Simmons, Decd. To the Honorable the Judge of the 11th Judicial District Court, Parish of Union, State of Louisiana. The petition of Jesse W. Simmons, a resident of the Parish of Union, respectfully shows that Victoria A. Simmons, his late wife departed this life about the month of March 1867 in testate, leaving a small estate consisting of personal property which was held in community with your petitioner, her surviving spouse with a considerable amount of community debts. Petitioner avers that it is necessary that there should be an administrator appointed as well as an Inventory and Appraisement of the property and that he as the partner in community is entitled to the administration and that a sale of all the property will be necessary to pay the debts of said Estate. That she also left two children as her heirs issued of her former marriage to L. Patterson. Wherefore he prays that this his application be advertised according to law and after the legal delays, he be appointed Administrator of the Estate of Victoria A. Simmons, Decd., that an Inventory and Appraisement of said Estate be made according to law and that he be authorized to sell all the property of said Estate according to law to pay the debts of the same for all further orders and decrees necessary in the premises and for general and equitable relief &c. Simmons to be appointed Administrator of the Estate of Victoria A. Simmons be advertised according to law and it is further ordered that W. C. Smith, Notary Public proceed to make an Inventory and Appraisement of said and due return of the same make to this office according to law. Done and signed in office on this November 1st 1867. J. W. Reid Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union In the matter of the succession of Victoria A. Simmons, Decd., the premises considered, it is hereby ordered, adjudged and decreed that Jesse W. Simmons be and he is hereby ordered and authorized to sell all of the property of said Estate according to Articles 990, 991 and 992 to pay the debts of said succession and the administrator of said Estate be authorized to make sale. Done and signed in office on this November 19, 1867. J. W. Reid Clerk, District Court State of Louisiana 11th District Court Parish of Union The premises considered and by reason of the proper and legal advertisements having been made and no opposition having been filed thereto, it is hereby ordered that J. W. Simmons be and he is hereby appointed Administrator of the Estate of Victoria a. Simmons, Decd. and upon his giving bond and taking the oath required by law, that letters of Administration do issue to him. Done and signed in office this 19th day of November AD 1867. J. W. Parks do solemnly swear that I will faithfully and impartially appraise the property that may be presented to me belonging to the Estate and Succession of Victoria A. Smith, Recorder and ex officio Notary Public in and for said parish directed authorizing me to make an Inventory and Appraisement of the property belonging to the Estate and Succession of Victoria Simmons, Decd. situated in the Parish of Union and being assisted by Levi J. Parks and Wm. D. Thurston two male citizens of Union parish of lawful ages, who being duly appointed and sworn by me as appraisers, proceeded to make said Inventory and appraisement at Locklomond in said Parish in the presents of H. W. Simmons the surviving husband as community property. Simmons as principal and Hugh Young as securities, are held and firmly bound unto the Honorable J. D. Watkins, Judge of the Eleventh Judicial District Court in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of Five hundred Dollars to a true and full payment thereof we bind ourselves, our heirs, executors, administrators and legal representatives, firmly and in solido by these presents. Dated at Farmerville, La. this 19th day of November AD 1867. The condition of the obligation is such that whereas the said Jesse W. Simmons has been duly and legally appointed and confirmed as Administrator of the Estate of Victoria A. Simmons, Deceased, and he has taken the oath required by law. Now therefore if the said Jesse W. Simmons shall faithfully and impartially perform all the duties incumbent on him as Administrator of the said Estate and shall render to the Judge of said Court, a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property belonging to the said Estate to the proper person or persons to receive the same, then this obligation to be null and void. Simmons, do solemnly swear that I will faithfully and impartially discharge all the duties incumbent upon me as Administrator of the Estate of Victoria A. Simmons, Deceased and he has given bond with good security and has taken the oath prescribed by law. Now therefore the said Jesse W. Simmons is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Simmons, Decd. after making the legal advertisements, I proceeded to offer the following property on the Locklomond Plantation at Public Auction on the 5th day of December 1868 and after crying the same a sufficient length of time the following persons became the purchasers of the following property to wit: Hugh Young bot. 4 Double plows @ $8, 2 Cary plows @ 2.75 8.00 3 Avery plows @$4, 1 pr. cotton scrapers @ $7 13.00 8 Weeding hoes @ $2.50, 1 pr. cotton balances $3 5.00 1 Gin band @ $1, 1 horse mule @ $10 11.00 4 Mules @ $80.50 a head 322.00 1 Wagon & geer $50, 2 Bedsteads & mattresses __80.00 $442.25 Joseph Baker bought 2 spades $1.60, 1 [unreadable] 3.60 W. P. Smith bought 20 chairs 5.75 Samuel Sawyer bought 1 chisel &c @ $1.50, 2 tables @ $2.50 4.00 Cash bought ___3.80 Sum total sold $459.12 Terms of sale cash property paid for and delivered. J. W. Simmons, Admr. Per Jno. L. Barrett, Atty. To the Honorable the Judge or the Clerk of the 11th Judicial District Court in and for the Parish of Union, State of La. The petition of Jesse W. Simmons, Administrator of the Estate of Victoria A. Simmons, Decd. respectfully represents that he has in hands the entire assets of said Estate amounting to Four hundred and fifty nine and 11/100 dollars and that he has accepted the following as just claims against the Estate to be part by preference to wit: Law charges 1 Clerk’s cost, See Voucher No. 1 Recorder’s fees, Voucher No. 2 Advertising, Union Record, Voucher No. 3 Atty. Fee, Voucher No. 4 Account of Hugh Yongue for supplies furnished for working the farm of Decd. for the year 1867 and for rent of the place amounting to about $15.00 beside int. Wherefore he prays that this his statement of debts and Tableau of Distribution be advertised and after the legal delays that he be authorized to pay the debt in the order set forth in said Tableau until the assets of the Estate are exhausted and that his bond be cancelled and for general relief &c. Jno. L. Barrett, Atty. State of Louisiana 11th Judicial District Court Parish of Union The premises considered, it is ordered that the within account &c be advertised according to law. Reid Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union In the matter of the homologation of the State of Debts and Tableau of Distribution filed by Jesse W. Simmons as Administrator of the Estate of Victoria A. Simmons, Decd, 1st James W. Reid, Clerk of the District Court sworn says that he was the acting of said Court in Feby. last and that said Statement and Tableau was filed in the Clerk’s office on the 28th day of Feby. AD 1868 and has been advertised for more than thirty days prior to this date by publication in a weekly newspaper published in said Parish called the Union Record and by posting at the door of the Courthouse in the town of Farmerville said Parish and that no opposition has been filed to the homologation of the same. State of Louisiana 11th District Court Parish of Union I hereby certify that this is all the evidence adduced in the trial of the homologation of the state of debts and Tableau of Distribution filed by Jesse W. Reid, Clerk State of Louisiana 11th Judicial District Court Parish of Union By reason of the law and the evidence in this case and by further reason of the proper and legal advertisement having been made and no opposition having been made thereto, it is hereby ordered, adjudged and decreed that the within statement of debts and Tableau of Distribution be and the same is hereby allowed, approved and homologated in all its parts according to law.
