Mercer's Company "A" 6th Regt La Mex War Volunteers, was enrolled on the 22 day of May 1846 at New Orleans for 6 months and is reported: on muster out roll of Co dated Aug 22 1846 at New Orleans, mustered out with Co. that date and place. State of Louisiana County of Winn Appeared on the 19 day of September 1892 before a clerk of 4th Dist Court; Jeremiah D Warner, a resident of Cold Water PO, in the county of Natchitoches who being sworn, deposes that: He is the identical Jeremiah D Warner who served under that name as a private in the company commanded by Captain Harmon Mercer, in the 6th Regiment of La Vols ; commanded by Col. Featherstone, Leut Col Peck, Maj Wellinyche in the war with Mexico; that I enlisted at New Orleans on or about 22 May 1846 for the term of 6 months; and was honorably discharged at New Orleans on the 22 Aug 1846. That being duly enlisted, he served 60 days in Mexico on frontier - was in skirmishes - stood guard. That I am 68 years of age, having been born at Hardeman Co Tenn on the 19 day of June 1824. That I am dependent upon my own labor for support.That I am disabled by reason of age & liver disease. That I am now married; that the maiden name of my wife was Mary Ann Crisup; to whom I was married at Winn Parish on the 17 day of October 1865; that my wife is now dead having died on the --- of October 1878 at Natchitoches Parish; that I have since remarried. That the name of my present wife is Mary Jane Worner (nee Lowery). He submits his age (62) and affidavits of David J Warner & E M Noble as to identity and service. That he made an application for pension, No. 13753. That I am not a pensioner of the US under cert. No. 13753. That since his discharge from service he has resided in Caldwell, Winn and Natchitoches Parishes. He appoints James T Wallace as his attorney. Made his x mark. (Submitter Notes) This ends records reference Jeremiah. He died Dec 18 1904 and records do not note that he ever got a pension. Warner records note that first wife of Jeremiah was Mary Ann Crisup; b. 8/14/1840, mar. 10/17/1865 & d. 10/1878. She was first married to Jacob Langston on 11/27/1856 in Union Parish and had three children. Supposedly, he died in 1865 near Morganza. His second wife was Mary Jane Lowery, married May 1 1882. Remainder of file is transcribed as received. There is a conflict between two alledged widows in filing of widow's pension benefits. Also, his first wife did not die in 1878 as previously sworn and believed. It is uncertain if he ever divorced his first wife. Worner Page 8: (3-038) Claim of Widow for Service Pension under Act of Jan 29,1887 Dated 14 May 1909 - Claim of Mrs. Mary Ann Worner (Note: This brings in Mary Ann Crisup Langston Worner, the first wife of Jeremiah; who, according to his earlier statement of 19 Sept 1892, had died in Oct 1878 prior to his remarriage.) Appears before notary public on 14 May 1909 and states she is widow of Jeremiah D Warner and is age 68. Does not give Mexican War unit details and says that he enlisted at Winnfield (error). Says husband was about 26 years of age, 6 feet in height, blue eyes, dark hair, light complexion, occupation farmer and he was born near Winnfield (error). That after leaving the service he resided near Zion Hill Church, Winn Parish 21 years; near Clear Lake PO, Natchitoches Parish near 12 years. That she was married to him on 27 Oct 1866 at Zion Hill Church by Rev. Rogers. That she had been previously married to Jake Langston who died in 1864. That her said husband (Jeremiah) died near Winnfield on 4 Dec 1904. That she is 68 years of age and was born on 13 Aug 1840 at (??) near New Orleans La on Atchfalaya River. That she has been dependent for support since March 1879 upon relatives and has no income or property. She appoints George T Warner as her attorney. Her post office address is Creston. Made her x mark. Witnesses: James Wells & F R Lattier. Also appeared Francis R Lattier age 49 residing at Clear Lake and Henry F Weaver age 59 residing at Creston la who state they have known her for 37 and 30 years. They signed a witness affidavit. Of Pensions May 28 1909 "Nothing has been found of record to show the death in hospital at Morganza, L, of Jacob Langston, private, Company C, 1st Battalion Louisiana Cavalry Scouts. The medical records show, however, that one Jacob Lancastes, private, Company E 1st Louisiana Cavalry died September 26, 1864 at Morganza, La from chronic diarrhoea. The name Jacob Lancastes; has not been found on the rolls, on file in this office, of Company E, 1st La Cav; on the rolls of the 1st Battalion La Cav Scouts, or on the rolls of any organization from the State of Louisiana in service in the civil war. From the data before it this Dept is unable to determine whether the Jacob Lancastes referred to was or was not identical with Jacob Langston. The charge of desertion of record against Jacob Langston above mentioned has not been removed, and no application for its removal is pending. " date stamp May 29 1909 Pension s/FT (?) Worner alleged widow of Jeremiah D Worner Co A 6 La Vols P.O. Creston Natchitoches Par. La W.O. 18775 Mary J Worner alleged widow of Jeremiah D Worner, same service P.O. Goldonna, Natchitoches Par. La Sir; I have the honor to return the papers with my report in the above entitled claims which were referred for special examination to determine legal widowhood which if either claimant is entitled to recognition as the soldiers widow and investigation as to criminal fractures as requested in the letter from the chief of the law division hereto annexes as Ex B. under date of June 8 1909. The claims were received by me through transfer from the Postmaster at Natchez Miss who had received the same from special examiner Dow McClain. Both of the claimants were served with the required notice and their rights explained. I have given nearly two weeks of time to the investigation of these claims and have not obtained sufficient testimony in this district to establish definitely which if either claimant is the legal widow. The testimony taken shows as to the claimant Mary A Worner that she was married to Jacob Langston, she has furnished, as yet, no definite proof that he is dead, but there is a possibility that if Thomas James can corrobate in a measure the record of the war department so that the death of Jacob Lancastes Sept 26, 1864 at Morganza, La can be accepted as the death of Jacob Langston, then the claimant Mary A was free to marry again. We question is did she contract a ceremonial marriage in the state of Louisiana after the death of the said Jacob Langston; she claims that she did, that the ceremony was performed by a preacher by the name of Rogers and that it took place at Zion Hill settlement in Winn Parish La Oct 12 or 27 1866 and that the soldiers brother George Worner and her two sisters Louisiana Worner and Elmina Terral were witnesses of the said ceremony. The records of Winn parish have been burned and there are no marriage records preserved at a date prior to 1886 so that if the ceremonial marriage can be established by credible and competent witnesse it will tend strongly toward the establishing of the fact of legal widowhood on the part of claimant Mary A, as it is not diaried that Jeremiah D Worner ever had any divorce from her and I have written to the clerk of Natchitoches parish for a copy of any decree there may be at Natchitoches parish La divorce of Jeremiah David Mary A Worner but have received no answer and I personally searched the records of Winn Parish since 1886 and found none at Winnfield La, as regards this ceremonial marriage. I have taken the testimony of the claimants sister Louisiana Worner and she disclaims any knowledge whatsoever of any such marriage. She is a woman of good natural intelligence and said if she could recall any such marriage that she ------ END OF FILE (Note: Above is transcript of entire file. Mary Lowery Warner is buried at the Evergreen Cem. in Natchitoches Parish with other Lowery family members. There are no dates on her marker. )
