Whitescarver was born about 1831 in Kentucky. In 1860 he farmed near Marion with his wife, E. N. Whitescarver (born c1837 in Alabama). Whitescarver enlisted in Union Parish as a private in Company E, 25th Louisiana Infantry Regiment on 26 February 1862, entering the Confederate service in March at Monroe. He died at Memphis, Tennessee on 1 April 1862. ================================================================================== ================================================================================== Union Parish Louisiana Succession Book F, pp. 440 - 443 ================================================================================== ================================================================================== To the Honorable the Judge of the 11th Judicial District Court in and for the said Parish of Union, Louisiana. The petition of James Edwards of the Parish of Union aforesaid respectfully represents, shows that Frederick W. Whitescarver late of said parish and State departed this life about April or May 1862 leaving an Estate consisting so far as Petitioner is avail of a tract of land and some debts and aging intestate, also left a surviving widow who has since married. Petitioner avers that he left no children at his decease and that there are no beneficiary heirs within his knowledge, also that he is a creditor of said deceased to the amount of forty five hundred dollars besides interest which amount was secured to Petitioner by a mortgage executed by said deceased in his life on the said land which mortgage was duly recorded in the office of the Recorder of Mortgages for your said Parish of Union; and further as a creditor, Petitioner has the right to administer on said Estate and that said administration is necessary in order to pay the debts of said Estate and especially the debt due petitioner. Wherefore he prays that this his application be duly advertised and that he be appointed Administrator of the Estate of said F. W. Whitescarver, decd., that an Inventory and Appraisement of the Estate be ordered and that a sale of the property be ordered to pay the debts of said Estate and that petitioner be ordered to make said sale and for all further orders and decrees necessary in the premises and for general relief &c. Jno. L. Barrett, Atty. State of Louisiana 11th Judicial District Court Parish of Union In the matter of the Estate of F. W. Whitescarver, the premises considered, it is hereby ordered and decreed that the foregoing application of James Edwards to be appointed Administrator of the Estate of Fredrick W. Whitescarver be advertised according to law. It is further ordered that Wm. C. Smith, Recorder &c do make an appraisement and inventory of the said Estate of F. W. Whitescarver, Decd. according to law. Done and signed in office on this January 29th 1867. J. S. W. Whitescarver be sold in accordance with Articles 990 & 991 Code of Practice. Guthrie Deputy Clerk, District Court State of Louisiana 11th Judicial District Court Parish of Union $500.00 Know all men by these presents therein, we James Edwards as principal and John Bearden as security are held and firmly bound unto the Honorable Judge of the 11th Judicial District Court in and for Union Parish, La. for the time being or to his successors in office in the just and full sum of Five hundred dollars to the true and full payment we bind ourselves, our heirs, executors, administrators and legal representatives firmly and in solido by this presents. Dated Farmerville, La. this 21st day of February AD 1867. The condition of the obligation is such that whereas the said James Edward has been duly and legally appointed and confirmed as Administrator of the Estate of F. W. Whitescarver, Deceased and he has taken the oath required by law. Now therefore, if the said James Edwards shall truly and faithfully discharge all the duties incumbent on him as Administrator and shall render to the Judge of said Court a true and correct account of all his acts and doings in and about said estate and shall when legally required so to do pay over all sums of money and deliver all the property belonging to the said Estate to the proper person or persons to receive the same. Then this obligation to be null and void. Otherwise to be and remain in full force according to law. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 21st day of February AD one thousand eight hundred and sixty seven pursuant to an order issued from the Honorable 11th Judicial District Court in and for the parish of Union and State of Louisiana and to me William C. Smith, Recorder and Ex Officio Notary Public in and for the Parish and State aforesaid directed authorizing me to make an Inventory and Appraisement of the property belonging to the Estate of Fredrick Whitescarver, deceased late of the Parish of Union, La. and being assisted by James P. Montgomery and John Bearden male citizens of said Parish of lawful age who being appointed and sworn by me as appraisers and in the presence of lawful and competent witnesses, I proceeded to make said Inventory and