Winds, Decd. To the Honorable the Judge of the 12th Judicial District Court in and for the Parish of Union, State of Louisiana The petition of Robert W. Winds, a resident of your said Parish and State aforesaid respectfully represents unto your honor that Edward B. Winds, brother of your petitioner departed this life on the first of this month January 1861 at his residence in said parish, intestate, leaving a surviving widow, partner in community and three minor heirs to wit: Rachel D. Winds, Edward B. Winds, Jr., and Robert Milburn Winds, also a large Estate consisting of slaves and real and personal property. Petitioner represents that it is necessary an administrator be appointed by your Honl. Court to take charge of said succession, that the surviving widow and partner in community of Deceased is the person legally entitled to administer but that she desires and requests your petitioner to make application for said administration. Wherefore petitioner prays you honor the same W. C. Smith, Parish Recorder and Ex-officio Notary Public for said parish be ordered by your Honorable Court to take a faithful inventory of the effects belonging to the succession of Edward B. Winds, decd. and after due advertisement your petitioner be appointed Administrator of said succession upon his giving bond according to Law and finally for all orders and decrees necessary with premises of a general relief. Winds, Decd. and he has given bond and good security and has taken the oath prescribed by Law. Now therefore the said Robt. W. Winds is hereby duly and legally authorized and empowered to do and perform all acts appertaining to said appraisement according to law. Pearson as his securities are held and firmly bound unto R. W. Richardson, Judge of the 12th Dist. Court in and for Union Parish, State of Louisiana and to his successors in office in the sum of Thirty five thousand and two hundred dollars to the true and faithful payment thereof we bind ourselves, our heirs and assigns on this the 2nd day of July 1861. The condition of the above obligation is such that whereas the said Robert W. Winds has been duly appointed administrator of the Estate of Edward B. Winds deceased and he has taken the oath prescribed by law. Now therefore if the said Robt. W. Winds shall faithfully administer said Estate and shall do an perform all the acts in and above said Estate and shall wherever legally required so to and render a true and correct account to the Judge of the same Court [unreadable] of said Estate when required legally so to do then his obligation to be null and void otherwise to be and remain in full force and effect against the principal and his said securities. Windes, Decd. To the honorable the Judge of the 11th Judicial District Court in and for the Parish of Union, Louisiana. The petition of Sarah Carr, formerly wife of E. B. Windes, Decd. late of said Parish, now the wife of Robert W. Futch, also a resident of said Parish, being herein authorized and assisted by her said husband who joins her herein for that purpose, respectfully represents that she is a partner in the community property forming part of the Estate of said E. B. Windes, Decd. and that Edward B. and Robert W. Windes, minor heirs of the said E. B. Windes the issue of the marriage between the said Decd. and petitioner are the only heirs. She represents that in contracting the said second marriage she lost the right to the Natural tutorship of the said minors, and that she desires that their natural Uncle Robert W. Windes should be approved their tutor and that there should be a partition of the community property between herself and her said children. She therefore prays that an inventory and appraisement of the said community property be made according to law for the purpose of a partition. That a partition be ordered according to law that William A. Darby and William Pearson be appointed experts to make the petition and that R. W. Windes be appointed Tutor to the minors and R. W. Futch Under Tutor to the said minors Robert B. and R. W. Windes. She also prays that the necessary order for inventory of the other property be3longing to the said minor heirs may issue and all such other orders &c as the case requires. H. Regenburg, Atty. State of Louisiana 11th District Court Parish of Union The premises considered it is ordered and decreed that R. W. Windes be and he is hereby appointed tutor of the minor heirs of the Estate of E. B. Windes, decd. to wit: Edward B. and Robert W. Windes and upon his giving bond with good security and taking the oath required by law that letters do issue to him and that R. W. Futch be and he is hereby appointed under tutor to the said minor heirs of E. B. Windes, decd. and upon his taking the oath prescribed by law that letters do issue to him. It is further ordered that W. C. Smith, Parish Recorder and Ex Officio Notary Public be and he is hereby authorized and commanded to make an inventory and appraisement of the community property belonging to the said Estate and due return thereof make to this office without delay. It is further ordered that there be a partition of said property according to Law and that Wm. A. Darby and William Pearson be and they are hereby appointed experts to make said partition and further that W. C. Rabun about $2000.00 A note held by John Street about $1200.00 And as far as he has had funds in hand leaving a few debts yet due amounting to about $800.00 and also two security debts of $500.00 each. These debts the administration desires to pay before delivering the property to the heirs and prays for an order to sell such personal property as may be spared to an amount sufficient to pay the same. Windes shall faithfully and impartially discharge all and singular the duties incumbent on him as Tutor aforesaid and shall account faithfully to the Judge aforesaid for all his acts in and about said matter of Tutorship and shall faithfully look after the interest of said minors in all things and shall whenever legally required so to do, pay over all sums of money or other property of whatever nature belonging to said minors to the proper person or persons to receive the same then the above obligation to be null and void. Smith, Parish Recorder State of Louisiana Parish of Union Be it remembered that on the 26th day of September AD 1863, I William C. Smith, Parish Recorder and Ex Officio Notary Public in and for said Parish and State together with Wm. A. Darby and William Pearson duly appointed experts to make a petition of the community property viz. slaves and personal property belonging to the Estate of Edward B. Windes, decd. between the partner in community and the heirs E. B. & R. W. Windes, minors. Said Experts being first duly sworn, we proceeded to made said partition as herein after set forth, the parties being present the minors being represented by Robert W. Windes, Tutor. The lands belonging to the community as will appear on the inventory this day made is set aside to bee partitioned at some future day. The property to be partitioned is valued at ten thousand nine hundred and seventy five dollars $10,975.00. Winds, Decd. To the Honorable Judge of the 11th Judicial District Court in and for the Parish of Union, State of Louisiana. The petition of Robert W. Winds, a resident of your said Parish with due receipt represents that Petitioner was the administrator of the succession of E. B. winds, Decd. late of said Parish and is now the tutor of the minor heirs Edward and Robert W. Winds of said E. B. Winds, Decd. that upon the settlement of said succession, Petitioner as Admr. there were a considerable amount of debts left unpaid, also that there was only a partial division of the effects of the succession between said minor heirs and their mother who was the surviving partner in community of their said deceased father, that the said consisting of the Plantation known as the late residence of said E. B. Winds, Decd. and several lots &c in Farmerville were left undivided. Petitioner, now represents that in order to pay the remaining debts and farther to effect a partition of between said minors and said surviving Partner in Community it is necessary at least that a portion of said undivided property be sold. Petitioner represents that it will be for the interest of all concerned that the plantation remain as it now is and that the property situated in Farmerville be sold. Petitioner also represents that the mother of said minors is living and is the proper one to be Tutrix to said minors, her children and that Petitioner desires to be discharged from his appointment as Tutor and that it be conferred on their mother who is now the wife of R. W. Futch. Wherefore, Petitioner prays your honor that a family meeting be convoked for the purpose of deliberating upon the matter according to law and that an order issue from your Honorable Court directing the sheriff authorizing him to sell all the property belonging to the legal representatives of said E.
