Williams Spangler To the Honorable Judge of the Fifth Judicial District Court, holding sessions in and for the Parish of Winn, Louisiana: The petition of WILLIAM O. SPANGLER, the duly qualified natural Tutor to the Minors, NETTIE, HENRY DEWEY and ADA Spangler with respect represents: That the said minors, Tremont Lumber Company, Walter Spangler, Mrs. MARY MERCER, Mrs. VINIE WILSON and your petitioner own in common in the proportion of one-twelfth to each of the said minors, and one-twelfth to WALTER SPANGLER, Mrs. MARY MERCER and Mrs. VINIE WILSON each in the following described property, to wit: N ½ of NE ¼ Section 12 less a strip of 10 acres on the West side of said 80; S ½ of SE ¼ Section 17, N ½ of NE ¼ Section 20, all in Township 11, N. R. 1 West, Louisiana Meridian, said property being situated in the Parish of Winn, together with all of the improvements thereon, and appurtenances in any wise belonging thereto. That your petitioner owns a one-half interest in the following described land, to wit: N ½ of NE ¼ Sec. 12 T. 11 N. R. 1 W less a strip of 10 acre on the West side of said eighty and that Tremont Lumber Company owns a one-half interest in all the timber and in the following described land: S ½ of SE ¼ Sec. 17, N ½ N ½ of NE ¼ Sec. 20 T. 11 N. R. 1 West and the said minors and WALTER SPANGLER, Mrs. MARY MERCER and Mrs. VINIE WILSON own a ½ undivided interest in all the above described property both land and timber. Your petitioner further represents that the said WALTER SPANGLER, Mrs. MARY MERCER and others of the co-owners are unwilling to remain and own any longer in indivision with their co-proprietors the property herein described, and desire to affect a partition of said property. That said property is not divisible in kind, and that a sale hereof is necessary to effect said partition. Partition shows that A. R. EARLY has offered to purchase the entire property for the sum of Two Thousand and Sixty ($2060) Dollars, which is One Hundred Seventy-one and 66-2/3/100 ($171.66-2/3) Dollars for the interest of each of the said minors. Petitioner believes that the acceptance of said offer would be advantageous to the interest of the said minors. But petitioner further represents that it is necessary that a family meeting in behalf of the above named minors be convened to deliberate upon the subject matter of this petition, and to advise whether it is to the interest and advantage of the said minors that the said property be sold at private sale for the purpose of effecting a partition, and to appraise the said property and fix the terms and conditions of the sale and determine whether or not the offer of A. R. EARLY to give Two Thousand and Sixty ($2060) Dollars for the property should be accepted in so far as the minors are interested; said family meeting to be composed of the following named persons, to wit: J. W. CURRY, J. W. E. CURRY, J. C. STRICKLAND, J. G. COOPER and G. B. SPANGLER all relations and friends within the circle prescribed by law, and that J. H. KEEN, under-tutor to said minors, be notified to attend said family meeting. Petitioner prays for general and equitable relief. MOSS a Notary Public, duly commissioned and qualified in and for the Parish of Winn, State of Louisiana, convoked a family meeting of the friends and relatives of the minor heirs of Mrs. Spangler, deceased to wit: NETTIE, HENRY DEWEY and ADA SPANGLER to deliberate upon the interests of said minors, said meeting composed of J. C. STRICKLAND, J. W. CURRY, J. W. E. CURRY, G. B. SPANGLER and J. G. COOPER, and in the presence of attesting witnesses, all of said parish. Having administered the oath, I explained to the members of the object of the meeting, when after due consultation and deliberation the said family meeting advises and recommends as follows: That the said property described in plaintiffs petition be sold at private sale for the purpose of effecting a partition and that the offer of A. R. EARLY to pay ($2060) Two Thousand and sixty Dollars cash for the whole property be accepted and that WILLIAM O. SPANGLER, Tutor to the said minors, be and he is hereby authorized to make a deed to the 1/12 interest owned by each of the said minors and to receive for the said minors their respective interest of the sale price which is ($171.66 2/3) one hundred seventy-one and ½ dollars each. The said property hereby authorized to be sold is the following: N ½ of NE ¼ Sec. 12 less a strip of 10 acres off of the West side of said eighty S ½ of SE ¼, N ½ of NE ¼ Sec. 20 all in Tp. 11 N. R. 1 West La. Meridian together with all improvements thereon or appurtenances in any wife belonging thereto. The Under tutor of said minors being present, signs and approves these proceeds. A. MOSS, a notary public, on the 13th day of September, 1911; that as will appear from the said process verbal, the family meeting has recommended that for the purpose of effecting a partition between the said minors and their co-owners the property described in said process verbal be sold at private sale for not less than Two Thousand and Sixty ($2060) Dollars, and that the offer of A. R. EARLY to pay Two Thousand and Sixty ($2060) Dollars, cash, for the whole property, which represents One Hundred and Seventy-one and 66-2/3/100 ($171.66-2/3) Dollars for the interest of each of the said minors be accepted in far as the minors; and that said deliberations and recommendations have been approved by the under-tutor. WHEREFORE, petitioner prays that the said deliberations be approved and homologated, and that he be authorized to effect said sale, and to make and execute deed to the interests of the minors in said property.
