Smith, Decd., the premises considered, it is hereby ordered that the application of O. P. Smith to be appointed Administrator of the Estate of Claiborne M. Smith, Decd. be advertised according to law and it is further ordered that W. C. Smith, Recorder and Ex Officio Notary Public proceed to make an inventory and appraisement of said Estate and return the same to this office. Done and signed in chambers on this February 5th 1873. Smith, Recorder and Ex Officio Notary Public in and for the Parish of Union personally came and affirmed Edward Dawkins and John Peak who after being sworn by me deposes and says that they appraised the property presented to them belonging to the Estate of C. Perry Smith to be appointed administrator of the Estate of C. M. Smith, deceased has been advertised more than ten days prior to this date and no opposition having been filed hereto. It is ordered that said O. P. Smith be and he is hereby appointed Administrator of the said Estate and that upon his taking the oath required by law and giving bond with good security and letter of Administration issue to him according to law. Done and signed in chambers this 17th day of February 1873. Thos. C. Lewis Parish Judge State of Louisiana Parish Court Parish of Union $12,000.00 Know all men by these presents that O. Perry Smith as Principal and [unreadable] as security are held and firmly bound to the Honorable Thomas C. Lewis, Judge of the Parish Court of Union Parish [unreadable] Twelve Thousand Dollars to the true and [unreadable] payment of which we find ourselves, our heirs administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this 17 day of February AD 1873. The condition of the above obligation is such that whereas the above bound O. Perry Smith has this day been duly and legally appointed Administrator of the Estate of C. M. Smith, deceased and he has taken the oath required by law. Now therefore if the above bound O. Perry Smith as principal shall faithfully and impartially discharge all the duties incumbent on him as Administrator of said Estate and shall render to the Judge of the aforesaid Court a true and correct account of all his acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property of whatever nature that he may have in his hands belonging to said Estate to the proper person or persons to receive the same, then this obligation to be null and void. Otherwise, to be and remain in full force and effect according to law. Done, signed and acknowledged before me this the day and date above written. ATTEST: J. W. Kilgore O. Perry Smith [NOTE: The top of next page is unreadable] To the Honorable the Judge of the Parish Court of Union Parish, State of Louisiana. The petition of O. Perry Smith of your aforesaid Parish and State respectfully shows that he has this day been appointed and qualified Administrator of the Estate of C. M. Smith, Decd.. That said Estate is composed entirely of an interest in the commercial partnership caused on heretofore at Ouachita City, La. under the firm name and style of C. M. & O. P. Smith. That said property is most of perishable in its nature and ought to be sold at once. It is further alleged that said partnership is in debt and can only be settled by the sale of all the property of said Estate. That the debts are pressing and must be paid. Wherefore he prays that he be authorized by an order of your Honorable Court to sell all of the property of the Estate of C. M. Smith, Decd. to pay the debts of said Estate according to law and that the Administrator himself be authorized to make the said sale for all orders and decrees necessary in the premises and for general relief &c. Smith, Decd., the premises considered, it is ordered that the [NOTE: The top of page is unreadable.] State of Louisiana Parish of Union Pursuant to order of the Parish Court of Union, State of Louisiana authorizing the sale of all the property of the Estate of C. M. Smith, Decd. after having advertised the seal of the personal property for more than ten days by publishing in the Union Record, a newspaper published in Union Parish, La. and having made known to those present at Ouachita City in said Parish of Union on the 4th day of March 1873 proceeded to offer at Public auction to the highest bidder the following property at the late place of business of said decd. and after drying each lot for a considerable length of time O. P. Smith being the last and highest bidder became the purchaser as follows to wit: 1 Lot of hats @ $257.15 1 Lot of clothing @ 634.85 1 Lot of hardware & cutlery &c @ 484.55 1 Lot stationary &c @ 41.51 1 Lot drugs @ 182.27 1 Lot tin & crockery @ 241.93 1 Lot saddlery @ 163.23 1 Lot guns & ammunition @ 192.12 1 Lot boots & shoes @ __699.90 Amount sale brought forward $2897.57 Dry goods & notions 1428.67 Entire lot of groceries @ 2127.28 Old buggy & harness @ 50.00 1 mule & dray @ 200.00 1 Lot of store furniture @ 182.00 1 Lot of store furniture @ ___67.00 Total sale of personal effects $6952.52 Now therefore the purchaser having complied with the terms of sale to wit, cash at not less than the appraisement, I hereby adjudicate and deliver to him each and all of the aforesaid property. Smith State of Louisiana Parish of Union Be it remembered that pursuant to an order of the Parish Court of Union Parish aforesaid authorizing the sale of all the effects of the Estate of C. M. Smith, Decd. both real and personal after having advertised said sale according to law for more than thirty days by publishing in the Union Record a weekly newspaper published in Farmerville, Union Parish, La. and after having read said advertisement in a loud voice to those present at Ouachita City on the 20th day of March 1873 and having fully made known the terms of sale to wit: Lot No. 1 and store house thereon situated on the corner of Front and Main Streets beginning on said corner and running 75 feet thence East 75 feet to place of beginning also the West ½ of Lot No. four North of Main Street also Lot No. 6 and 7 on Front Street South of Main Street with warehouse and cotton shed. That is to say the undivided one half interest in said Lots with all improvements thereon and after crying the same for a sufficient length of time O. P. Smith being the last and highest bidder and he being the owner of the other undivided half, he became the purchaser of the said property for the sum of twelve hundred and fifty Dollars $1250.00 said Lots being in Ouachita city, Union Parish, La. Now therefore the said vender having complied with the terms of the sale by paying the cash and the same bringing its appraised value according to the Inventory, I by virtue of my authority as Administrator and of the aforesaid order of court do hereby sell transfer and adjudicate unto the said O. P. Smith, purchaser the before described property with full legal Warranty to have and hold the same forever. This done and signed in the presence of James C. Manning and Wm. C. Smith, good and lawful witnesses specially called on this June 4th 1873. The above Lots being numbered and described with reference to the Plot of Ouachita City in the aforesaid Parish of Union, La.
