The petition of Delaware S. Jones, wife of Hugh Yongue and of Hugh Yongue, who files herein for the purpose of aiding authorizing and assisting his said wife, residents of the Parish of Ouchita, State aforesaid with respect shows that she was regullarly appointed administratrix of her deceased mother Parmelia Sloan, decd. estate and gave bond and took the oath of office as required by law. She further represents that on the 11th of July 1859 she filed in your honorable court on account of her administratrix said account after having been legally advertised upon evidence of its correctness being adduced was duly homologated in accordance with law. She refers to said account for an explanation of all the affairs connected with said succession of Parmelia Sloan, decd. up to the date when the account as aforesaid was filed. She further shows that since the filing of the said account, one of the Heirs of said succession to wit William C. Jones, brother of your Petitioner has died intestate leaving a minor child [blank] Jones to which his portion of said succession of Parmelia Sloan, decd. She further shows that the suit instituted by Robert Lassiter to probate a pretended olographic [sic] will is still pending in your Honorable Court. Judgement was obtained against the succession of Jno. T. Hardee & Co. for five hundred and sixteen 52/100 dollars, which amount with the interest and cost, have been paid in all amounting to five hundred and seventy nine Dollars. The suit against the succession of A. B. Cooper, Decd. described in the former account is also still pending in your honorable court. Your petitioner further shows that James B. Willson an emancipated minor one of the heirs of her said mother has instituted suit in your honorable court for a partition of the effects of said succession of Parmelia Sloan, Decd. but that Judgment has not yet be obtained. Your petitioner represents that the affairs of the succession are in a most prosperous condition. That all the debts of the estate except those contracted during the current year have been paid and that a surplus of money remains in their hands. She refers to the account of her merchant Mers. Knox and Higgins as showing the manner in which the last crop of cotton was disposed of an states that there is at present growing on the Loch Lomand Plantation belonging to the succession a fine crop both of corn and cotton. You petitioner further states, that in order to carry on advant [unreadable] the business of the succession both as to planting and Stomy [sic] at Loch Lomand her husband Hugh Yongue has necessarily had to devote a large portion of his time and attention t the said affairs besides the outlay of money in arranging the affairs of the succession in New Orleans. She has thereupon thought it proper on his account as agent to charge the estate with the value of his services. She respectfully refers the court to the annexed account and vouchers. She has still remaining in her hands the sum of three hundred and seventy eight 67/00 Dollars which she is ready at any minute to pay over to the Heirs of the succession besides the groping crop which is heretofore stated, is among [unreadable]. Wherefore your petitioner found authorized [unreadable] as aforesaid respectfully prays that an order may be granted directing this account to be duly advertised and notified to the parties interested in accordance with law. That Homer Regenburg as tutor and agent for the child of William O. Jones, Decd. may be duly cited that Robert Lassiter as tutor of the minors Victoria A. The petition of Deleware S. Jones, Admx. of the Estate of Permelia Sloan, Decd. and of Hugh Youngue, her husband who joins herein for the purpose of authorizing and assisting her in the same respectfully represents that the foregoing is a full and complete account of her acts and doings as the Admx. of said Estate. It is [unreadable] that about August 1863, it became necessary on account of the near approach of the Federals to remove the slaves belonging to the Estate from the plantation belonging thereto and that since that date the labor of said salves has been unproductive to the Estate that from an examination of the foregoing account, it will appear that the expenditures of the Estate have been somewhat greater than the income up to this date. Leaving a balance due the Administratrix of [blank] dollars. She further avers that the cotton crop of 1861 is still on hand and unsold. Also that there are outstanding claims against the Confederate States and against individuals which have not been settled as yet amounting to a considerable sum in the aggregate which will more than balance the indebtedness of the Estate so that not withstanding the unfavorable circumstances of the war and removal of the slaves, they have still made more than a support. That there is an outstanding debt due to the order of Nixon & Co. of $253.86 with 8% int. from May 21, 1862 and then may be some other small claims due in NO which like this cannot be paid at present, but that all other debts of the Estate known to the Admx. have been paid. That the debts due the Estate are for the hire of the Negroes during the past year. That all the monies she has received for a long time past have been Confederate Treasury notes and that on some of this she has lost the discount under the act of Congress no redue [?] the same &c. That the discount she lost in paying the C.S. Tax of the present year of $1313.88 amounts to $656.94 which amount forms the last item of charges in her account foregoing against the estate all of which she respectfully submits to the consideration and action of your Honorable Court. Therefore, she prays for an order granting that this her account be duly advertised and notified to the parties interested in accordance with law. That after the legal advertisements and delays, this account may be approved and homolgated in all its items and facts and that all other orders and decrees may be granted which may be necessary to secure her rights and interests in the premises and for general relief &c. Of the Estate of Permelia Sloan, Decd. and of Hugh Youngue, her husband who joins herein for the purpose of aiding, authorizing and assisting his wife here in. They both being refugees from the Parish of Ouachita, temporarily residing in the Parish of DeSoto, La. and also of James B. Wilson of the State of Arkansas respectfully represents that the Administratrix of the Estate of Permelia Sloan, Decd. has recently filed her acct. of the Administration of said Estate up to the first of Dec. 1864. They further represent that the Admx. Is now no longer able to control the Negroes belonging to the said Estate. That she has been obliged to remove these said Negroes from the plantation belonging to said Estate on account of the approach of the Federals and that some of them have run away from her temporary home and have gone back to the old place. That it is unsafe for her longer to attempt to