The petition of William P. Smith, a resident of your said Parish and State respectfully represents that Anthony Smith departed this life on or about the 20th day of December AD 1866 at Petitioners residence in said Parish leaving an Estate consisting of rights and credits, also leaving the following heirs to wit: Wm. P. smith, Petitioner, Elizabeth J. Smith, wife of Chas. J. Lassiter, David K. Smith and Amanda M. Smith, wife of James S. Tubb all being of age and now residences of said Parish. Petitioner represents that being the only heir present, he is entitled to the Administration. Wherefore he prays that an Inventory and appraisement may be had according to Law and after due and legal proceedings had, he may be appointed Administrator of the said Estate and for such other orders and decrees as the case may required. H. Regenburg, Atty. State of Louisiana 11th Judicial District Court Parish of Union It is ordered and decreed that the within application of William P. Smith to be appointed administrator of the Estate of Anthony Smith, Decd. be advertised according to Law. It is further ordered and decreed that W. C. Smith, Parish Recorder &c be and he is hereby authorized to make an Inventory and appraisement of all the property belonging to the said Estate and due return thereof make to this office. Darby and I, David Arent do hereby solemnly swear that I will faithfully and impartially appraise all the property that may be presented to me belonging to the Estate of Anthony Smith, decd. at its cash value to the best of my judgment. Smith Parish Recorder State of Louisiana 11th Judicial District Court Parish of Union Be it remembered that on this the fifteenth day of June AD one thousand eight hundred and sixty six, pursuant to an order of the 11th Judicial District Court in and for the parish of Union, La. bearing date May 5th 1866 and to me William C. Smith, Recorder and Ex Officio Notary Public and for said Parish directed and authorizing me to make an Inventory and appraisement of all the property belonging to the Estate of Anthony Smith, Decd. in the Parish of union and being assisted by W. A. Darby and David Arent, male citizens of the Parish of union of lawful age who being duly appointed and sworn by me the said Recorder as appraisers and in presence of two lawful and competent witnesses proceeded to make said inventory and appraisement at my office in the Town of Farmerville as herein after set forth: No. 1 One promissory note drawn by H. G. Blackman payable to Anthony Smith or bearer for three thousand six hundred and sixty six and two thirds dollars with % Interest from maturity till paid due Nov. 22, 1863 apprd. @ $1833.33 No. 2 One promissory note drawn by H. G. Blackman payable to Anthony smith or bearer for three thousand six hundred and sixty six dollars & two thirds dollars with 8% interest from date Nov. 22, 1862 due 24 Months after date apprd. @ $1833.33 No. 3 One promissory note dreawn by M. H. Holloway payable to [unreadable] A. Heard for forty five dollars and seventy five cents with 10% interest from date & dated January 1st 1862 and due one day after date apprd. @ $5.00 No. 4 One promissory note drawn by Thos. L. Upshaw for Twenty six 25/100 dollars due one day after date. Dated June 11th 1860 apprd. @ $10.25 No. 5 One promissory note drawn by John S. Salisberry payable to J. A. Freeland or bearer for Twenty nine and 10/100 dollars due January 1, 1862 with 10% interest from maturity apprd. to be worth $100.10 No. 6 One promissory note drawn by Melton H. Holloway to Overby & Simonton or order Forty six and 43/100 dated Jany. 21st 1861 due one day after date with 10% int. from January 1, 1862 apprd. to be worth ___$5.00 $3677.01 No. 7 A receipt signed by J. A. Sherman for a promissory note drawn by Chas. M. Desmott for the sum of four hundred dollars apprd. @ $20.00 No. 8 A receipt signed by W. W. Robinson, Dept. Sheriff dated Prentis, Miss. April 6, 1861 for a promissory note in favor of Anthony smith executed by W. W. Croom on the 19th Feby. 1859 due 1 Jany. 1861 for two thousand five hundred and sixty and 60/100 dollars apprd. to be worth ___$25.00 $3722.01 Having completed the foregoing inventory and appraisement, I have on this the 15th day of June AD 1866 closed the same in testimony whereof, I have caused said appraisers to sign their name hereto in presence of H. Smith, Sr. Administrator of said Estate respectfully represents that since taking charge of said Estate he has obtained possession of the following notes to wit: 1st a note on W. W. Croom of Eutaw, Alabama for $2666.00 due Jany. 1st 1862 and 2nd a note on Mrs. Tabita S. Hargiss and D. S. Welsh of $2003.00 due Jany. 1st 1860 said parties residents of Smith Co., Miss. Which note having come into his possession as property of said Estate. He prays may be placed as an addition to the Inventory thereof. H. Regenburg State of Louisiana 11th Judicial District Court Parish of Union The premises considered it is ordered and decreed that the above mentioned notes be placed on the Inventory of said Estate. Reid Clerk, District Court State of Louisiana Parish of Union Be it remembered that on this day the 22nd of April AD One thousand eight hundred and sixty seven pursuant to an order from the Honorable 11th Judicial District Court in and for the Parish of Union, State of Louisiana authorizing that certain notes be added to the Inventory of Estate of Anthony Smith, deceased which was omitted in the first inventory made on the 15th day of June AD 1866. I, William C. Smith, Recorder and Ex Officio Notary Public in and for Union Parish caused to come before me William A. Darby and David Arent who acted as appraisers in the original Inventory and me proceeded to make this as a supplementary Inventory of the property of the Estate of Anthony Smith, Deceased. 