Dist. holden in and for the Parish of West Carroll, La. P.W. DeFrance vs W. Arch Hedrick, President Board Director West Carroll Publishing Company - Suit 245 The petition of Park Walter DeFrance, a resident of the Parish of West Carroll, La. respectfuly represents that W. Hedrick, President of the Board of Directors of the West Carroll Publishing Company is well and duly indebted to petitioner in the sum of One Hundred & Eight 55/100 ($108.55) dollars for this to wit--Petitioner shows that the "West Carroll Publishing Company", composed of members to wit, A.J. Wyly, David R. Herron, James Imboden, S. Tayler Jackson,Douglas Donnan, William G Buchanan and William A. Hedrick was formed on the 26th July 1881. The said members intered into a contract and chartered themselves into a body corperate under the firm name and style of the West Carroll Publishing Co. for the purpose of publishing a newspaper in the town of Floyd, Parish of West Carroll known as the "West Carroll Watchman", said incorporation taking stock jointly in said company and they bound themselves by their articles of incorporation that said joint Stock Company should be limited to one year that the members there of paid the amount of their subscriptions which was used in the purchase of printing Press type of material for said printing office in order to carry out the objects and purposes of said company, that your Petitioner was employed to assist in the conducting of said Newspaper as general Manager Clerk and editor at a monthly salary of Thirty-five dollars and under said salary, Petitioner was in the employ of said company for some months, that an itemized account showing the amount due Petitioner was made out and approved by the said President of the Board of Directors of said Company, but has been misplace, that Defendants are further indebted to petitioner in the sum of Twenty six & 70/100 dollars and account transfered by S.T. Jackson hereto attached and made part hereof. That subsequently your Petitioner was in the employ of said Publishing Co. for several months at a salary of Twenty Dollars per month and after giving all just and correct credits on the amt due on said salary there is now due Petitioner on said salary eighty-one & 85/100, that an itemized account was rendered to the director & was duly allowed for that amount, but has been misplaced. Petitioner further shows that said West Carroll Publishing Co. has lapsed by effects of time and limit expressed in charter and now no longer exists except for the purpose of setting up its concerns, that belonging to said company in the printing press type, fixtures of Co. and that your petitioner has a lien & privilege on said property for the amount due him by said company and that W.A. Hedrick, President & Chairman of said Publishing Company & S.T. Jackson, Secretary of said company. That a writ of sequestration is necessary to protect and preserve Petitioner rights in the promises. Prays that your Honorable Court make an order, directing & ordering and commanding the Sheriff of West Carroll to sequester and take into his possession the printing press, Type fixtures and company belongings to the West Carroll Publishing Co and to hold the same subject to the further order of your Hon. Court, and to the rights of Petitioner, further pray that the West Carroll Publishing Co. be cited through it President & Secretary of same and in final trial that judgment be rendered in favor of Petitioners and against W.A. Hedrick, President and S.T. Jackson, Secretary of the Board Directors of the West Carroll Publishing Company in the sum of one hundred & eight 55/100 Dollars with 5 per cent interest there-in from 10th of January 1882 till paid, That Petitioner privilege be recognized and rendered Executory on the property sequesterd, that the same be sold according to law and that petitioner be paid by preference out of the proceeds of said sale over all parties whom so ever prays for all such & further orders ncessary and for general relief and costs. C.T. Dunnathy P.W. DeFrance sworn says that the facts and allegations set forth above are true and correct that he has a heir and privilege on the property described and that he prays that the parties Defenndant will conceal part with or dispose of the property in their possession during the pendency of this suit, that a Writ of Sequestion is necessary to protect his right in the premises. Sworn to before me this 15th May 1883 P. W. DeFrance Service accepted on the written petition citation and all legal delays for answering waiver-May 16, 1883 W.H.
