Windes was born about 1824 in Mississippi. In 1850, he lived in Union Parish northwest of Farmerville, near what is now known as the Zion Hill Community, with his wife Eliza, born about 1831 in Alabama, and daughter Sarah, born about 1848. B. W. Odom lived in Windes' household and worked as an overseer. His first wife and daughter apparently died in the 1850s, for by 1860, Windes lived in or just outside Farmerville with his second wife, Sophronia W, born about 1836 in Georgia. Windes owned much valuable property for that era, with real estate valued at $7500 and personal estate at $22295. This included the value of his 26 slaves who lived on six slave houses on his plantation. Probably due to his financial status and the number of slave he owned, Windes apparently managed to avoid military service during the war. In 1870, he lived on his farm near Farmerville with Sophronia and their children: Rodell (born 1861), John (born 1863), and Eugene (born 1866). Following Robert W. Windes' death in January 1873 and the settlement of his estate in the next few years, Sophronia moved her family to the City of Monroe, where she lived in 1880. All four of her children lived with her: Rodell L., John V., Eugene, and Orlow, her daughter born in 1871. Rodell worked as a store clerk, while John and Eugene worked as telegraph operators. ======================================================================================= ======================================================================================= To the Honorable the Judge of the Parish Court in and for Union Parish, State of Louisiana. The petition of Sophonia W. Winds, a resident of said Parish represents unto your honor that Robert W. Winds departed this life on or about the [blank] day of January 1873 at his residence in said parish intestate leaving your petitioner the surviving spouse and four minor children to wit: [blank] the issue of the marriage between petitioner and her said deceased husband and an Estate worth several thousand dollars. That it is necessary to appoint an administrator or represent the Estate of said deceased. The petitioner being the surviving spouse of decd. and partner in community is entitled to said appointment. Petitioner also avers that she is the Natural Tutrix of her said minor children and desires to be confirmed as such. Wherefore petitioner prays that after due advertisement and all legal delays, that she be appointed Admx. of the succession of Robert W. Winds, decd. and confirmed natural Tutrix of her said minor children upon complying with requests of law. That W. C. Smith, Recorder & Ex Officio Notary Public be ordered to take an Inventory of the property belonging to said Succession. For all other orders and decrees necessary in the premises & for general relief. R. W. Futch, Atty. Parish Court of Union Parish, La. Premises considered, it is ordered that the within application of Mrs. Sophonia W. Winds to be appointed Admx. of the Estate of R. W. Winds, Decd. be advertised according to law and further that W. C. Smith, Parish Recorder & Ex Officio Notary Public be & is hereby ordered to proceed to make and Inventory and Appraisement of all the property belonging to said Estate of R. W. By reason that the proper advertisement has been made and no opposition has been filed thereto, it is ordered that Sophonia W. Winds be and she is hereby appointed Administratrix of the Estate of Robert W. Lewis, Judge of the parish Court in and for the Parish of union, La. and unto his successors in office in the just and full sum of Fourteen Thousand ($14000.00) dollars to the true and faithful payment of which well and truly to be made, we bind ourselves, our heirs, administrators and legal representatives firmly and in solido by these presents. Dated at Farmerville, La. this fourteenth day of January AD 1873. The conditions of the above obligation are such that whereas the above bounden Sophonia W. Winds has this day been duly and legally appointed Administratrix of the Estate of Robert W. Winds, Deceased and she has taken the oath required by law. Now therefore if the above bounden Sophonia W. Winds shall faithfully and impartially discharge and perform all and singular the duties encumbered on her as Administratrix of said Estate and shall render to the Judge of the parish Court of Union parish, La. a true and correct account of all her acts and doings in and about said Estate and shall when legally required so to do pay over all sums of money and deliver all the property of whatever nature that she may have in her hands belonging to said Estate to the proper person or persons to review the same then this obligation to be null and void. Winds is hereby duly and legally authorized and empowered to do and perform all and singular the duties and acts appertaining to the said appointment according to law. The petition of Sophonia W. Winds, a resident of your said parish and Admx. of the Estate of Robert W. Winds, Decd. with respect represents that there is belonging to said Succession of Robert W. Winds, Decd. a considerable amount of personal property that is liable to perish or become lessoned in value. That there are also debts to be paid. That the interest of said Estate requires that the personal property belonging thereto be sold at as early a day as possible. Wherefore, petitioner prays your honor that an order do issue from your Honorable Court directing that all the personal effects belonging to the Succession of Robt. W. Winds be sold at public auction to the last and highest for cash after due advertisement &c according to law. That the Admx. be authorized to make said sale. The petition of Mrs. Sophonia W. Winds, a resident of the Parish and State aforesaid and Administratrix of the succession of R. W. Winds, Deceased late of said parish, represents the Admx. has fully and completely administered said Succession, settled all the debts against said Succession. That it is unnecessary to keep said Succession open any longer. Petitioner therefore presents hereto annexed her final account with said Succession as Admx. that said account shows a balance in the hand of the Admx. of Four thousand nine hundred and twenty and 05/100 dollars ($4920.05/100). Petitioner represents that land retained as belonging to said Succession with the improvements thereon constitute the separate Estate of the Deceased. That the balance in the hands of the Admx. as shown by said account together with the personal property and right and credits returned constitute the community property of said Succession. That