Stewart, Decd., Union Parish Louisiana ================================================================================= ================================================================================= NOTE: William J. Stewart was born about 1836 in Louisiana. In 1860, he and his wife Nancy Lawrence and their son lived on their farm in southern Union Parish. He enlisted in Company G, 31st Louisiana Infantry Regiment in early 1862 and was elected as a corporal. The regiment spent the bulk of 1862 in northeastern Louisiana swamps in and around the Mississippi River in attempts to harrass the Yankee forces attacking Vicksburg. The men suffered greatly from disease, and Stewart was sent home to Union Parish to recover. The petition of Samuel P. Legget, a resident of your said parish respectfully represents unto your honor that William J. Stewart, late of your said Parish departed this life on or about October AD 1862 in said Parish intestate, leaving an estate consisting of real and personal property, rights, credits, debts and also a widow in community, Nancy M. Laurence and two heirs, William W. and Lilly M. Steward, the legitimate issue of the marriage of said deceased with said Nancy M. Laurence who are both minors. Petitioner represents that no Administration has been legally had on said estate and therefore prays that an inventory and appraisement may be made according to land and after due proceedings having been hand, that he may be appointed Administrator of said Estate and for such other orders and decrees in the premises as may be necessary. Legget be appointed Administrator of the Estate of William J. Stewart, Decd. be advertised according to law. It is further ordered that William C. Legget shall faithfully and impartially discharge all the duties incumbent on him in his said Administrative capacity and shall render to the judge of the said court a true and correct and faithful account of all his acts and doings in and about said Estate and shall whenever legally required so to do pay over all sums of money and deliver all the property of whatever nature in this hands belonging to the said Estate to the proper person or persons to receive the same. Lewis Deputy Clerk District Court To the Honorable the Judge of the Eleventh Judicial District Court in and for the Parish of Union, Louisiana. The petition of Benjamin L. Jones and Samuel P. Leggett, residents of said Parish and State respectfully represents that they herewith present a process verbal of the proceedings of a family meeting held according to an order of your Honorable Court before W. J. Ramsey, J. P. which family meeting recommends that appointment of petitioner Jones as Tutor to Wm. W. Stewart and Lilly M. Stewart and petitioner Leggett Natural Tutor to his own minor child John H. Leggett. Petitioner represents that Nancy M. Lawrence the mother of said Minors departed this life on or about the 26th day of August 1866 having a small amount of personal property and a community interest in the Estate of John H. J. Stewart, Decd., that no debts, and that no administration is necessary. They represent that the recommendation of the family meeting is that the personal property be sold except certain bed clothing which would be of use to the minors and also the land. They therefore pray that the proceedings of the family meeting be homologated that they may be appointed Tutors respectively as recommended, B. L. Jones and William W. and Lilly M. Stewart and S. P. Leggett Natural Tutor to John H. Leggett and Cincinnatus H. Dacus Under Tutor. They further pray for an Inventory of the property of said minors consisting of the effects of the Estate of W. J. Stewart as per final account of S. R. Leggett, Admr. which is all community property between W. J. Stewart and Nancy M. Lawrence mother of all the minors. They further pray for an order of sale ordering the sale of all the personal property except the bed clothing and also the land and the terms recommended by the family meeting to wit: The personal property for cash and the Land on three payments one third cash and one third in one and two years. Parties giving their notes with security and a mortgage on the Land. Petitioner also prays for an order of partition pertaining to the community property between the two heirs and then the property of H. J. Stewart, Decd. between W. W. and Lilly Stewart and the property of Nancy M. Stewart between the above three minors. They also pray that R. L. Jones be authorized to make the sale and for such other orders and decrees in the premises as may be necessary. H. Regenburg, Atty. In the matter of the minor heirs of W. J. Stewart, decd. and of Nancy Lawrence, Decd. Let the prays of Petitioner be granted, that the proceeds of the family meeting filed be homologated and it is ordered that Benjamin L. Jones be appointed Tutor and T. M. Lawrence Under Tutor to the minors W. W. Stewart and Lilly M. Stewart and that Samuel P. Leggett be appointed and confirmed natural tutor and his minor child John H. Leggett, and that C. M. Dacus be appointed Under Tutor and that they take the oath and qualify according to law. It is further ordered W. C. Smith, Recorder of said Parish make an Inventory of the effects of said minors. It is further ordered that the land and personal property of said minors be sold according to the recommendation of the family meeting to wit: The sale on terms of one third cash and one third payable in one and two years. Purchasers giving their notes with security bearing 8 percent interest from the date of sale, also remaining mortgage and vender’s privileges with same and the personal property for cash and that B. L. Jones make the said sale. It is further ordered that after said sale is had, a partition be made according to law. Done and signed in chambers this the 27th day of October AD 1866. J. W. Ramsey, a Justice of the Peace in and for the Parish of Union, Louisiana in obedience to an order of the Honorable 11th Judicial District Court did convoke a family meeting consisting of F. M. Lawrence, W. F. Stinson, C. H. Dacus, S. P. Leggett and B. S. Jones being relatives and friends of William W. Stewart and Lilly M. Stewart, minor heirs of William J. Stewart, deceased and also relatives and friends of John H. Leggett, minor heir of Nancy M. Lawrence, deceased and that of the named herein duly sworn by me faithfully to discharge their duties as members of said family meeting and having deliberated upon the interest of the said minors recommended that B. S. Jones be appointed Tutor and F. M. Lawrence Under Tutor of W. W. Stewart and Lilly M. Stewart and that S. P. Leggett be appointed Tutor and C. H. Dacus, Under Tutor of John H. Leggett, that the land belonging to said minors be sold for one third cash, the balance due and payable on one and two years credit with 8 percent interest from sale, for the use of said minors and the remainder of personal property be sold for cash. I hereby certify that the above and foregoing to be a true and correct statement of proceedings done by said family meeting. W. J. Jones Be it remembered that in pursuance of an order of the 11th Judicial District Court to me directed, and after having advertised the same in the Union Record, a weekly paper published in Farmerville, Union Parish for more than thirty days. I, B. S. Jones Tutor, proceeded on the First day of December AD 1866 to offer at public auction in the premises the following described lot or parcel of land belonging to the minor heirs of the Estate of W. J. Stewart and Nancy M. Lawrence both deceased, sold in order to effect a partition to wit: The North East quarter of section No. 32, Township 20, Range one West containing one hundred and sixty acres more or less with all the improvements thereon and thereto belonging and that after affirming said land and crying the bids made for a sufficient length of time, David B. Hughes became the purchaser, he being the highest and last bidder, bidding the sum of four hundred dollars. And, the said David B. Hughes having complied with the terms of sale by paying one third of said sum to wit: one hundred and thirty three 33/100 dollars in cash and giving his promissory note with L. E. McGee in solido bearing date of the 1st December 1866 for one hundred and thirty three 33/100 dollars cash the first due on twelve months and the second twenty four months after date with 8 percent interest from the date of the same. Now therefore the said described premises is hereby adjudicated, granted, bargained and sold to the said David be [unreadable] his heirs and assigns forever receiving a mortgage and the venders privilege upon the premises until the full and final payment of said notes shall have been made. Reid, Clerk of the Court sworn says he was the acting clerk of the Court in August last, that this account was filed in the Clerk’s office on the 18th day of August AD 1866, and has been advertised for more than thirty days from the date by publication in a weekly published in the Town of Farmerville, La. called the Union Record and by posting at the door of the Courthouse in said Parish and that no opposition has been filled to the homologation of the same.
