Wallace, Decd., Union Parish Louisiana ================================================================================= To the Honorable the Judge of the 11th Judicial District Court in and for the Parish of union, State of Louisiana. The petitioner of Mary B. Walace of the Parish and State above written respectfully shows that John B. Walace late of the parish and State above written departed this life in the State of La. intestate in the year 1863, that he left a small succession or Estate considerably involved in debt, probably insolvent. That he left petitioner surviving spouse and partner in community and that he left six minor children all the issue of the marriage between said decd. and petitioner to wit: Mary I. Walace, John T. Walace, Sarah F. Walace, Charles L. Walace, Samuel B. Walace, Millard F. Walace and Marian B. Walace. Petitioner avers that as surviving partner she ahs the right to administer said Estate. She also avers that a sale of all of the personal property of said Estate will be necessary for the purpose of paying the debts. Wherefore she prays that this her application be advertised according to law and after the legal delays, she be appointed Administratrix of the said Estate of John B. Walace, Decd., that an Inventory and Appraisement of said Estate be considered and that she be authorized to sale all the personal and perishable property of said Estate to pay the debts thereof and further that she be appointed and confirmed Natural Tutrix of the aforementioned minors to wit: Mary E., John T., Sarah F., Charles L., Millard F., Samuel B. and Marion B. Walace for all further orders that may be necessary and for general and equitable relief &c. Jno. L. Barrett, Atty. State of Louisiana 11th District Court Parish of Union It is ordered and decreed that the within application of Mrs. Mary B. Walace to be appointed Administratrix of the Estate of John B. Walace, Decd. be advertised according to law. It is further ordered that William C. Smith, Parish Recorder &c be and he is hereby authorized to make an Inventory and appraisement of all the property belonging to the said Estate and due return thereof make to this office. Done and signed in office on this the 18th day of December AD 1865. Thos. C. Lewis Clerk, District Court State of Louisiana 11th District Court Parish of Union The prayer of the within petitioner duly considered, it is ordered and decreed that Mrs. Mary B. Wallace be appointed and confirmed as Natural Tutrix to her following named minor children to wit: Mary J., John T., Sarah F., Charles L., Millard F., Samuel B., and Marion B. Wallace and that upon her taking the oath prescribed by law that Letters of tutorship do issue to her. It is further ordered that Wesley W. Walker be appointed Under Tutor to said minor and upon his complying with the law that Letters as such do issue to him. Done and signed in office on this 18th day of December AD 1865. Thos. C. Lewis Clerk, District Court State of Louisiana 11th Judicial District court Parish of Union The premises considered and by reason of the proper advertisement having been made and no opposition being made thereto, it is ordered and decreed that Mrs. Mary B. Wallace be and she is hereby appointed and confirmed as Administratrix of the Estate of John B. Wallace and that upon her giving bond with good security and taking the oath prescribed by law that Letters of Administrator do issue to her. Berry do solemnly swear that I will faithfully and impartially appraise the property that may be presented to me belonging to the Estate of John B. C. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the [blank] day of December AD One thousand eight hundred and sixty five, I, William C. Smith, Recorder & Ex Officio Notary Public in and for said Parish duly commissioned and sworn, in presence of an order of the Honorable 11th Judicial District court in and for said Parish and being assisted by D. C. Berry and Nicholas L. White, males of lawful age and domicile who being duly appointed and sworn by me as appraisers. I proceeded to make and inventory appraisement of all the property belonging to the Estate of John B. Walace, Decd. executed at the residence of Mrs. Mary B. Walace, the surviving widow of said Jno. B. Walace, Decd. in the Parish of Union as herein after set forth: Four Bales of cotton weighing 450 lbs. each more or less 1800 lbs. Lewis Clerk, District Court Succession of John B. Wallace, Decd. State of Louisiana 11th District Court Parish of Union Whereas Mary B. Wallace has been duly and legally appointed and confirmed as Administratrix of the Estate of John B. Wallace, Decd. and she has given bond with good security and has taken the oath prescribed by law. Now, therefore the said Mary B. Wallace is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Given under my hand and seal of office on this 4th day of January AD 1866. Thos. C. Lewis Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union Know all men by these presents that we Mary B. Walace as principal and Wesley W. Walker, as her security are held and firmly bound unto Honorable J. D. Watkins, Judge of the 11th Judicial District court and for Union Parish, Louisiana for the time being or to his succession office in the just and full sum of five hundred and fifty dollars $550.00 to the time being and faithful payment whereof well and truly to be made, we bind ourselves, our heirs, assigns and legal representatives firmly by these presents. Date at Farmerville, Louisiana this the 4th day of January Ad 1866. The condition of the above obligation is such that whereas the said Mary B. Walace has been duly appointed Administratrix of the Estate of John B. Wallace, Decd. and she has taken the oath prescribed by law. Now therefore, if the said Mary b. Wallace shall faithfully and impartially discharge all and singular the duties incumbent on her as Administratrix of the said Estate and shall whenever legally required so to do pay over all sums of money and deliver all the property received by her and belonging to the Estate to the proper person or persons to receive the same, then this obligation to be null and void, otherwise to be and remain in full force and virtue against the principal and her said securities. Wallace is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law.
