue and property be sold without the benefit of appraisement for cash as on a 12 months bond this May 18, 1874 said mortgage recorded in Mortgage Book “C” Page 32 date of Record May 25th 1874 taxes due for the year 1875 on said Estate $7.09. In testimony whereof I hereto sign my name and affix my seal of office this the 19th day of January AD 1877. W. C. Smith Recorder Petition of order for sale: Filed January 22, 1877 To the Honorable the Judge of the Parish Court, Parish of Union, State of Louisiana. The petition of H. E. Mosely, Administrator of the Succession of Wm. J. Rainey, decd. with respect shows that there is some real estate belonging to the said succession which ought to be sold to pay debts and to enable your petitioner to settle up and close the Administration. He avers that he advertised and offered for sale at public auction all of the land belonging to the said succession, according to the order of our Honorable Court but no one would offer the appraised value of said land and our petitioner had no right under the order to sell it for less and he therefore asks for an order to sell the said land on a twelve months bond for what it will bring on a credit after due advertisements, at the court house door in Farmerville, La. and for all such other orders as are necessary in the premises & for general relief. Considering the above petition, it is ordered that the administrator proceed to advertise and sell on Tuesday 6th day of Feby., 1877 at public auction at the court house in Farmerville all of the land belonging to the said Estate of Wm. J. Raniney, decd. for what it will bring on a credit of twelve months and the Admr. is authorized to take and approve a twelve months bond taken as the price thereof. Raney, Deceased Be it remembered that pursuant to an order from the Judge of the Parish Court of Union Parish, La. and to me directed dated 26th day of November AD 1876, commanding me to sell at public auction for cash all of the property both real and personal belonging to the Succession of William J. Raney, decd. I proceeded to advertise said sale in the Union Record, a newspaper published weekly in Farmerville, Union parish, La. for more than thirty days to take place at Farmerville on Saturday 20th day of January AD 1877, when on said day, I proceeded to the court House door, the place designated for said sale, and after waiting until 12 o’clock, I proceeded to read in a loud voice the order of sale, the advertisement and the certificate of Mortgage and then proceeded to offer all of the said Property for sale at public auction, but after crying said property both real and personal a sufficient length of time and no one offering as much as two thirds of the appraised value of said property, I declared that there was no sale in accordance with said order and I therefore represented that same to the said Court which granted an alias order of sale bearing date 22nd of January AD 1877 commanding me to proceed to re-advertise and sell all of said property on a credit of twelve months for what it will bring. After advertising the same for sale for fifteen days, and in obedience to said order, I advertised said property again to be sold on a credit of twelve months in the Union Record, a newspaper published weekly in Farmerville Union Parish, La., for what it would bring, for more than fifteen days when on the sixth day of February 1877, the day fixed for said offering for sale, I proceeded to the Court house of Union Parish, La., the place designated for said sale and after waiting until 12 o’clock, I proceeded to read aloud the order of sale, the advertisement and the certificate of Mortgages and then offered at public auction all of the land belonging to the Succession of William J. Raney, deceased on a credit of one year, for what it would being when after crying the said Property in lots of forty acres each a sufficient length of time, William R. Rutland became the purchaser of the following described parcels or lots of land belonging to said Succession, lying in Union Parish, La. he being the last and highest bidder for the same; namely the SW ¼ of Sec. No. 4 and Lot No. four (4) of Sec. Nine (9) in township No. (20) twenty North of Range (4) four East containing one hundred and ninety five acres more or less at ten cents per acre and also another tract or parcel of land in Union Parish, La. being he North East quarter of the North West quarter of Section fourteen and the South East quarter of Section Ten and also the South East quarter of Section No. Eleven all in township Twenty, North of Range three east containing in all three hundred and fifty nine & 14/100 acres (359 14/100) acres more or less at ten cents per acre and also an undivided one fourth interest in the following tract of land belonging to said Succession and situated in the Parish of Union, La. being the South West quarter of the North East quarter and the East half of the North East quarter of the North West quarter of Section No. four township No. Twenty one North of Range two West containing sixty acres ore or less at ten cent per acre being in all six hundred and fourteen & 14/100 acres more or less. Now therefore the said W. R. Rutland having complied with the terms of the said sale by giving his bond with good and solvent security for the sum of sixty one dollars and forty five cents, it being the last and highest bid made with eight per cent per annum interest thereon after its maturity and due one year from its date, I, Henry E. Mosely, Administrator or the Succession of William J. Raney, do by virtue of my authority as such, adjudicate, sell, convey and deliver free from all mortgages, liens or privileges whatsoever, except the vendor’s privilege which is hereby specially retained to secure the payment of the above named bond described six hundred and fourteen & 14/100 acres of land, to have and to hold the same to himself his heirs and assigns forever. There being no further property for sale, I closed the same and returned this my process verbal of the same on this 4th day of February AD 1878 in presence of the attesting witnesses. H. E. Mosely Admr. Final Account: Filed March 10, 1880 In the matter of the Succession of W. J. Rainey, decd. the Administrator, H. E. Mosley. Now comes into court and files this his final account in which he first charges himself up with the amount of the proceeds of sales which amount in the aggregate to the sun of eight hundred and sixty eight dollars 56/100 $878.20 He claims the following credits as charges against said Estate to wit: 1st, Law charges 2 ¼ p. ct. commissioned, admr. fees $19.20 2nd, J. Rainey Decd. represents unto the Parish Court of Union Parish, La. that he has Administered said Estate to the best of his ability and the aforegoing statement shows that he received eight hundred and seventy eight & 50/100 dollars belonging to said Estate and that he has paid all of that amount out to the surviving widow and to the payment of other debts, and the farther sum of two hundred and sixteen & 34/100 dollars out of his own funds. Therefore he prays that the above and foregoing account be allowed approved and homologated in all its parts after due and legal notice of the same by proper advertisement. Petitioner prays for general relief in the premises. W. R. Roberts Attorney of Admr. Note of Evidence: Filed July 11, 1881 Succession of W. J. Raney, Decd. In matter of homologation final account of Admr. Jas. M. Smith sworn for Admr. says: I am clerk of Dist. Court etc. for Union Parish, La. & to the best of my recollection the final acct. notice of the filing of Admr. in said Estate and advertised for more than ten days according to law & that no opposition has been made thereto. Sworn to & subscribed before me this July 11th AD 1881, Jas. M. Smith E. M. Graham Judge 3rd, Dist., La. H. E. Mosly sowrn for Admr. says: that the final acct. is correct & that the credits therein are correct & that the credits are in favor of L. B. Rush for $184 & 14/100 dollars is settled & that all the other vouchers have been paid by me. All vouchers filed in evidence by Admr. Judgement of Homologating Final Account: Filed July 14, 1881 State of Louisiana 3rd District Court Parish of Union By reason of the law and the evidence being in favor of H. E. Mosley, Admr. of the Succession of W. J. Rainey decd. upon the trial of the homologation of the final account filed by the Administrator, it is ordered adjudged and decreed that the final account be approved and homologated in all its parts and that the Administrators bond be cancelled upon his filing in the clerk’s office his vouchers and receipts showing that he has paid the claims allowed upon said account.
