Nessmith January 20, 1905 Section 34 Township 2 North Range 5 West Written: January 20, 1905 Recorded: January 25, 1905 Book W pages 543-545 543 State of Louisiana Parish of Vernon Before me Francis M Ingalls a notary Public duly commissioned and sworn within and for the Parish of Vernon State of Louisiana in presence of the witnesses hereinafter named and undersigned Personally came and appeared Thomas J. Nessmith a resident of Rapides Parish La, who declared that he 544 did and do by these presents grant bargain sell assigne convey set over and deliver unto James B McCollough, a resident of Vernon Parish La here present accepting and purchasing for him self his heirs and assigns all and singular the following described property to wit: The South West quarter of the North East quarter SW 4 of NE 4 Section No Thirty four 34, Tp No. Two 2, North Range No Five 5, West Louisiana Meridian in Vernon Parish Louisiana containing 40 acres. To Have and To Hold the said described land unto the said purchaser his heirs and assigns in full property forever, free from any lien mortgage or encumberance whatever with full and general warranty of title and with full subrogation to all the warranty and all other rights as held therein by such Vendors. This sale is made and accepted for an in consideration of the price and sum of Four Hundred (400.00) Dollars payable as follows to wit: $50.00 Cash $100.00, payable Janry 1st 1905, $125.00 January 1st 1906 and $125.00, January 1st 1907, as representing which credit portion said Vendor has made drawn and signed under date of this deed several Three promissory notes made payable at the epochs aforesaid to the order of Thomas J Nessmith conditioned to bear 8 per cent per annum interest from Maturity until paid in full which promissory notes after having been paraphed by Ne Varietur by me said notary in order to identify the same with these presents have been remited to said Thomas J Nessmith who accnowledged due possess- ion and delivery thereof. In case it becomes necessary to necessary resort to legal proceedings for the recovery of the amount of said notes or any part thereof I the said James B McCollough bind and obligate my self to pay the fees of an attorney who may be employed for that purpose which fees are hereby fixed at 10 per cent on the account sued for. And in order to secure more effectually the full and punctual payment of the aforesaid note together with all interest and cost that may accrue on the same according to the terms of said notes and the stipulations herein written, the said purchaser in addition to the Vendors Lien and privilege which is hereby especially returned by said Vendor, declares that he does by these presents specially mortgage and hypothecate the property herein conveyed to the said Vendor binding him self his heirs and assigns not to alienate deteriorate or encumber the same to the prejudice of this mortgage. The said appears agree to dispence with the certificate 545 required by Article 3364 of the Revised Civil Code of this State and exonerate me said Notary from all responsibilities on account of non production of the same. All taxes due upon said property have been paid as evidenced by the Tax receipt exhibited to me said Notary. This Done and Passed at Cora in the Parish of Vernon on this 20 day of January 1905 in the presence of I C Boyd and T E McFarland two competent witnesses who sign these presents with said appears and me said Notary after due reading.
