The Petition of Martha Mahala Tabor, wife of Sterling C. Lee, who joins his said wife herein, Susan P. Tabor, Robert J. Tabor, John L. Tabor, William T. Tabor, all residents of said Parish and State, respectfully represents unto your Honor that Elijah Tabor, late of said Parish departed this life on or about March AD 1864, leaving a widow Matilda Tabor, who also joins this petition as widow in community and your other Petitioners together with Thomas J. Tabor and Mathew B. Tabor and the heirs of Geo. W. Tabor to wit: James, Elizabeth, Susan M., Jilly E., John B. and Molly G. Tabor, heirs to his Estate, which consists of real Estate and personal property. They represent that there are no debts owing y the Estate, that an administration is necessary and that they desire a partition of said Estate according to law. They therefore pray that they may be recognized as heirs of said Estate, that an Inventory and Appraisement may be made according to law for the purpose of making said partition, that Tutors be appointed to the said minors as follows: Tutor for Thomas J. Tabor Tutor for Nathan B. Tabor Mary W. Tabor Natural Tutrix of the minor heirs of Geo. W. Tabor [blank] that [blank] and [blank] be appointed be appointed experts to make said partition according to law, and for such orders and decrees in the premises as the case may require. H. Smith, Recorder &c make an Inventory of the property of said Estate of Elijah Tabor, Decd and due return thereof make to this office. Done and signed in office on this 20 day of January AD 1865. The premises being ordered all the heirs of said Estate being present and represented, it is ordered, adjudged and decreed that the property of said Estate be partitioned among the heirs thereof, Martha Mahala Tabor, wife of Sterling C. Lee, Susan P. Tabor, Robert J. Tabor, John T. Tabor, William T. Tabor, the heirs of Geo. W. Tabor, Thomas J. Tabor and Nathan B. Tabor and that William C. Smith, Recorder State of Louisiana Parish of Union Be it remembered in that in pursuance of an order issued from the Honorable 11th Judicial District Court in and for said Parish bearing February 7th 1865, authorizing a partition of the property belonging to the Estate of Elijah Tabor, deceased among the heirs thereof, I William C. Smith, Recorder and Ex Officio Notary Public in and for said Parish and State in pursuance of said order and by the consent of the heirs and parties interested have on the 18th day of September AD 1867 assisted by Charles A. Heard and Tilman Porter lawful citizens of the Parish of Union who becoming appointed as experts to assist in making said partition being duly sworn by me proceeded to make said partition as hereinafter set forth. 1st, we proceeded to make a partition of the Community property belong to said Estate between Mrs. Matilda Tabor, the surviving spouse and partner in community of acquents (sic) and gains of Estate of Elijah Tabor deceased and the heirs thereof to wit: Martha M. Tabor, wife of Sterling C. Lee, Robert J. Tabor, John L. Tabor, William T. Tabor, the heirs of George W. Tabor, deceased, Thomas J. Tabor and Nathan Z. Tabor who are all present or represented as hereinafter set forth. The community property belonging to said Estate amounts to $4267.50 According to the inventory made on the undivided interest which is the active mass to be divided. The following debts to be paid and deducted: One promissory note in favor of Duncan Payne & Co, New Orleans principal 249.95 Interest of the same up to this date 88.64 Account in favor of W. C. Smith, Recorder’s fee 40.00 Account in favor of T. C. Lewis, Clerk’s fee 5.80 Account in favor of J. W. Reid, Clerk’s fee 5.00 H. Regenburg, Attorney’s fees ___25.00 Amounting to $414.39 This amount deducted from the active mass leaves To be divided $3853.11 Which amount to be divided unto two equal parts, Each share to be $1926.55 We then proceeded to form lots.
