The Petition of Joseph J. Smith, a resident of your parish & State respectfully represents unto your honor that Samuel L. Wright departed this life some time ago in the Parish leaving a wife and several minor heirs. That of rights his said wife the mother of his said minor heirs be made their Tutrix but that she has & [unreadable] herself of said tutorship by contracting a second marriage with your petitioner without calling a family meeting to the premises whether she should retain the tutorship according to Law. That said heirs minor children may now without any tutor at all and that they bear rights to assess that makes it necessary for a tutor to be appointed by your honorable with the advice of a family meeting. That their mother now the wife of your petitioner wishes said appointment wherefore your petitioners prays your honor to have a family meeting convened for the purpose of deliberating upon the property of appointing a tutor to said minor heirs and advising who shall have said appointment and that the last Saturday in this month be the day set apart for the convocation of said meeting and finally for all orders necessary in the premises and for general relief. Worman and relations and friends of t he minor heirs of S. L. Wright, Decd. according to law to convoke before William C. Smith, Parish Recorder &C on the last Saturday in January 1860 to deliberate upon the matter and things set forth in the petition. Done and signed in office thereof the District being about on this the 14th day of January A.D. 1860. Thos. C. Ellis and her husband both residents of your said Parish & State respectfully represents unto your honor that in presence of a decree of your honorable Court, W. C. Smith, Parish Recorder and Exofficio Notary Public, convoked a family meeting for the purpose of determining who should be appointed tutor to the minor heirs of Samuel L. Wright, Decd. the issue of the marriage between the said Samuel J. Wright and your petitioner Sarah E. Ellis that said family meeting advised that your Petitioner Sarah E. Ellis being the mother and said natural tutrix be continued as the heirs to said minors and that her said Joseph J. Smith be appointed Co-tutor. All of which will appear by reference to the proceeding of said family meeting hereto answered. Wherefore petitioner prays that the said proceedings be homolgated in all its parts and that [blank] be appointed under tutor to said minors finally petitioner prays for general relief. R. W. Smith, Recorder State of Louisiana Parish of Union Be it remembered that on this the 28th Jany. 1860 in pursuance to an order of the Hon. The clerk of the 12 Judl. District Court in and for the parish of Union, State of Louisiana before me W. C. Smith, Parish Recorder & Exofficio Notary public, personally came and appeared John Norsworthy, John Hill, L. F. Rowland, W. W. Guthrie and M. S. Carson convoked in a family meeting to advise and recommend whether Sarah E. Ellis, the mother of the minor heirs when after being duly sworn and after much deliberation and communication advise and recommend that the said Sarah E. Ellis widdow of said Samuel L. Wright decd. and now the wife of Joseph J. Smith should be appointed and confirmed a tutrix and Joseph J. smith Co tutor upon given [unreadable] and taking the oath according to law in full faith whereof the said past members have hereto signed their names in presence of the undersigned. Court Parish of Union The premises considered it is ordered adjudged and decreed and decreed the within process verbal of a family meeting duly convoked before W. c. Smith, parish Recorder and Exofficio Notary Public on the 28th day of Jany. A.D. 1860 be and it is hereby approved and homolgated in all its parts. It is further ordered that Sarah E. Ellis the mother of the minor heirs of S. L. Wright, decd. and now the wife of Joseph J. Smith be and she is hereby appointed and confirmed natural Tutrix to said minors. It is further ordered that Jos. J. Smith be and he is hereby appointed Co-Tutor to said minors. It is further ordered and decreed that [blank] be and he is hereby appointed Under tutor to said minors. Done and signed in office on this the 10th day of February A.D. 1860. Thos. C. Smith do solemnly swear that I will faithfully and impartially perform all the duties incumbent on me as Co tutor to the following minor heirs of the estate of S. L. Wright Decd. to wit: Cornelia Wright, Thos. J. Wright, and Junetta Wright to the best of my abilities and understanding. So help me God. Joseph J. Smith has been duly appointed Co tutor to the following minor heirs of the estate of S. L. Wright Decd. to wit: Cornelia Wright, Thos. J. Wright, and Junetta Wright and he has given bond and good security and taken the oath prescribed by law. Now therefore the said Jos. J. Smith is hereby duly authorised and empowered to discharge all and singular the duties appertaining to said appointment according to law. Smith do solemnly swear that I will faithfully and impartially discharge all the duties incumbent on me as Natural Tutrix to my minor children to wit: Cornelia Wright, Thomas J. C. L. Norman, J. P. Tutorship of the minor heirs of S. L. Wright, Decd. State of Louisiana 12th Judl. Disct. Court Parish of Union Whereas Sarah E. Smith has been duly and legally appointed and confirmed Natural Tutrix to her minor heirs to wit: Cornelia Wright, Thomas J. Wright and Junetta Wright and she has taken and given bond and good security taken the oath prescribed by law. Now therefore the said Sarah E. Smith is hereby duly authorised and empowered to do and perform all the duties appertaining to said appointment according to law. Given under my hand and seal of office on this the 29th day of March 1860. State of Louisiana 12th Judl. Dist. Court Parish of Union Know all men by these presents that we Sarah E. Smith and Joseph J. Smith as principal and S. W. Phillips and Jno. Norsworthy as security are firmly bound unto Robt. W. Richardson Judge of the 12th Judl. Disct. Court in and for the parish and State aforesaid for the time being or to his successors in office in the full and just sum of One thousand dollars the true and faithful payment whereof well and truly to be made we find ourselves our heirs assigns administrators and legal representatives firmly by these presents dated Farmerville La Feb. 2nd 1860. The condition of the adm. Obligations is such that whereas the said Sarah E. Smith has been appointed Tutrix and the said Joseph J. Smith has been appointed co. Tutor to the minor heirs of S. L. Wright Decd. and they have taken the oath prescribed by law. Now therefore if the said Sarah E. Smith and Joseph J. Smith shall faithfully and impartially discharge all the duties incumbent on them as Natural tutrix and Co tutor and shall faithfully account to the Judge of said court for all moneys or property received from this or any other state and shall answer yearly to the Judge of said court a true and faithful account of all their acts and doings in and about said matter of Tutorship and shall faithfully look after the bodies of said minors and study their interest in all things and shall wherever legally required so to do pay over all sums of money and deliver all the property of whatever natural to the said minors or to their legal representatives or to the proper person or persons to receive the same. Then the above obligation to be null and void otherwise and remain in full force and effect against said principals and their said security.
