Hamilton, a resident of this Parish for the purpose of making an Inventory and appraisement of the Property composing the Estate of William Sutten, Decd., last a resident of the Parish of Union and Whereas Benj. Moore both men of lawfull age & residents of the Parish of Union being duly appointed by me the said Recorder as appraisers and in the presence of lawfull & competent witnesses we proceed to make the following Inventory as thereinafter set forth. W. Tubor witnesses of lawfull age & domicilated in the Parish & State aforesaid who have hereto signed with said appraisers and me by Law recorded on this the day and date above written. To the Hon. the Judge of the 12th Judicial District Court and in the Parish of Union, State of Louisiana. The petition of Henry W. Hamilton a resident of the above parish and State respectfully represents unto your Hon. that on or about the 17th day of March A.D. 1860 William Sutton late a resident of your said Parish & State decd. at his residence as above leaving considerable property consisting of real estate and personal property, credits &c and also unpaid debts. Deceased also left the following minor children as heirs of the same state to wit: John S., James D., Joseph, and Sarah Jane Sutton, Sons & daughter of deceased. Petitioner represents that the property has been inventoried by the Parish Recorder as the law directs in such cases. We further represents that the property is in a condition so that it is left to waste & depreciate in Value. Whereas he asks to be appointed Administrator that he may be permitted to go in an sell and do with the property as a good Administrator. He also prays for all orders and decrees necessary in the present and for general relief &c. F. G. Hayes, Atty. for E. State of Louisiana 12th Judicial District Court Parish of Union The petition considered it is ordered and decreed that the within application of Henry W. Hamilton to be appointed Administrator of the Estate of William Sutton, Decd. be ministered according to Law. Done and signed in offices on this the 17th day of April A.D. 1860. Thos. C. Lewis, Clk. State of Louisiana Parish of Union The petition considered and by [unreadable] that proper appraisement having been made and in application being filed in my office it is thereupon decreed and decided that Henry W. Hamilton be and here appointed Administrator of the Estate of William Sutton, Decd. and upon his giving bond and good Security and taking the oath prescribed by law that letters be issued to him. Hamilton do solemnly swear that I will faithfully and impartially discharge all and singular the duties incumbent on me as Administrator of the Estate of William Sutton, Decd. according to the best of my ability and understanding. State of Louisiana 12th Judicial District Court Parish of Union Whereas Henry W. Hamilton has been duly & legally appointed Administrator of the Estate of William Sutton, Decd. and He has given bond and good Security and has taken the oath prescribed by Law. Now therefore the said Henry W. Hamilton is hereby duly & legally authorized and empowered to do and perform all acts appertaining to said appointment according to Law. Given under my official nature and Seal of said Court on this the 9th day of May A.D. 1860. Thos. C. Hamilton a resident of the aforesaid Parish & State and Administrator of the Estate of William Sutton, Deceased represents that there is a considerable amount of debts which has been presented against said Estate that the personal property of the same is subject to was in an [unreadable] in Value and further that the interest of the Estate demand a sale of all the personal property thereof. Wherefore Your petitioner prays for an order of Sale so that he may sell all the personal property belonging to said Estate. He further prays that the sale be had in the following terms. All sums of Five dollars and over on account until the first day of Jany mgt. Purchasers giving their notes with applied security for all sums under five Dollars cash. Petitioners further prays for all these orders and decrees necessary in the presence and for general relief. F. G. Hargis, Atty. State of Louisiana 12th Judl. Dist. Court Parish of Union The premises being duly considered it is ordered and decreed that all the personal property belonging to the Estate of William Sutton, Decd. Be sold according to Law in the following terms. All sum of five dollars and over on a credit till the 1st of January 1861. Purchasers giving their notes with good & solvent Security with Eight per cent Interest from date. All sums under five dollars cash and that Henry W. Hamilton, Administrator of said Estate be authorized to make said sale. Done & signed in office on this the 11th day of May A.D. 1860. Thomas C. Lewis, Clerk Administrators Bond State of Louisiana Parish of Union Know all men by these presence that Mr. Henry W. Hamilton as principle and James Edmonds as his Security are held and primly bound unto Robt. W. Richardson Judge of the 12th Judicial District Court in an for the Parish & State aforesaid for the time being or to his Successors in office in the full and just sum of Six Thousand three hundred & fifty Eight Dollars the true & faithful payment whereof well and being to be made we bond our Petition here as assigns Administrators executors & Good representatives firmly by these presents stated at Farmerville, La. May 14th A.D. 1860. The condition of the above obligations is such that whereas the said Henry W. Hamilton has been duly & legally appointed administrator of the Estate of William Sutton, Decd. makes taken the oath prescribed by Law. Now therefore of the said Henry W. Hamilton shall faithfully & impartially discharge all and [unreadable] the duties incumbent in him as Administrator of said Estate and shall faithfully account to the Judge of said Court for said moneys in properly received belonging to said Estate from this or any other sale and shall make a full and faithful account of all his acts and doings in and about said Estate to the Judge of said Court and whenever legally requires so to do to pay out all sums of money & declare all property of whatever nature belonging to said Estate the proper person or persons to receive the same then the above obligation to be null & void otherwise to be and remain in full force & effect against the principles and his said Security. Hamilton Administrator of the Estate of William Sutton deceased in compliance with the advertisement hereto annexed and made part hereof: The said sale having been advertised in the Union Democrat a weekly newspaper according to Law. The terms of sale having been made know and the aforesaid advertisement having been said aloud proceeded to offer for sale on this 5th day of June 1860. Reid, Clerk, District Court sworn says that he was the acting clerk of the court in July last; that the said annual account was filed in the Clerk’s office on the 31st day of July AD 1866 and has been duly and legally advertised for more than thirty days prior to this date by publication in a weekly newspaper published in the town of Farmerville, La. called the Union Record and by posting at the door of the Court House of said Parish; and that there as been no opposition filed to the homologation of the same.
