In the Name of God Amen this second day of July in the year of our Lord Christ one Thousand seven hundred and Fifty Four I Robert Fitts of Sutton in the County of Worcester and Province of the Massachusetts Bay in new England. Husbandman being very Sick and weake in Body but of perfect mind & memory Thanks be given to God therefore calling unto mind the mortality of my Body and Knowing that it is appointed for all men once to dy do make and ordain this my Last Will & Testament That is to say principally and first of all I give and Recommend my Soul unto the Hand of God that gave it and for my Body I Recommend it to the Earth to be buried in a Christian Like and decent manner at the Discretion of my Executors nothing Doubting but at the General Resurrection I shall receive the same again by the mighty Power of God and as Touching such worldly Estate as it hath pleased God to bless me with in this Life I Give devise and dispose of the same in the following form and manner. Imprimie it is my will and I do order Jonathan Fitts of Sutton in the County of Worcester and Province above and yeoman of my Loving & Trusty Brother whom I constitute appoint and ordain my only and sole Executor of this my Last Will and Testament to make sale of all my Lands and Buildings and all my other Estate both real and personal whatsoever That I am (___?___) and possessed of Excepting my household Furniture I dispose as hereafter contained & I order my said Executor to collect & receive all my just dues and I order my said Executor to pay and Satisfie all my just debts and funeral charges out of my Estate and after my Debts and funeral charges be paid and satisfied I order my said Executor to Let out all the Money Remaining of my Estate on Lawfull Interest so to pay said money and Interest as of that order herein and after Contained. Item: I give and bequeath unto Keziah my Dearly beloved wife all my Household Stuff and Furniture of all sorts which is for Household use and Jerone (?) and the Pillion for her to Ride on to her & her Heirs forever and I give to my said wife one Third part of the Interest of the money that shall be due on the money my Estate shall sell for after my debts shall be paid of all sorts, to be paid to her yearly by my said Executor so long as she remains my widow. Item: I give to my son Robert Fitts sum Fourteen pounds Lawfull money to be paid by my Executor when he comes to the age of Twenty one years. Item: I Give unto my son Samuel Fitts Fourteen pounds Lawfull money to be paid by my Executor when he comes to the age of Twenty one years. Item: I Give unto my son John Fitts fourteen pounds Lawfull money to be paid by my Executor when my said son is Twenty one years of age. Item: I Give unto my daughter Keziah Fitts Five pounds Lawfull money out of my Estate paid by Executor when she is Twenty one years of age. Item: I Give unto my daughter Hannah Fitts Five pounds Lawfull money when she is Twenty one years out of my Estate to be paid by my Executor. Item: I Give unto my daughter Margaret Fitts Five pounds of Lawfull money out of my Estate to be paid by Executor when she comes to the age of Twenty one years. Item: I Give unto my daughter Ruth Fitts Five pounds Lawfull money to be paid out of my Estate by my Executor when she is Twenty one years of age. Item: I Give unto my daughter Lucy Fitts Five pounds Lawfull money to be paid out of my Estate by my Executor when she is Twenty one years old. Item: I Give unto my daughter Phebe Fitts Five pounds Lawfull money to be paid out of my Estate by my Executor when she comes to the age of Twenty one but if any of my daughters abovesaid should marry before they are Twenty one year old, Then that Daughter shall have their portion at their marriage paid by my Executor the same him abovesaid. And if any of my Children should not live while they are of age to receive their Portion then their part shall be Divided among the Rest of the Children Each son to have as much as Two Daughters when they are all of age and all & every part of my Estate that shall be Left and Remaining after all my Children have had their Proportion out of my Estate That is willed to them and my Widow had all paid her that is given in the Will aforesaid then the said remaining Estate to be divided among all my Children and their Heirs – Each son to have as much as Two Daughters as above said. And I do hereby utterly disallow, revoke & disannul all and every other former Testament Wills Legaceys and Executor by me Willed and bequeathed Ratifying and Confirming this and no others to be my Last Will and Testament – In Witness whereof I the said Robert Fitts have hereunto set my Hand and seal the Day and year above written. Robert Fitts (ss) Signed Sealed Published pronounced and declared by the said Robert Fitts as his Last Will and Testament in the Presence of us the subscribers John Fry Daniel Dike Isaac Easty Furthermore I the said Robert Fitts in addition to this will above do ordain my abovesaid Brother Jona Fits my said Executor to be Guardian and Trusty to bind out and order and dispose of all my Children while under age together with my loving wife Keziah Fitts whom I appoint and ordain to take care of all my children abovesaid and bind out as they the said Jona Fitts and Keziah Fitts shall think proper and I further order that all my children under the age of seven years shall be maintained out of my Estate before any division be made among any children that is they shall be maintained out of the interest of my estate while they are each seven years old and no longer then bound out as said Guardian may think proper.