appraisement as herein after set forty (Property pointed out by James Edwards) First, a tract of land lying and being situated in the Parish of Union, La. known as the late domicil of F. W. Whitescarver number as follows: The south West ¼ of the North East quarter and the North West quarter of the South East quarter of Section No 26 Township No. 22 North of Range no. three east containing eighty three 50/100 acres appraised at four hundred dollars ($400.00) Having completed the foregoing inventory and appraisement, I have on this the [blank] day of February AD 1867 closed the same amounting in the aggregate to Four Hundred Dollars. Reid, Clerk ================================================================================== ================================================================================== Union Parish Louisiana Succession Book F, p. 579 ================================================================================== ================================================================================== State of Louisiana Parish of Union Pursuant to an order of the 11th Judicial District Court in and for the Parish of Union aforesaid after having advertised the same according to law by publishing the same for more than thirty days in the Union Record, a weekly newspaper published in said Parish to wit from March 15th to April 15th 1867. A copy of which advertisement is hereto annexed on the 15th day of April 1867 as the late residence of F. W. Whitescarver, Decd. between the legal hours of sale and having read in a loud voice to all those present the said advertisement and fully made known the times of sale. I offered at public auction to the last and highest bidder as the property of the Estate of F. W. Whitescarver, Decd. the following described tract of land to wit: the SW ¼ of NE ¼ and the NW ¼ of SE ¼ of Section 26 Township 22 North of Range three East containing 80 40/100 acres and after crying the same for a sufficient length of time J. G. Brown became the purchaser for the sum of Five hundred dollars cash, he being the last and highest bidder. Now therefore the said Brown having complied with the terms of sale by the authority vested in me as Administrator of the said Estate of F. W. Whitescarver, Decd. I do hereby sell, adjudicate and deliver unto the said Brown the above described tract or parcel of land lying in the aforesaid Parish of union to have and hold the same forever. In testimony whereof I have hereto signed my name officially on this the 4th day of September 1867 in presence of Jno. L. Barrett and W. W. The petition of James Edward, Administrator of the Estate of F. W. Whitescarver, Decd. duly appointed Hon. Court respectfully shows that in the administration of said Estate he is chargable with the sum of five hundred dollars, it being the said amount of assets of said Estate. See the process verbal of sale filed September 5th 1867 $500.00 Petitioner further shows that he has allowed the following as just claims against said Estate that they are privileged claims and entitled to the following order to wit: Law charges 1st Clerk’s cost, See voucher 1 [blank] 2nd Recorder’s fee, See Voucher 2 5.00 3rd Advertising, See Voucher 3 & 4 11.00 4th Attorney’s fee, See Voucher 5 25.00 5th Admr. Commission 2 ½% on $500.00 12.00 Mortgage debts for the sum of five hundred dollars due James Edwards and act of Mortgage duly recorded 500.00 Petitioner represents that no ordinary debts have been presented to him for allowance or registry and he believes the foregoing are all the debts of the Estate. He therefore prays that this his statement of debts and Tableau of Distribution be advertised according to law and after legal delays that this his account final be approved and homologated and he be authorized to pay the assets of the Estate of the Claimants in the order set forth in this Tableau of Distribution and having done so that his bond be cancelled and for all orders and decrees necessary in the premises and for general relief &c. Reid, Clerk State of Louisiana 11th Judicial District Court Parish of Union In the matter of the homologation of the Statement of Debts and Tableau of distribution filed by James Edwards as Administrator of the Estate of F. W. Whitescarver, Decd. 1st Vouchers failed with said Tableau 2nd James W. Reid, Clerk of the District Court, sworn says he was the acting clerk of the said Court in March last, that said statement was filed on the 11th day of March and has been advertised according to law for more than thirty days prior to this date and that no opposition has been filed to the homologation of the same. Reid Clerk, District Court State of Louisiana 11th District Court Parish of Union By reason fo the law and the evidence in this case and by further reason of the proper and legal advertisements having been made and no opposition having been made thereto, it is ordered, adjudged and decreed that the within Tableau be and the same is hereby allowed, approved and homologated in all its parts and the Administrator is ordered to pay in according therewith.