petitioner being the surviving spouse and partner in community with her said decd. husband one undivided half of said community belongs of right to petitioner. That said deceased left no heirs except the issue of the marriage of petitioner with her said deceased husband. That deceased left the following heirs the issue of his marriage with petitioner to wit: [blank]. That said minor heirs interest the entire other undivided half of said community. That according to the statute of the State, petitioner as the surviving partner in community with said R. W. Winds, decd. is entitled to the usufruct [sic] of that portion of the community. That may be inherited by the said minor heirs of the decd. during petitioners natural life or widowhood. That petitioner will have to account to said heirs only for the necessary rising from the land belonging to said heirs. Represents that it is necessary that petitioner be confirmed Natural Tutrix to her said minor children and that an Under Tutor be appointed. Wherefore petitioner prays your honor that the petitioner be duly confirmed and appointed natural Tutrix to her said minor children and that an Under Tutor be duly appointed and letters issue accordingly. That the annexed final account be duly advertised according to law. That after all legal delays said account be approved and homologated in all its parts. That upon petitioner being qualified as Natural Tutrix to said minor children, the petitioner be authorized to take possession of the property as follows: one undivided half of the community in her own right of ownership, the other undivided half of the community with the right of respect of the same during her natural life of widowhood and the real or separate Estate of Deceased as Natural Tutrix of her said minor children and that petitioner's bond as Admx. be cancelled and declared void and petitioner discharged from the further Administration of said Succession. Parish Court in and for Union Parish, State of Louisiana By reason of the law and evidence and by further reason of the annexed final account of Mrs. Sophonia W. Winds, Admx. of the Succession of R. W. Winds, deceased with said succession having been duly advertised according to law for more than ten days and then being no opposition filed to said account it is ordered, adjudged and decreed by the court that said final account of Mrs. Sophonia W. Winds, Admx. of said Succession of R. W. Winds, deceased with said succession be and the same is hereby allowed, approved and homologated in all its parts. It is further ordered and decreed that said Sophonia W. Winds be and she is hereby authorized to take possession of the property returned and in the hands of the said Sophonia W. Winds as Administratrix as aforesaid as follows 1st the one undivided half of the community property in her own right as owner of the other undivided half of said community by virtue of the right of usufruct which she is entitled to under the statute of State and of the real estate which constitute the separate estate of decd. as Natural Tutrix of her minor children the sole heirs of said R. W. Winds, Decd. That the Administratrix bond be cancelled and annulled and the Administratrix finally be discharged from further administration of said Succession of R. W. Winds, decd. Done, read and signed in open court on this 14th day of May AD 1873. Thos. C. Lewis Parish Judge To the Honorable the Judge of the Parish Court of Union Parish of Louisiana. The petition of Mrs. Sophonia W. Winds, a resident of your Parish and State aforesaid respectfully shows that she has been legally appointed and confirmed Natural Tutrix of the minors of R. W. Winds, Decd. That they possess, inherited from their father's estate a large plantation or tract of land which is expensive to keep up and which when managed in the best manner possible will yield little or no income that the investment is an unprofitable on under the circumstances and it would be for the interest of said minors that said land should be sold and its effects administered in some other manner. Petitioner therefore prays that a family meeting composed of the relatives and in default of relatives of the friends of the said minors to advise minors. That said family meeting b immediately convoked, that Wm. C. Smith, Recorder &c convoke the said meeting and make due return thereof to this the Parish Court for all orders and decrees in the premises and for general relief &c. Jno. L. Barrett Atty. for Petr. Smith, Parish Recorder and Notary proceed to convoke a family meeting of the relatives and in default of relatives of the friends of the minor heirs of Robert W. Winds, Decd. to advise and recommend with regard to the sale of the real property of said minors and also as to the terms of sale should a sale be thought advisable and make due return of the same. Winds, Tutrix of the minor heirs of Robt. W. Winds, decd. respectfully shows that a family meeting composed of the relatives and friends of the aforesaid minors duly convoked to advise and recommend the sale for cash of all the real property of said minors at the appraisement to wit $2.00 per acre and that these proceedings have been approved by the Under Tutor. The process verbal of said proceedings being hereto annexed and made a part of this petition. Wherefore petitioner prays for an order of your Honorable Court homologated said proceedings and authorizing your petitioner to make a sale of all the real property of said minors at public auction for cash at not less than $2.00 per acre for the whole land in accordance with the recommendation of said family meeting and that the cost of these proceedings be [unreadable] the property sold and for general relief &c. It is hereby ordered, adjudged and decreed that the proceeding of the family meeting hereto annexed be and they are here by approved and homologated and in accordance therewith Mrs. Sophonia W. Ward, Tutrix is hereby authorized to sell at public auction all of the property of said minors for cash at not less than two dollars per acre for the entire tract of land, twelve hundred and forty acres more or less after the legal advertisements and that the costs of the sale be borne by said minors. Winds, decd. said parties being first sworn by me according to law, proceed to deliberate and advise on the subject matter above statute and after mature deliberation they advise and recommend that all of the real property belonging to the Estate of Robert W. Winds, decd. be sold for cash for a sum not less than the appraisement to wit at two dollars per acre.
