Wheelis (c1825 - 2 Sept 1863) lived near Union Cross Roads (now Oakland), listed by the census enumerator as Spring Hill. Wheelis owned real estate valued at $1560, and his personal estate was valued at $10,200. Sidney Wheelis was born in Georgia. In 1860, Sidney Wheelis lived next to the household of J. M. Wheelis, born about 1830 in Georgia. J. M. and S. T. Wheelis were very likely brothers, Living in the household of J. M. Wheelis was John Rolls, aged 13 years, almost certainly the man who made the petition below. He was likely a close relative. In 1860, Emiline and Sidney had these children living with her: Antoinette (born 1851), W. (male born 1853), C. (female, born 1854), James (born 1856), Agnis (born 1858), and Frances (female, born 1859). It appears that several of their daughters died between 1860 and when the following petition was made in 1868. ======================================================================================= ======================================================================================= To the Honorable the Judge of the Parish Court of the Parish Union, State of Louisiana. The petition of John H. Rowles, a resident of the parish and State above written with respect represents that Mrs. Emmline [sic] Wheelis, late a resident of aid Parish and State departed this life at her residence in said parish on or about the 19th day of October AD 1868, leaving a small estate consisting of real and personal property, rights and credits, also leaving the following named minor children to wit: Sarah A. Wheelis, Walten T. Wheelis, James S. Wheelis, Mary Wheelis and Louisa Wheelis the issue of a marriage between deceased and one Sidney T. Wheelis also deceased. Petitioner represents that the interest of said minors in said Estate render a tutorship is necessary. Wherefore he prays that after all legal delays, he be appointed tutor of the said minors and Geo. W. Murphey be appointed Under Tutor. That W. C. Smith, Parish Recorder and Ex Officio Notary Public be authorized to make an Inventory and Appraisement of all the property belonging to the Estate of Emmline Wheelis, Decd. and for all further orders and decrees necessary in the premises and for general relief &c. Tompkins presiding The premises duly considered, it is ordered that the prayer of petitioner be granted and that Jno. H. Rowles be appointed Tutor to the minor heirs of the Estate of Emeline Wheelis, decd. and that upon his giving bond with good security and taking the oath required by law that letters of Tutorship do issue to him and it is further ordered that Geo. W. Murphey be appointed Under tutor to said minors and further that W. C. Smith, parish Recorder &c be and he is authorized to make an Inventory and Appraisement of all the property belonging to the Estate of Emeline Wheelis, decd. and due return thereof make to this office according to law and signed in office this 28th day of October AD 1868. Smith, Recorder and Ex Officio Notary Public in and for said parish directed authorizing me to make an Inventory and Appraisement of the Property, rights and credits belonging to the Estate of Emeline Wheelis, deceased late a resident of the Parish of Union and being assisted by J. M. Wheelis and Jos. H. Smith, Recorder State of Louisiana Parish Court Parish of Union $2440.00 Know all men by these presents that we John H. Rowles as principal and Isham M. Weelis and George W. Murphey as securities are held and firmly bound unto the Honorable T. B. Tompkins, Judge of the Parish Court in and for Union Parish, Louisiana for the time being or to his successors in office in the just and full sum of two thousand four hundred and forty dollars to the true and full payment thereof we bind ourselves, our heirs, executors, administrators and legal representatives firmly and in solido by these presents. Date at Farmerville, La. this 18th day of November AD 1868. The condition of this obligation is such that whereas the said John H. Rowles has been duly and legally appointed and confirmed as Tutor to the minor heirs of the Estate of Emiline Wheelis, deceased and he has taken the oath required by law. Now therefore if the said John H. Rowles shall faithfully and impartially discharge all the duties incumbent on him as Tutor to the said minors and shall render to the Judge of said court a true and correct account of all his acts and doings in and about said Tutorship and shall when legally required so to do pay over all sums of money and deliver all the property belonging to the said Estate to the proper person or persons to received the same. Then that obligation to be null and void. Otherwise to be and remain in full force according to law. Done, signed and acknowledged before me this the day and date above written. J. W. Rowles has been duly and legally appointed and confirmed as Tutor of the following named minor heirs of the Estate of Emiline Wheelis, deceased to wit Sarah A, Walten T., James S., Mary A. and Lou J. Wheelis and said John H. Rowles is hereby duly and legally authorized and empowered to do and perform all the acts appertaining to the said appointment according to law. Rowles, a resident of the Parish and State above written with respect represents that he has been appointed and confirmed as Tutor of the following named minor heir of the Estate of Emiline Wheelis, Deceased, Sarah A., Walten T., James S., Mary and Louisa Wheelis that the personal property belong to said Estate is liable to waste and determination in value and that it is to the interest of all parties concerned that the same be sold. Whereupon he prays that an order may issue from your Honorable Court authorizing him to all the personal property belonging to said Estate of Emiline Wheelis, decd. in accordance with law. He further prays for all [unreadable] orders and for general and equitable relief &c. Thos. C. Lewis Atty. in fact for Petr. State of Louisiana Parish Court Parish of Union It is hereby ordered that the prayer of petitioner be granted and that all the personal property belonging to the minor heirs of the Estate of Emiline Wheelis, decd. be sold and further that Jno. H. Rowles, Tutor to said minors make said sale in accordance with articles 990 and 991 of the Code of Practice and due return thereof make to this office according to law. Done and signed officially this 18th day of November AD 1868. T. B. Tompkins Parish Judge Union Parish, La. State of Louisiana Parish of Union Be it remembered that on the 20th day of November AD 1869 in pursuant to an order from the Honorable the parish Court in and for Union Parish, La. issued by and with the advice of a family meeting and to me directed authorizing me to sell all the real estate belonging to the heirs of the Succession of Emiline Wheelis and after first having given public notice by inserting an advertisement in the Union Record, a weekly paper published in the Parish of Union, Louisiana. I, John H. Rowles, Tutor of the minor heirs of the Estate of Emiline Wheelis between the legal hours of sale at the late residence of deceased in said Parish proceeded to offer for sale at public auction the following described tract or parcel of land belonging to said Estate lying and being situated in said parish and State viz. The North West quarter of Section Seven (7) in Township Twenty three (23) North of Range one (1) East and the North East quarter of the South East quarter of Section Eleven (11) and the South East quarter of the North East quarter and the South East quarter and the East half of the South West quarter and the South West quarter of the South West quarter of S3ction Tw4elve in Township 23 North Range 1 West containing 520 acres more or less. And after crying the sale a sufficient length of time the above described land was bid off by Thomas B. Wheelis he being the last and highest bidder bidding the sum of one thousand dollars. Now therefore the said Thomas B. Wheelis having complied with the terms of sale by giving his two promissory notes for the sum of five hundred dollars each, one due twelve months after day of sale, the other due two years and after day of sale both drawing eight per cent per annum interest from day of sale (viz.) November 20th 1869 until paid the said T. B. Wheelis signing said notes as principal and J. M. Wheelis and Daniel Houser as security. I, John H. Rowles, Tutor of the minor heirs of the Estate of Emiline Wheelis, decd. do by these presents grant, bargain, sell and convey unto the said Thomas B. Wheelis, his heirs, assigns and legal representatives the above described land with all the legal warrantees hereby reserving and retaining as special mortgage and vendor’s privilege on said land until the said notes, interest ad all costs that may occur on same be fully and finally paid. In testimony, I herby sign my name officially together with said Thos. B. Wheelis in the presence of T. E. Mayo and Thos. C. Lewis, lawful witnesses this 25th day of February 1870. Thos. C.