1st a promissory note on W. W. Croom of Eutaw, Alabama for $2666.66 due Jany. 1st 1862 apprd. to be worth $266.66 2nd A note on Mrs. Tabita S. Haynes and D. S. Welsh for $2003.00 due Jany. 1st 1860 said parties residents of Smith County, Miss. apprd. to be worth __$500.00 Total amount of supplement $767.41 This done and signed on this 22nd day of April AD 1867 in presence of Thos. F. Nolen and H. H. Cobb witnesses and me Recorder Thos. T. Nolen W. A. Darby H. H. Cobb D. Arent W. C. Smith, Recorder State of Louisiana Parish of Union I, William P. Smith do solemnly swear that I will faithfully and impartially discharge and perform all the duties incumbent upon me as Administrator of the Estate of Anthony Smith, Deceased to the best of my knowledge, abilities and understanding. So help me God. W. P. Smith Sworn and subscribed before me this the 15th day of June AD 1866. J. W. Reid Clerk, District Court Succession of Anthony Smith, Decd. State of Louisiana 11th Judicial District Court Parish of Union Whereas, William P. Smith has been duly and legally approved Administrator of the Estate of Anthony Smith and he has given bond with good security and taken the oath required by law. Now, therefore, the said William P. Smith is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appointment according to law. Given under my hand and seal of office this 15th day of June AD 1866. J. W. Reid Clerk, District Court Know all men by these presents that William P. Smith as principal and Joseph Baker and H. C. Glasson as securities are held and firmly bound unto J. H. Watkins, Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana or his successors in office in the full and just sum of four thousand seven hundred dollars for the payment whereof well and truly to be made we bind ourselves our heirs, executors, Administrators and legal representatives firmly and in solido by these presents this 15th June AD 1866. The conditions of this obligation is such that whereas the above bounden W. P. Smith has been appointed Administrator of the Estate of Anthony Smith, Deceased. Now therefore if he shall well and truly perform all the duties incumbent on him as such and shall render and account of all his acts whenever required legally so to do; and shall pay over the monies and deliver the property belonging to said Estate to the person or person authorized to receive the same. Then this obligation to be null and void, otherwise to be and remain in full force according to Law. In witness whereof the said parties have signed their names on this day and date above. ATTEST J. Glasson Order having been overlooked is recorded here State of Louisiana 11th Judicial District Court Parish of Union The premises considered and by reason of the proper and legal advertisements having been made and no opposition having been filed, it is ordered and decreed that William P. Smith be and he is hereby duly and legally approved Administrator of the Estate of Anthony Smith, Decd. and that upon his given bond with good security and taking the oath prescribed by law that letters of Administration do issue to him. P. Smith, as principal and R. W. Futch and G. A. Killgore as securities are held and firmly bound unto the Honorable J. D. Watkins, Judge of the Eleventh Judicial District Court in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of One thousand Dollars to the true and full payment thereof we bind ourselves, our heirs, executors, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La this 22nd day of April AD 1867. The condition of this obligation is such that whereas the said W. P. Smith has been duly and legally appointed and confirmed as Administrator of Anthony Smith, Deceased and he has taken the oath required by law and has given bond for the full amount of original inventory of said Estate and whereas a supplemental Inventory has this day been filed gives his additional bond. Now therefore if the said W. P. Smith shall faithfully and impartially discharge all the duties incumbent upon him as Administrator of said Estate and shall render to the Judge of said Court a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property belonging to said Estate to these proper person or persons to receive the same. Then this obligation to be null and void. Otherwise to be and remain in full force according to law. W. P. smith G. A.
