Spears, Spearsville, Union Parish Louisiana Union Parish, LA Deed Book H pg 352-54 Written Oct 1, 1856 Recorded Feb 3, 1857 ======================================================================================= ======================================================================================= State of Louisiana Parish of Union Know all these presents That I Thomas M. Smith of the parish of Union and State of Louisiana have this day granted sold and conveyed unto William L. Spears also of above parish and state:the following described negroes to wit: Peter aged sixty and his wife Amy aged forty two and their child Cinderella aged nine years John aged twenty four and his wife Chana aged twenty and her three children Susan aged five years Eliza Jane aged two years and John Fredrick aged about four weeks. Jerry aged eighteen, Zack aged sixteen, Mitchell aged twenty-one,Lizetta aged fourteen years and Henrietta aged Twelve. In consideration of the above sale and transfer the said William L. Spears has granted his two several promissory notes one being dated October 31, 1856 and payable fifteenth day of January next for the full sum of Six thousand dollars and bearing interest at the rate of eight percent per annum from date: and one other note for the full sum of Thirty nine hundred dollars bearing the same date as the first not and payable on the first day of March eighteen hundred and fifty eight bearing interest at the rate of eight percent per annum date until paid: both of said notes are considered by the parties to this contract as mortgage notes and are marked on the face of each Oct. 31 October 1856. Now in order to secure the full and punctual payment of the two said promissory notes, the said purchaser herewith obligates himself not to alienate the foregoing described negroes to the prejudice of the vendor but does especially mortgage the same to secure the payment of the note falling due on the fifteenth day of January next; and also of the second note with the citation of the following described negroes who are to be released from this mortgage after the payment of the first note viz: Peter, Amy, Cinderella, Jerry Mitchel and Lizetta, to have and to hold the said negroes with the said purchaser his heirs assigns, to their preferred use and behoof for ever and the said vendor for himself and his heirs the said negroes to the said purchaser his heirs and assigns for ever , shall and will warrant and forever defend against the lawful claims of all persons whomsoever by these ???? . This Done and passed in the parish of Union aforesaid in the presence of Oliver B. Hill and Azariah Gillcoate witnesses of Lawful age and domesticated in the said parish on this thirty first day of October eighteen hundred and fifty six. W.L. Spears T.M. Smith O.B.
