D. 1907, leaving an estate consisting of real and personal property, and leaving as his sole heirs Sandy Wayne Jr., Moses Wayne, John Wayne, Thomas Wayne, Stella Benham, Georgeanna Smedley, Fannie Young, who are of lawful age, and King Wayne and Myrtie Wayne who are minors all of whom are issue of his marriage with petitioner, and for whom a tutor should be appointed. That in order that said minors may be provieded with a tutor it is necessary that an inventory be taken of all the property, real and personal, belonging to said minors and to their deceased father, Sandy Wayne, and to the community which existed between him and petitioner. Wherefore, petitioner prays that an inventory betaken of all the property belonging to said minor children or in which they own any interest, and that in due time petitioner be allowed to qualify as natural tutrix of said minors, ant that at the same time they be provided with an under-tutor; and for general relief. Fourth District court, Union parish, Louisiana. To the Honorable the fourth Judicial District court for the parish of Union, State of Louisiana: The petition of Mary Jane Wayne, the duly qualified natural tutrix of the minors, King Wayne and Myrtie Wayne, with respect shows: That each of said minors owns an undiveded one-eighteenth interest in the following described property to wit: E½ of SW¼ and W½ of SE¼ sec. 32, Tp. 23. N. N. 2 E., and NW¼ of NE¼ sec. 6 and E½ of NE¼ sec. 5 and SW¼ of NW¼ sec. 4,( less two acres) Tp. 22, N. N. 2 E., situated in Union parish, Louisiana, and containing 318 acres, more or less, as shown by the inventory herein taken and filed on the 21st. day of February, 1907. That said minors acquired title to their interest in said property by inheritance and as heirs of their father, Sandy Wayne, deceased husband of petitioner. That and undivided one-eighteenth interest in said property is likewise owned by each of the seven major heirs of the said Sandy Wayne, namely Sandy Wayne Jr., Moses Wayne, John Wayne, Thomas Wayne, Stella Wayne Benham, Georgeanna Wayne Smedley, and Fannie Wayne Young, who acquired title in the same manner as their co-heirs. That the remaining one-half interest in said property is owned by petitioner, who , as wife and partner in community of her late husband, Sandy Wayne, acquired title to said interest under deed* of record in the parish of Union, Louisiana. That the several coproproprietors above named are unwilling to remain longer in indivision as owners of said preoperty, and desire to effect a partition thereof. That the said property is not susceptible of a convenient and equitable division in kind, for which a sale will be necessary in order to effect a partition. That all the co-proprietors of said property prefer that it be sold at private sale, rather than at public auction, for the reason that the latter would entail unnecessary expense upon them all, and would involve considerable delay and loss of time. That, While petitioner is able to convey title to her undivided interest, and which the major heirs herein named are able to convey title to their undivided interest the two minor heirs, King Wayne and Myrtie Wayne, are unable to act for themselves, and petitioner is unable to convey title for them, without the advice of a family meeting and the order of the court. That the nearest competent male relatives of said minors residing within the radius prescribed by law and not having an interest on the subject matter of this petition are George Wayne, Willie Wayne, Joe Douglas, Pat Douglas, and Wilson Gardners all uncles or cousins of said minors and related to them in the second or third degree. Wherefore the premises considered, petitioner prays that a family meeting to be composed of the above named relatives to be convoked and held by some competent notary, to deliberate on the subject matter of this petition, and to advise: (1) Whether a sale of the above described property is for the best interest of said minors; (2) Whether such a sale, if made at all, should be private or public; and (3) On what terms and conditions petitioner shall be permitted to sell the minors interest in said property; that Wilson Wayne, under-tutor to said minors, be notified to attend said family meeting; and for general relief. I, George Wayne, Willie Wayne, Pat Douglas, Wilson Gardner, and Joe Odom do solemnly swear that I will faithfully and impartially give my advice and recommendations relative to the property of the tutrix Mrs. Mary Jane Wayne, of selling of certain real estate in which said minors are interested in, and to what such purchase should be made, if made at all, all of which advice I w ill give to the best of my ability and judgement. Fourth District court, of Louisiana, in and for Union parish, in the matter of the tutorship of the minor heris of Sandy Wayne deceased at the instance of the tutrix Mrs. Mary Jane Wayne, of date of July the 30th, A. D. 1907, and to me, Thomas L. Holloway, notary, directed, authorizing and commanding me to convoke a family meeting composed of George Wayne, Willie Wayne, Joe Douglas, Pat Douglas, and Wilson Gardner, Joe Douglas having been duly notified, failed to appear and Joe Odom a friend of said minors, appointed to act in said family meeting in place of Joe Douglas males of lawful age and residents of Union parish, for the purpose of advising us to whether it is to the best interest of said minors that this tutrix, Mrs. Mary Jane Wayne shall sell certain real estate, in which said minors are interested. Now therefore I, Thomas L. Holloway, Notary public duly qualified and action for and within the parish of Union, State of Louisiana, in purisance to said order did cause a family meeting to be held before me at my office at Marion, Union parish, composed of the parties herein named, on the day and date above written, at 10 oclock Am and after administering the oath on the first page hereof, to each member composing this meeting, except to the under-tutor, Wilson Wayne, who is present; That said family meeting to advise and deliberate upon the subject matter hereinbefore specically stated, and the said family meeting after advising and consulting together, advise and recommend that it is to the best-interest of said minors heirs that their tutrix Mrs. Mary Jane Wayne sell certain described real estate to wit: The NW¼ of NE¼ of sec. 6 T 22, R 2 East, and that said sale be made to Stella Wayne Benton for the surrender of a certain mortgage note amounting to the full sum of seventy five dollars. The petition of Mary Jane Wayne, the duly qualified natural tutrix of the minors King