keep the said Negroes under her control. That the heirs are now nearly all of age or emancipated and that each on is better able to take charge of their own portion of said slaves than the Admx. Is to manage the whole of them. That Hugh Youngue, the husband of the Admx. May soon be called into the service and in that case, she cannot manage the said slaves at all. That [unreadable] debts are now due by the state and those cannot now be part. That outside of the Negroes, there is about no means in the hands of the Admx. To satisfy all the debts due either liquidated or not. Then she wishes to keep [unreadable] the slaves she wishes to have partitioned. They further ask that in consequence of the removal from the plantation of the slaves, it is advisable to sell the household and kitchen furniture, 4 mules, 1 wagon, 1 Jersey wagon, 1 dray, some corn, some cows, and hogs and perhaps some other things as they will be of no further use to the Estate and they deem it advisable that the said articles should be sold. They further aver that the heirs of said Estate are Deleware S. Youngue and James R. Wilson, your petitioners, together with Deleware Jones, the daughter of William O. Jones, Decd. who was a son of the Decd. P. Sloan, Hiram A. Wilson and Victory A. Wilson, the wife of L. Pettigrew, the said Victory and Hiram also being children of the said P. Sloan, Decd. and residents of Arkansas and the said Deleware Jones is a resident of Arkansas and not represented in this state and a tutor ad hoc will be necessary to represent her in said partition. Therefore petitioners pray that all of the parties in interest as herein set forth be duly notified of this petition and that after the legal delays that there be an order granted by the court for a partition final of the Negroes of the Estate of P. Sloan, Decd. among the aforesaid heirs of said Estate. That a Notary be named and expects to affect said partition, also to fix the time and place of the same. That the said partition be made in [unreadable] and for all orders and decrees necessary in the premises in justice and equity. Pettigrew of Severn County in the State of Arkansas, the widow of Larkin Pettigrew, late of said County, deceased and daughter and one of the Heirs of Permelia Sloan, late of Union Parish in the State of Louisiana, deceased do by these present [unreadable], constitute and appoint James H. Willson of said County of Severn my attorney in fact for me and in my venue and for my use as such or otherwise as may seem to him to receive my share and interest in the Estate of said Permelia Sloan, Deceased or any part or parcel thereof and upon the receipt thereof or any part and in my name a receipt or other acquisition or proper discharge to the proper person having charge of the same to sign, seal and deliver whatsoever my said litany may do and about the premise. I do hereby confer the same as I represent and did the same in my own proper person. The petition of Hugh Yongue of the Parish of Ouachita, Louisiana who is the owner and holder by purchase of the entire interest of James B. Wilson, Victoria A. Wilson and Hiram W. Wilson in the Estate of Permelia Slone, Decd., they being heirs of said Estate and also the Petitioner Delaware S. Jones, wife of your petitioner Hugh Yongue who authorizes his said wife herein to appear and [unreadable] she being also an heir of said Estate, respectfully shows that a judgment was obtained by them contradictory with H. Regenburg, the Administrator of the Estate of W. C. Jones, Decd. who was also an heir of said Estate ordering a partition of said Estate according to law in the suit entitled J. B. Wilson vs. D. S. Now therefore to carry said judgment into effect your petitioner prays that an Inventory and Appraisement of said succession be made according to law and further that all of the property be sold according to law. Reid, Clerk 11th Judicial District Court for Union Parish on the 1st day of November 1867 to me officially directed to take charge of and sell all the remaining property of the Estate of Permelia Slone, Decd., I did proceed to take charge and on the 5th day of December 1867 when on day of sale after all legal advertisements were made, I proceeded to the late domicile of Permelia Slone, Decd. On the day appointed to wit: 5th day of December 1867 and after reading the order certificate of Mortgage and advertisement, I proceeded to the public sale of the following described tract or parcel of land to wit: The Locklomund Place described as follows viz. Lot No. 1 Section No. 3 township No. 17.20 of Range three East by old survey is now by new Survey subdivided as follows: Lots No one, two, four and five in same section township and range and containing ninety six & 19/100 acres more or less (No. of entry 4307). Also the Cardose[sic] confirmation or tract containing four hundred and twenty eight (428) acres more or less including the Peter F. Neaon Tille[sic] of one hundred and fifty acres (150). Also lots No. 1 Section thirty four (34) containing sixty two and 57/100 acres more or less. Township twenty (20) of R 3 East also the SW ¼ of the SW ¼ of Section No. 28 in Township No. 20 N of 3 East containing 39 & 20/100 acres containing in all six hundred and twenty six & 66/100 acres more or less together with the improvements and appurtenances thereon when after crying the same a reasonable length of time and in an audible voice, D. S. Yongue became the purchaser for and in consideration of the sum of One thousand and twenty dollars, that being the amount of the appraisement and he the only bidder and the receipt of the money therefore is hereby acknowledged. I, Wesley W. Guthrie, Sheriff of the Parish of Union, do hereby sell, adjudicate and deliver unto the said Hugh Yongue, his heirs and assigns for ever all the rights, title and interest which the said succession has or had to the said land. I then proceeded to the sale of the remaining property belong to said Estate which found on the Inventory to consist of the following judgments against Robert Lassiter, Provisional Administrator of said Estate viz. 1st D. The money therefore is hereby acknowledge and that amount being more than the appraisement and he being the last and highest bidder. Yongue has received 5000.00 And in order to make all of the amounts received equal to that received by W. O. Jones $5153.03 We add to the amount received by J. B. Wilson Say $4973.23 = $179.81 making $5153.03 Victoria J. Wilson has received $5240.81 Deduct from this $87.78 leaves the amount recd. $5153.03 Hiram A. Wilson has received $4598.00 We add to this amount $555.03 $5153.03 D. S. Yongue has received $5153.03 We then deduct the amount it requires to make each of the shares equal to that received by W. C. Jones say %5800.08 from the amount due by the Administratrix to wit: $6805.36 leaves one thousand and five and 27/100 dollars to be divided by five gives $201.0, the distribution share going to each heir in cash: William O.
