The name used most often herein was 'Alconder'. ================================================================================== To the Honorable the Judge or Clerk of the 12th Judl. Dist. Court in and for the Parish of Union, State of Louisiana. The Petition of Elijah Tabor, Resident of the Parish of Union aforesaid respectfully represents to your honorable Court that Alexander Washington Smith is a grandson of Petitioner and the son of Martha M. Tabor. Petitioner s daughter by her marriage with Burrel R. Smith the father of said child and further that the said Martha M. Tabor mother of the said Alecander Washington Smith he being a minor and she being the natural tutor of the said minor has entered upon a second marriage with [unreadable, but looks like Stanley] C. Lee and thereby has lost her right as natural tutrix to the said minor she not having previously convoked a family meeting to authorize the same. That the said minor has recently inherited property in the state of Alabama and that it is [unreadable] necessary that a Tutrix should be appointed to the said minor to look after and attend to the interest aforementioned of the said minor. That the petitioner being Grandfather to the said minor has the sole right now under the law to the tutorship of the said minor. Wherefore he prays the petitioner considered he be appointed and confirmed by your honorable court as tutor to the said minor Alconder Washington Smith under the Article 281 of the Civil Code of the State of Louisiana and that letters of tutorship do issue in her favor upon his taking the oath and giving bond according to law and that some person be appointed undertutor to the said minor for all orders and decrees necessary in the premises and for general relief &c. District Court Parish of Union In the matter of the Tutership of the minor Alconder Washington Smith, Whereas due proof has been made to this Court of all the facts and obligations of the forgoing petition or application. Therefore it is hereby ordered adjudged and decreed that Elijah Tabor be and he is hereby appointed and confirmed as tutor of the minor Alconder Washington Smith and that letters of tutorship be issue to the said Tabor upon his taking the oath and giving bond according to law and it is further ordered adjudged and decreed that George W. Tabor be and he is hereby appointed undertutor to the said minor A. W. Smith and thus letters Issue to him according to law. Done and signed in office on this April 16th AD 1860. Thos. C. Lewis, Clerk State of Louisiana 12th Judicial District Court Parish of Union I Elijah Tabor do Solemnly Swear that I will faithfully and impartially perform all the duties incumbent on me as tutor to the minor Alconder Washington Smith according to the best of my abilities and understanding. District Court Parish of Union Whereas Elijah Tabor has been duly and legally appointed Tutor to the minor A. W. Smith and he has given bond with good security and taken the oath required by law. Now therefore the said Elijah Tabor is hereby duly and legally authorized and empowered to do and perform all and singular the duties appertaining to said appointment according to law. Tabor do Solemnly Swear that I will faithfully and impartially discharge all the duties incumbent on me as Undertutor to the minor Alconder W. Lewis, Clerk Tutorship of the minor Alconder W. Smith State of Louisiana Parish of Union 12th Judicial District Court Whereas George W. Tabor has been duly and legally appointed (authorized and empowered to discharge all and singular) Undertutor to the following minor heir of the estate of Burrel R. Smith, Dec. to wit: Alconder W. Smith and he has taken the oath prescribed by laws Now therefore the said George W. Tabor is hereby duly and legally authorized and Empowered to discharge all and singular the duties appertaining to said appointment according to law. Given under my hand and seal of office on this the 16th day of April AD 1860. Thos. C. Lewis, Clk. State of Louisiana 12th Judl. Dist. Court Parish of Union Know all men by these presents that we Elijah Tabor as principal and George W. Tabor as his security are held firmly bound unto Robert W. Richardson Judge of the 12th Judicial Dist. Court in and for the parish and State aforesaid for the time being or to his successors in office in the full and just sum of [blank] the true and faithful payment whereof will and truly be made we bind ourselves heirs assigns administrators Executors and legally representation firmly together . The condition of the above obligation is such that whereas the said Elijah Tabor has been duly and legally appointed Tutor to the following minor heir of the estate of Burrel R. Smith, Decd. To wit: Alconder W. Smith and he has taken the oath prescribed by law. Now therefore if the said Elijah Tabor shall faithful and impartially discharge all the duties incumbent on him in his said capisity and shall faithfully account to the Judge of said court for all moneys or property received from this or any other State and shall faithfully render yearly to the Judge of said Court a true and faithful account of all his acts and doings in and about said matter of tutorship and shall faithfully look after the body of said minor and stay intense in all things and shall whereas legally required so to do pay over all sums of money and deliver all the property of whatever nature to the said minor or to his legal representatives or to the proper person or persons to receive the sums then the above obligation to be null and void otherwise to be and remain in full force and effect against the said principal and his said securities.