Wayne, and Myrtie Wayne, with respect represents: That, pursuant to the order of our Honarable court, a family meeting was duly convoked and held before T. L. Holloway, notary public, on the 12th. day of August, 1907 to deliberate on the advisability of of the sale of the real estate in which said minors have an interest, and to recommend the manner, terms and conditions of such sale; as a result of which meeting and deliberation the members of said family meeting have unanimously recommended that the tract of forty acres described as the NW¼ of the NE¼ of sec. 6, Tp. 22 N. R. 2 E., be sold at private sale to Stella Wayne Benton in consideration of the surender by said purchase of one certain mortgage note affecting said property and amounting to the sum of seventy-five dollars, and that petitioner be authorized to act in behalf of said minors in making said sale; all of which appears from the proves verbal of said family meeting filed on the 13th day of August, 1907. Wherefore, petitioner prays that the proceedings of said family meeting be approved and homologated, and that she be authorized to act for said minors in making a private sale of the above described property to the aboved named purchaser at the price and on the terms above set forth; and for general relief. R. 2 E., to Stella Wayne Benton, in consideration of surrender of a certain mortgage note affecting said property and amounting to the sum of seventy-five dollars. Dawkins, Judge of the 4th Judicial District court, Union parish, Louisiana: The petition of Mary Jane Wayne, the duly qualified legal tutrix of the minors King Wayne and Myrtie Wayne, with respect represents: That the said minors and your petitioner together with their brothers and sisters of age own the following described property to wit: SW¼ of the NW¼ sec. 4 E½ of the NW¼ sec. 5. T22, 2 East; W½ of the SE¼ & E½ of the SW¼, sec. 32, T23, 2 East. Your petitioner further shows that petitioner and the said heirs and owners of said property have been offered the sum of seven hundred and fifty dollars, for the timber on said lands; that said sale would be advantageous to the said minors; that a sale of the said land would likewise be of advantage to said minors and that it would probably be best to make a sale of said land and a sale of said timber standing thereon. That said major heirs desire a partition of said estate and are unwilling to remain longer co-proprietors with said minors. Petitioner represents that such sale cannot be made, however, nor can a private sale of same be made without the advice of a family meeting. wherefore petitioner prays that a family meeting in behalf of the above named minors be convened to deliberate upon the subject matter of this petition and advise whether it is to the interest and advantage of said minors that the said property be sold at private sale for the purpose of affecting a partition and a disposition of said property to the best interest of said minors and to determine whether the offer made by the Summit Lumber Co., should be accepted; said family meeting to be composed of the following named persons to wit: George Wayne, Pat Douglass, Joe Douglass, Willie Wayne, Wilson Gardner, all relatives and friends of the said minors residing within the circle prescribed by law and that Wilson Wayne, the under-tutor of said minors be notified to attend said family meeting; Further prays for general relief. Elder a Notary public in and for Union parish state of Louisiana, duly commissioned and sworn in pursuance to an order dated August 14, th 1908, and to me directed authorixing and commanding me to convoke and hold a afmily meeting in the interest of the minors King Wayne and Myrtie Wayne, said family meeting to deliberate as to whether it is for the best interest of the said minors that the merchantable pine timber on the following described land situated in Union parish, Louisiana, to wit: SW¼ of NW¼ sec. 4 & E½ of NE¼ sec. 5, Twp. 22, N. R. 2 East and W½ of SW¼ and E½ of SW¼ sec. 32, Twp. 23, N. R. 2 East be sold, said land being owned by them in indivision with their mother Mary Jane Wayne and their brothers and sisters to wit: Sandy Wayne Jr., Moses Wayne, Jno. Wayne, Thos. Wayne, Stella Benton, Georgia Ann Smedley, and Fannie Young; said minors each owning an undivided one ninth interest in said timber. Said family meeting to give such other advice as might be pertinent and to the best interest of said minors. Now therefore I, J. W. Elder commissioned and sworn as aforesaid having caused to appear before me Pat Douglas, Jake Moses, Geo. Wayne, W. L. Menser, Sam Wayne, and Sandy Wayne, all the nearest relations or friends of said minors living in this parish and each members having waived the three days notice prescribed by law, and written at the beginning hereof retired from my presence to deliberate upon their duties and after mature consultation and deliberations they returned into my office and unanimously recommended that the merchantable pine timber situated on the above described tract of land be sold to the Summit Lumber Company for seven hundred & fifty dollars this being the highest bid for same and being in addition a good sale and that their tutrix Mary Jane Wayne be authorized to make a deed in accordance with the recommendations herein set forth and that said sale be for cash. To the Honorable fourth district court, in and for Union parish, Louisiana: Herein comes Mary Jane Wayne, legal tutor of the minor heirs Myrtie and King Wayne and most respectfully shows to the court: That she has this this day filed in this court the proces verbal of the family meeting held on behalf of said minors before J. W. Elder a notary public, on the 20th day of August, 1908; that as will appear from the proces verbal, the family meeting has recommended that for the purpose of affecting a partition between the said minors and their co-proprietors, the property described in said proces verbal be sold at private sale, and the same is to the advantage of said minors; and that the offer by the Summit Lumber Co., of this parish to pay the sum of seven hundred and fifty dollars cash for the entire timber on said lands be accepted and that said deliberations and recommendations have been approved by the under-tutor. Elder, a notary, on Aug, 20th, 1908, be approved and homologated; and accordingly let the petitioner, Mary Jane Wayne, legal tutrix of said minors be authorized to sel the undivided portion which belongs to said minors in the property described in said proces verbal to the Summit Lumber Co, of this parish, for the price and sum of $ 750:00 cash.
