This Indenture made this fourth day of November in the year of our Lord one thousand Eight hundred and forty Between Daniel Crabtree and Maria Crabtree his wife of Allegany County in the State of Maryland of the one part and James Crabtree Christopher Waggoner, John Ruby, James Ruby Thos. R.C. Martin Abel T. Crabtree and Hugh Nixon Trustees Entrust for the uses and purposes herein after mentioned all of the county of Allegany in the State of Maryland aforesaid of the other part witnesseth that the Said Daniel Crabtree and Maria Crabtree his wife for and in consideration of the Sum of two dollars Specic[?] to them in hand paid at and upon the Sealing and delivery of these presents their receipt whereof is hereby acknowledged have given granted bargained Sold released confirmed and conveyed and by these presents do grant bargain Sell release confirm and convey unto the Said James Crabtree Christopher Waggoner John Ruby James Ruby Thos. R.C. Martin Abel T. Crabtree and Hugh Nixon and their Successors trustees in trust for the uses and purposes herein after mentioned and described all the Estate right title interest property Claim and whatsoever either in Law or equity which they the Said Daniel Crabtree and Maria Crabtree his wife have in to and upon all and Singular a certain lot or piece of land Situate and lying & being in Allegany County and State of Maryland aforesaid being part of a tract of land called “Chance” bounded & butted as follows to wit Beginning for the Same at a bounded pine Sapling and a Stone just below the road leading from Old town to Daniel Crabtrees house and running thence about North eighteen Degrees East Eight perches to a Stone in the borders of an old field not inclosed [sic] then about South Seventy two degrees East ten perches to a Stone in Said Daniel Crabtree orchard field then about South eighteen degrees West eight perches to a Stone in the Same orchard field and then by a Straight line to the beginning containing and laid out for half an acre of land together with all and Singular the houses woods waters ways priviledges [sic] and appurtenances thereto belonging or in anywise appertaining To have and to hold all and Singular the above mentioned and described lot or parcel of land Situate lying and being as aforesaid together with all and Singular houses woods waters ways and priviledges [sic] thereto belonging or in anywise appertaining unto them the Said James Crabtree Christopher Waggoner John Ruby James Ruby Thos. R.C. Martin Abel T. Crabtree and Hugh Nixon and their Successors in office forever in trust that they Shall erect and build or cause to be erected and built thereon a house or place of worship for the use of the members of the Methodist Episcopal church in Allegany County in the State of Maryland in the United States of America capitol of which United States is the city of Washington in the district of Columbia according to the rules and discipline which from time to time may be agreed upon and adopted by the ministers and preachers of the Said church of their general confrences [sic] in the United States of America aforesaid and in further trust and confidence that they Shall at all times forever hereafter permit Such ministers and preachers belonging to their Said Church as Shall from time to time be duly authorized by the general Conferances [sic] of the ministers and preachers of the Said Methodist Episcopal Church or by the annual confrences [sic] authorized by the Said general Confrence [sic] to preach and expound Gods holy word therein and in further trust and confidence that as any one or more of the trustees herein before mentioned Shall die or cease to be a member or members of the Said Church according to the rules and discipline as aforesaid then and in Such case it Shall be the duty of the Stationed minister or preacher (authorized as aforesaid) who Shall have the ____ __ as charge of the members of the Said Church to call a meeting of the remaining trustees as soon as conveniently may be and when So met the Said minister or preacher shall proceed to nominate one or more persons to fill the place or places of him or them whose office or offices has or have been vacated as aforesaid provided the person or person So nominated Shall have been one year a member or members of the Said Church immediately preceding Such nomination and be at least twenty one years of Age and the Said Trustees So Assembled Shall proceed to Elect and by a majority of votes appoint the person or persons So nominated to fill Such vacancy or vacancies in order to keep up the number of five seven or nine trustees forever and in case of an Equal number of votes for and against the Said nomination the Stationed minister or preacher Shall have the casting vote advanced or Shall advance any Sum or Sums of money or are or Shall be responsible for any Sum or Sums on account of the Said premises and they the Said trustees or their Successors be obliged to pay the Said Sums of money they or a majority of them Shall be authorized to raise the Said Sum or Sums of money by a mortgage on the Said premises or by Selling the Said premises after notice given to the pastor or preacher who has the oversight of the congregation attending divine Services on the Said premises if the be not paid as the Said trustees or their Successors within one year after Such notice given and if Such Sale take place the Said trustees or their Successors after paying the debt and other expenses which are due from the money arising from Such Sale Shall deposit the remainder of the money produced by the Said Sale in the hand of the Steward or Stewards of the Society belonging to or attending divine Services on Said premises which Surplus of the produce of Such Sale So deposited in the hands of the Said Steward or Stewarts [sic] Shall be at the disposal of the next annual confrences [sic] authorized as aforesaid which Said annual confrences [sic] Shall dispose of the Said money according to the best of their judgment for the use of the Said Society And the Said Daniel Crabtree and Maria Crabtree his wife do by these presents warrant and forever defend all and Singular the before mentioned and described lot or parcel of land with the appurtenances thereunto belonging unto them the Said James Crabtree Christopher Waggoner John Ruby James Ruby Thos. R.C. Martin Abel T. Crabtree and Hugh Nixon and their Successors chosen and appointed as aforesaid from the claim or claims of them the Said Daniel Crabtree and Maria Crabtree his wife their heirs and assigns and from the claim or claims of all persons whatsoever In testimony whereof Said Daniel Crabtree and Maria Crabtree his wife have hereto Set their hands and Seals this day and year aforesaid NB the year was altered to 1840 before execution Signed Sealed and delivered In presence of us Daniel Crabtree Lenox Martin Maria Crabtree John Hartley Received the day of the date of the above written Indenture the consideration therein mentioned in full Witness Lenox Martin Daniel Crabtree John Hartley Maria Crabtree State of Maryland Allegany County to wit Be it remembered that on this fourth day of November in the year of our lord one thousand eight hundred and forty personally appeared before us two of the justices of the peace in and for the county and State aforesaid the within named Daniel Crabtree and Maria Crabtree his wife the grantors and acknowledged the within deed of trust to be their act and deed for the uses and purposes therein mentioned declared and the Said Maria Crabtree wife of the Said Daniel Crabtree being Separate and apart from her Said husband by us examined declared that She had made the Same acknowledgement freely and with her own consent without being induced thereto through fear or threats of her said husband In testimony whereof we hereunto Se out hands and Seals the day and year first above written John Hartley Lenox Martin Additional Comments: Book BB, Page 305 Deed of Trust Record from Allegany Co.
