TO THE HONORABLE EIGHTH JUDICIAL DISTRICT COURT, FOR WINN PARISH, STATE OF LOUISIANA The petition of Levi E. Drewett, Ira V. Drewett, William U. Drewett, Aaron T. Drewett, Mrs. Mina Griffith (Nee Drewett), Thomas J. Drewett Jr., and Mrs Bennie Mae Hebert (Nee Drewett) with respect represents: That Mrs. S. F. Drewett, mother and grandmother of the above named heirs, died intestate in the Town of Winnfield, Winn Parish, Louisiana, on the 12th day of April 1938, and that the following children were born of said marriage to wit: Levi E. Drewett, Ira V. Drewett, William U. Drewett, Aaron T. Drewett, Thomas J. Drewett, deceased, leaving the following heirs to-wit: Mrs. Mina Griffin (Nee Drewett), Thomas J. Drewett Jr., Mrs. Bennie Mae Hebert (Nee Drewett) That the above named children and grand children constitute the sole and only heirs of the said Mrs S. F. Drewett deceased, and that she left at her death certain real estate worth less than Five Thousand Dollars, which constitutes the property belonging to her succession and petitioners are willing to accept said succession simply and unconditionally; that it owes no debts and petitioners desire to be recognized as her sole and only heirs at law, and as such to be sent into the full possession of said property left by the decedent, and more particularly the following described property, to-wit: Beginning at the South East Corner of Lot No 3 of the 4 acre blocks of the Old Town of Winnfield, Louisiana, as per plot of said blocks, and running West 208.7 feet for a starting point and thence North 104.4 feet, thence West 108.8 feet, the South 104.4 feet and thence East 108.8 feet to starting point, being the property acquired by Mrs. S. F. Drewett as deed recorded book K page 277, less property sold as per deed Book 33 page 619. That the property described in this petition and left by the deceased has born its just proportion of taxation and is wholly exempt and does not owe any inheritance tax, that the value is less than Five Thousand Dollars, but in order to judicially determine this it is necessary that a ruling is issue herein on Bryant Sholars Sheriff of the Parish of Winn Louisiana, to show cause, if any he has, on a day and date to be fixed by this court why petitioners can not be placed in possession of the above described property, in the proportion herein above set forth, with recognition of said ownership without the payment of inheritance tax. WHEREFORE, petition, premises and annexed affidavit considered petitioner prays that they may be recognized and placed in the possession in their capacities and the following proportions, to-wit: Levi E. Drewett, One Fifth interest, Ira V. Drewett, One Fifth interest, William U. Drewett, One Fifth interest, Aaron T. Drewett, One Fifth interest, Mrs. Mina Griffith, One Fifteenth interest, Thomas J. Drewett Jr., One Fifteenth interest, Mrs. Bennie Mae Hebert, One Fifteenth interest, as the sole and only heirs of the deceased Mrs S. F. Drewett and all other property she may died possessed of, and all without the payment of any inheritance tax, and that Bryant Sholars Sheriff & Tax Collector of the Parish of Winn, be ruled to show cause why this should not be done in the manner authorized by law. Drewett, and know of their own knowledge that Mrs. S. F. Drewett was married but once and then to Tillman E. Drewett, with whom she lived until his death, leaving as her sole heirs, viz: Levi E. Drewett, Ira V. Drewett, William U. Drewett, Aaron T. Drewett, Mrs. Mina Griffin, Thomas J. Drewett Jr., Mrs. Bennie Mae Hebert. That Mrs. S. F. Drewett died possessed of property, worth less than Five Thousand Dollars, said property is real estate and has born its just proportions of taxation and is free from the payment of any inheritance tax. Now into court comes Bryant Sholars, Sheriff and Ex-Officio Tax Collector for Winn Parish, Louisiana, and for answer to the petition and rule filed herein by Levi E. Drewett et al., and says as follows: Respondent admits that the property described in the above and foregoing petition has born its just proportion of taxation and is worth less than FIVE THOUSAND DOLLARS, and that he desires to submit the matter to the court to determine by law, as provided in such cases and according to the evidence adduced on the trial thereof Prays for general and equitable relief. Drewett Eighth Judicial District Court, Parish of Winn, State of Louisiana. THIS CAUSE CAME ON REGULARLY FOR A HEARING, on the petition of Levi E. Drewett et al, heirs of Mrs. S. F. Drewett, deceased, to be recognized and placed in possession of the property she died possessed, and the cause having been put at issue by the answer filed herein by Bryant Sholars, Sheriff & Ex-Officio Tax Collector for Winn Parish, and the evidence adduced and the matter submitted to the Court, and the court considering the evidence and the law to be in favor of petitioners for the reasons this day orally assigned by the court: IT IS THEREFORE, ORDERED, ADJUDGED AND DECREED, That petitioners, be and they are hereby authorized as the sole heirs at law of the deceased Mrs S. F. Drewett, and, as such, they are sent into possession purely and simply and unconditionally, and in the following proportions to-wit: Levi E. Drewett, One Fifth interest, Ira V. Drewett, One Fifth interest, William U. Drewett, One Fifth interest, Aaron T. Drewett, One Fifth interest, Mrs. Mina Griffith, One Fifteenth interest, Thomas J. That the above named heirs are placed in the possession of all the property both real and personal left by the deceased, and more particularly the following described real estate, too-wit: Beginning at the Southeast corner of Lot No 3 of the 4 acre blocks of the Old Town of Winnfield, Louisiana, as per plot of said block, and running West 208.7 feet for a starting point. Thence North 104.4 feet ; thence West 108.8 feet, Thence South 104.4 feet and thence East 108.8 feet to starting point, being the property acquired by Mrs S. F. Drewett as per deed recorded Book K page 277, less property sold as per deed Book 33 page 619 conveyance records of Winn Parish, Louisiana. It is further ordered, adjudged and decreed, that petitioners in their said capacities, and in the proportions above set forth, be sent and placed in possession of the above described property, and any and all other property owned by the deceased and without the payment of inheritance tax; the court finding that no inheritance tax is due.
