Fitzgerald, Spearsville, Union Parish Louisiana Union Parish, LA Deed Book I, pp. 146-147 Sec. 31 Twp 23 Range 2W Written: November 1, 1858 Recorded: December 6, 1858 ======================================================================================= ======================================================================================= State of Louisiana Parish of Union Know all men by these presents that I William L. Spears of the Parish of Union and State of Louisiana have this day bargained sold and conveyed and by these presents do bargain sell and convey unto Garrett H. Fitzgerald also of the above Parish and State here present and accepting for himself his heirs and assigns two certain parcels or tracts of land with all the improvements thereon Viz: First the Southeast quarter of the Northeast quarter of section No. 31 in Township No. 23 of Range two West - containing Forty acres more or less, Secondly a lot of ground formerly occupied by J. C. Wright as a blacksmith shop and bounded as follows East by Lands now or formerly owned by Hill & Brezel and fronting on the road leading from Farmerville to El Dorado. North by M. Campbell’s lot - West - by the alley leading to the church and Masonic Lodge, and South - by D.M. Jameson’s lot; containing one fourth of an acre more or less. To have and to hold the said lots of ground with the improvements thereon to the said Fitzgerald his heirs and assigns the said Spears does and will warrant and forever defend against the lawful claims of all persons whomsoever by these presents. The above sale and transfer is made for and in consideration of the sum of One Thousand Dollars payable 333 33/100 dollars on the first day of January 1860, 333 33/100 dollars on the first day of January 1861 and 333 34/100 on the first day of January 1862: for the full and prompt payment of the said three several sums. The purchaser has render to the vendor his promissory notes payable as above and dated the day bearing interest at the rate of Eight percent per annum and marked on the face thereof in Red ink “act of November 1, 1858 and to secure the full and prompt payment of the three several promissory notes the said purchaser hereby hypothecates and mortgages the said tract of land with the improvements thereon unto the said William L. Spears his heirs and assigns and further agrees that if either of the notes should not be paid at the time of maturity the above property shall revert back to said Spears and the said Fitzgerald shall pay one hundred and fifty dollars damages and rent. Thus done and passed in the Parish of Union on the first day of November 1858 in presence of Oliver B. Hill and Sidney H. Griffin Witnesses of Lawful age and domiciliated in said Parish of Union.
