The petitioner of Nancy M. Stewart, Administratrix of the Estate of D. G. Fees ___25.00 $2307.21 By reference to which it will appear that she is chargeable with $2880.90 say twenty eight hundred and eighty dollars and ninety cents and that she claims credits for $2307.21 say twenty three dollars and sixty seven cents. She represents that this amount is community property, that she is entitled to one half of the said as being the widow partner in community and that the other half I due to her minor child Vestmer Stewart, the issue of the marriage between herself and the deceased D. J. Stewart, Jr. and the only heir of said deceased. Petitioner prays that this account may be duly filed and after due and legal proceedings had, be homologated and allowed and that judgment be rendered accordingly and her bond canceled and for such other orders and decrees as may be necessary. Reid Clerk, District Court State of Louisiana 11th District Court Parish of Union In the matter of the Homologation of the final account of Nancy M. Stewart, Administratrix of the Estate of D. G. Stewart, Jr., Decd. 1st Vouchers filed with final account. 2nd Jas. S. Guthrie, Dpy. Clk. Of said Court sworn says that the final account of N. M. Stewart was filed December 12th 1866 and has been advertised more than thirty days prior to this date, in the following manner to wit: by inserting an advertisement in the Union Record, a weekly newspaper published in the Town of Farmerville, La. and by posting a copy of the same at the door of the Court House of said Parish and State and there being no opposition filed to the Homologation of the same. The Petition of Margarett Feazell, widow of David Stewart, decd. respectfully sheweth that her said husband, David Stewart departed this life on or about the [blank] 1862 leaving a considerable estate consisting of land, slaves and personal property. She represents that being the widow in community, she is entitled to the administration of said estate and prays that an Inventory and Appraisement may be had according to law and that she be appointed Administratrix of the said Estate and for such other orders and decrees as the case may require. Smith, Parish Recorder be and he is hereby ordered to make an Inventory and Appraisement of all the property belonging to the Estate of David G. Smith, Parish Recorder and Ex Officio Notary Public in and for the Parish and State aforesaid proceeded to make an Inventory and Appraisement of all the property both real and personal belonging to the Estate and Succession of David G. Stewart, Decd., being assisted by Thomas J. Seale and James G. Stewart, Decd. State of Louisiana 11th District Court Parish of Union Whereas Margarett N. Stewart has this day been duly and legally appointed Administratrix of the Estate of David G. Stewart, Decd. and she hath given bond and taken the oath prescribed by law. Now therefore, the said Margarett N. Stewart is duly and legally appointed and authorized to do and perform and singularly all the duties incumbent on her by said appointment according to law. Given under my hand and seal of said Court, February 4th 1863. J. L. Guthrie, Clerk State of Louisiana Parish of Union Know all men by these presents that Margarett N. Stewart as principal and J. G. Kolb and Isaiah S. Feazel as her securities are held and firmly bound unto W. B. Egan, Judge of the 11th District Court, Parish and State aforesaid in the just and full sum of three thousand Dollars to the true and faithful payment thereof will and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. Date Farmerville, February 7th, 1863. The condition of this obligation is such that whereas the above bounden Margarett Stewart has been duly and legally appointed Administratrix of the Estate of D. G. Stewart, Decd. and she has taken the oath prescribed by law. Now therefore, if the said Margarett Stewart shall faithfully and impartially discharge all and singular the duties incumbent on her as Administratrix of said Estate, and shall account correctly to the Judge of said Court for all her acts in and about said Estate, and for all moneys belonging to the Estate, and shall whenever legally required so to do pay over all sums of money or other property to the proper person or persons to receive the same, then this obligation to be null and void. Guthrie, Clerk To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of Margarett Feazel [sic], Administratrix of the Estate of David G. Stewart, Decd. respectfully represents, that the land, cotton and Negroes inventoried in said Estate is owned in community by said Estate and the Estate [unreadable] and that in order to effect a partition between the said two Estates, it is necessary that the said property should be should. She therefore prays that an order for the sale of the same may issue, that she be authorized to make the sale and for such other orders as the case may require. H. Regenburg, Atty. State of Louisiana Parish of Union It is hereby ordered that the petition be granted and that the Administratrix be authorized to make said sale according to law. Guthrie Clerk, District Court Be it remembered that on the eighteenth day of April AD 1863 in conformity with an order of the Honorable District Court, in and for the parish of Union, Louisiana and after making lawful advertisement by posting notices, there being no newspaper published in the said Parish, the undersigned Administratrix of the Estate of David Stewart, Decd. and Administratrix of the Estate of Addision Griffin, Decd. proceeded to sell at public auction the following land, being owned in common by the said two Estates to wit: The north half of the South West quarter and the North West quarter of the South East quarter of Section No. 32 Township No. 20 Range 1 East containing one hundred and seventy acres more or less, which was bid off by Nancy M. Feazel at three dollars per acre. The South half of the South West quarter and the South West quarter of the South East quarter of Section No. 32 Township No. 20 Range 1 East containing one hundred and twenty acres more or less which tract was bid off by Mrs. Nancy Stewart of said Parish for the sum of three dollars per acre making three hundred and sixty dollars. Now therefore the said purchasers having complied on the terms of the sale by paying each the sum of three hundred and sixty dollars cash in hand, the receipt whereof is hereby acknowledged. The above mentioned tracts of land are hereby granted, bargained and sold respectively as above stated to the said purchasers, their heirs, and assigns forever.
