Scott, Decd., Union Parish Louisiana ================================================================================= NOTE: John W. Scott was born about 1835 in Tennessee. In 1860 he lived near Marion, in northeastern Union Parish, with his wife Frances. The statement in the petition below that Scott died in the Battle at Jonesboro, Georgia proves that he was the J. W. Scott who served at a private and corporal in Company E, 25th Regiment Louisiana Infantry. This company was raised in Union Parish in early 1862, and with the men enlisting at Monroe on 7 March 1862. The regiment officially entered the Confederate service on 26 March 1862 at New Orleans, just prior to the surrender of that city to the Yankees. They fought in several minor skirmishes near Corinth and Monterey, Mississippi, but their first major engagement was the Battle of Farmington on 9 May 1862. They fought at the Battle of Perryville on 8 Oct 1862. They became part of the 16th and 25th Consolidated Regiment at Shelbyville, TN on 30 November 1862. The regiment fought during the Battle of Murfreesboro in December 1862 - January 1863. In May, the regiment joined General Joseph Johnston's army at Jackson, Mississippi, where they participated in the siege there in July. They returned to the Army of Tennessee and fought at the Battles of Chickamauga and Missionary Ridge before wintering in Dalton, Georgia. They fought in the 1864 Atlanta Campaign, participating in the Battles of Mill Creek Gap, Resaca, New Hope Church, Atlanta, Ezra Church, and Jonesboro. Scott was present on the roll for May and June, 1862. The roll for Nov. and Dec., 1862 listed him as "present, engaged in Battle of Murfreesboro, Tenn., Dec. 31, 1862." On the rolls from Jan., 1863, to Aug., 1864, Scott was listed as present. The roll to Feb. 28, 1865, listed him as "Absent, missing since fight at Jonesboro, Aug. 31, 1864." ================================================================================= To the Honorable the Judge of the eleventh Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of John G. Hill, a resident of your said Parish and State respectfully represents unto your Honor that John W. Scott, late of the same residence, died intestate having been killed in a battle fought at Jonesbourough, Georgia in September 1864, leaving a small estate in your said parish of Union where he resided, consisting of real and personal property, rights, credits and the following persons interested in his succession to wit: his surviving widow Frances L. Scott, now the wife of Leonard Miller; his mother Sarah C. Hill, the wife of petitioner; Mary P. Stripling nee Scott, his sister of the full blood; and James, George and Franklin Hill, brothers of the half blood. Petitioner further represents that the Deceased left no descendants, that there are debts due to and by Decd. which render the appointment of an Administrator necessary, that Petitioner in right of his wife, Sarah C. Hill, who being the mother of the Decd is a forced heir, claims the appointment of Administrator by preference. Wherefore, Petitioner prays that due notice be given of this his application to be appointed Administrator, that a true and faithful Inventory and appraisement be made of all the property real and personal, rights and credits belonging to the succession of said John W. Scott, Decd. by the Parish Recorder of said parish and that Petitioner be appointed Administrator of said Succession and for all other orders which may be necessary &c. Sy G. Parsons, Atty for Pet. Soctt, Decd. and that upon his giving bond with good security and taking the oath required by law that letters of Administration do issue to him. Smith, Recorder and Ex Officio Notary Public in and for the Parish and State aforesaid being assisted by Edward Bronson and David Arent, males of lawful age and domicile who being duly sworn and appointed by me as appraisers on this the [blank] day of November AD 1865 at my office in the town of Farmerville make an inventory and appraisement of the property belonging to the Estate of John W. Scott, Deceased, late of Union Parish, La. pointed out and described John G. Hill of said Parish. First, a tract of Land situated in the Parish of Union known as the late residence of John W. Scott numbered as follows, SW ¼ Section West ¼ of SE ¼ and the SE ¼ of SE ¼ of Section No. 5, T. 21, $. 2 East containing 288 50/100 acres duplicate no. 20188 apprd. @ $1. per acre $288.50 6 Bales of cotton weighing 450 lb. more or less 2700 pounds more or less apprd. @ 20x 540.00 1 bay horse and saddle apprd. @ 45.00 30 head stock hogs more or less apprd. @ 90.00 Household and kitchen furniture and farming tools 25.00 One promissory note of John G. Hollis for about four hundred Dollars more or less ___400.00 $1588.30 Done and signed in my office in the town of Farmerville in the presence of Thos. C. Lewis and W. W. Hill has been duly and legally appointed and confirmed as Administrator of the Estate of John W. Scott, Decd. and he has given bond with good security and has taken the oath prescribed by law. Now, therefore, the said John G. Hill is hereby and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Hill as principle and John R. parks and Green B. Alfred as his securities are held and firmly bound unto Honorable J. D. Watkins, Judge of the 11th Judicial District in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of one thousand eight hundred and sixty dollars $1860.00 to the true and faithful payment whereof well and truly to be made. We bind ourselves, our heirs and assigns and legal representatives firmly by these presents. Dated at Farmerville, La. on this 28th day of November AD 1865. The condition of the above obligation is such that whereas the said Estate of John W. Scott, Decd. and he has taken the oath prescribed by law. Now, therefore if the said John G. Hill shall faithfully and impartially discharge all the duties incumbent on him as Administrator of said Estate and shall render to the Judge of the said court a true and correct account of all his acts and doings in and about said estate and shall whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature received him and belonging to the said estate to the proper person and persons to receive the same, then and in that case this obligation to be null and void. The petition of John G. Hill, a resident of your said Parish and State and Administrator of the succession of John W. Scott, late of said parish, Decd. respectfully represents that he has no funds in hand as Administrator of said succession and that in order to pay the debts due by same, it will be necessary to have a sale of the property both real and personal. Wherefore, Petitioner prays that an order directing the sheriff of said Parish authorizing him after due and legal advertisements to sell at the late residence of Decd. all the property both real and personal belonging to the said survivors and for all other and further orders may be necessary and proper &c Sy G. Scott, Decd. all the property real and personal belonging thereto after legal Articles 990 & 991 of the Code of Practice and that due return thereof be made according to law. Lewis Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union The foregoing petition being considered, it is ordered that the Sheriff of said parish proceed to sell at the late residence of John W. Scott, Decd. all the property real and personal belonging to the deceased. To after legal Advertisement said sale to be in accordance with Arti9cles 990 & 991 of the Code of Practice and that due return thereof be made according to law. That being all the property printed out to me by J. G. Hill, Administrator and after advertising the same according to law for more than thirty days, I proceeded to offer the same at public auction to the last and highest bidder, when J. B. Ivy became the purchaser for the sum of two hundred and eighty eight dollars to me in hand paid which amount I turned over to the Administrator, John G. Hill, January 15th AD 1865. W. W.
