All rights reserved. http://www.usgwarchives.net/copyright.htm http://www.usgwarchives.net/md/mdfiles.htm ************************************************ File contributed for use in USGenWeb Archives by: Susan King susanking@carolina.rr.com April 19, 2005, 3:50 pm "Piny Spring" Written: December 19, 1842 Recorded: May 12, 1843 At the request of John Ruby & others the following Deed was recorded May 12th 1843 This Indenture made this nineteenth day of December in the year of our Lord Eighteen hundred and forty two, Between, Daniel Crabtree and Maria Crabtree his wife of Maryland of the one part, and John Ruby James Ruby, Christopher Waggoner Hugh Nixon and Samuel Waggoner, Trustees in Trust for the uses and purposes herein after Mentioned all of the County and State aforesaid of the other part Witnesseth, that the Said Daniel Crabtree and Maria Crabtree his wife for and in Consideration of the Sum of Two Dollars __pecia [?] to them in hand paid at and upon the Sealing & delivery of these presents the receipt whereof is hereby acknowledged have given granted bargained and Sold released confirmed and conveyed and by these presents do give, grant, bargained, sell, release Confirm and Convey unto them the said John Ruby James Ruby Christopher Waggoner Hugh Nixon Samuel Waggoner, and their Successors, Trustees in trust for the uses & purposes hereinafter Mentioned and declared all the estate, right, title interest Claim and demand whatsoever either in Law or in equity which they the Said Daniel Crabtree and Maria his wife, here into or upon, all and Singular a certain Lot of Land Situate lying and being in the County and State aforesaid, bounded and butted as follows, To wit, Beginning for the Same at a bounded white oak Sapling Marked with Twelve Notches standing on a Tract of Land named “Piny Spring” taken up long ago by one Seth Evans and two perches from a bounded Spanish Oak __ corner of “Piny Spring”, & running thence South Twenty degrees, West ten perches to a Stone South Seventy degrees East eight perches to a Stone North Twenty degrees East ten perches to a Stone then by a Straight line to the Beginning, Containing one half acre of Land more or less- Together with all and Singular the woods waters ways priviledges [sic] and appurtenances thereunto belonging unto them the Said John Ruby James Ruby Christopher Waggoner Hugh Nixon and Samuel Waggoner and their Successors in Office forever in trust that they Shall erect & build or cause to be erected and built thereon a house or place of Worship for the use of the Members of the “Methodist Episcopal Church” in Allegany County aforesaid in the State of Maryland in the United States of America whose Capitol is the City of Washington in the District of Columbia according to the rules and discipline which from time to time may be agreed upon and adapted by the Ministers and preachers of the Said Church at their General Conference in the United States of America as aforesaid; And in further Trust and Confidence that they Shall at all times forever hereafter permit such ministers and preachers belonging to the Said Church as Shall from time to time be duly authorized by the General Conferences of the Ministers and preachers of the Said “Methodist Episcopal Church” or by the Annual Conferences authorized by the General Conferences to preach and and expound the God’s Holy word therein and in further Trust and Confidence that as often as one or none or the Trustees herein before Mentioned Shall die or cease to be a member or members of the Said Church according To the rules and discipline as aforesaid there it Shall be the duty of the Stationed Minister or preacher authorized as aforesaid who Shall have the pastoral Charge of the members of the Said Church call a Meeting of the remaining Trustees as Soon as conveniently may be and when so met the Said Minister or preacher Shall proceed to nominate one or more persons to fill the place or places of him as them whose office or offices has or have been vacated as aforesaid – Provided the person or persons so nominated to fill Shall have been one year a member or members of the Said Church immediately preceding Such Nomination and to be at least twenty one years of age, and the Said Trustees So assembled Shall proceed to elect and by majority of votes appoint the person or persons So nominated to fill Such vacancy or vacancies in order to keep up the number of five Trustees forever; and in case of equal number of votes for and against the Said nomination, the Stationed minister or preacher Shall have the Casting vote, Provided nevertheless that of the Said Trustees or any of them or their Successors have advanced Shall advance any Sum or Sums of Money or ___ or Shall be responsible for any Sum or Sums of Money or account of the Said premises and they the Said Trustees or their Successors be obliged to pay the said Sums of money or a majority of these shall be authorized ____ the Said Sum or Sums of Money by a Mortgage on the Said premises only Selling the Said premises after given to the Said pastor or preacher who has the oversight of the Congregation attending divine (worship) Services on the Said premises if the money due be not paid to the Trustees or their Successors within one year after ____ notice given: and if such sale take place the Said Trustees or their Successors after paying the debt and other expenses which are due from the money arising from such sale, Shall deposit the remainder of the money produced by the said Sale, in the hands of the Steward or Stewards of the Society belonging to or attending divine Service on Said premises, which Surplus of the pro___ of such sale so deposited in the hands of said Steward or Stewards shall be at the disposal of the next annual Conference authorized as aforesaid which said annual Conference shall dispose of the said money according to the best of their Judgment for the use of the Said Society. And the Said Daniel Crabtree and Maria his wife do by these presents warrant and forever defend all and Singular the before mentioned and described Lot or piece of Land with the appurtenances thereto belonging unto them the Said John Ruby James Ruby Christopher Waggoner Hugh Nixon and Samuel Waggoner Trustees as aforesaid and their Successors chosen and appointed as aforesaid from the claim or claims of them the Said Daniel Crabtree and Maria his wife their heirs and assigns and from the claim or claims of all persons whatsoever In Testimony whereof the Said Daniel Crabtree and Maria his wife have hereto Set their hands and Seals the day and year aforesaid- Signed Sealed & delivered In the presence of us- Jno. Mountz Maria Crabtree State of Maryland Allegany County, To wit Be it remembered, that in this Nineteenth day of December in the year of our Lord Eighteen hundred and forty two, personally appeared before us two of the Justices of the peace in and for Allegany County in the State of Maryland the within named Daniel Crabtree and Maria his wife and acknowledged the within deed of Trust to be their act and deed for the uses and purposes therein mentioned and declared. And She the Said Maria wife of the Said Daniel Crabtree being Seperate [sic] and apart from her Said husband by examined declared She had made the Same acknowledgment freely and with her own Consent without being induced thereto through fear or threats of her Said husband – In Testimony we have hereunto Set our hand and Seals the day and year first above written.
