Liber O Folio 329 Recorded: 19 Feb 1829 At the request of John Fikes Junr 19 Feb 1829 At the request of John Fikes Jr. the following deed was recorded February 19, 1829. This indenture was made this thirteenth day of January in the year of Our Lord One thousand eight hundred and twenty nine between Christian Musser, John Musser, Nicholas Musser John Winan and Adam Deetz of Allegany County in the state of Maryland of the first part and John Fikes Jr. of the same county and state of the other part. Witnesseth: that the said Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz for and in consideration of the sum of six hundred and sixty six dollars and sixty six cents to them in hand paid by the said John Fikes Jr find the reciept whereof is hereby acknowledged haith granted bargained and sold and by this presents doth give grant bargain sell makeover?? and confirm unto him the said John Fike Junr his heirs and assigns forever the following tracts or parcels of land a tract called Rich Hill being the (word crossed out) settlers lots which was patented to John Simkins on the fifth of April one thousand seven hundred and ninety five and from him conveyed to John Baker and the said Baker conveyed the same to Nicholas Musser on the eleventh of April Eighten Hundred and ?? the lots known and distinguished by numbers twenty seven hundred ninety three twenty seven hundred ninety four twenty seven hundred five originally laid out for fifty acres each and beginning for the same at a (------) or bounded stake Standing West eighty perches from a bounded Chesnut it being the Original Bounary of lot twenty seven hundred and ninety and also the boundary of Rich Hill of which the lots are part and running thence East?? eighty perches and north one hundred perches West eighty perches South Two Hundred perches East one hundred and sixty perches thereby a straight line to the Beginning containing one hundred fifty acres . Also all or part of a tract of land called Rich Hill granted to John Simpkins by patent bearing date of the fifth day of April seventeen hundred and ninety (?) and by him conveyed to Nicholas Musser on this ninth of April in the year of our Lord one thousand eight hundred and four it being one of five lots awarded as settlers lots of the lands westward of Fort Cumberland known and distinguished by the number two thousand seven hundred and ninety two situate lying and being in Allegany County Maryland. Beginning for said lot at a White Oaks Stump Standing ______ ___hundred and sixty perches from a bounded Chestnut tree standing in the land below Benjamin Coddingtons and Stephan Pearson it being the beginning ______ of Rich Hill of which lot number two thousand seven hundred and ninety two is part and running ____ East Eighty perches _______North and one hundred perches West eighty perches then by a straight line to the beginning containing fifty acres of land more or less together with the buildings and a __________ and all and singular other________ hereby bargained and sold or meant mentioned or intended hereby so as to be and every part and parcel thereof with their and every part of their___________ who this said John Fike Jr. his Heirs and assigns forever and to and for no other use intent or purpose whatsoever and the said Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz for themselves, their heirs, Executors, and Administrators doth hereby convey grant promise and agree to and with the said John Fike Junr his heirs and executors, Administrators or assigns that the said Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz and their heirs the said tracts and parcels of land and premises thereby granted bargained and sold and every part and parcel thereof with the _________ to belonging to him the said John Fike Jr. his heirs and assigns against which the said Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz and their heirs and against all and every person or persons whatsoever claiming Right or Title or interest to the land or any part thereof shall and will hereafter warrent and forever defer their Responsive Rights which is the one sixth of the lands and premises mentioned in the within deed in _______ whereas the said Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz hath herewithin subscribed their names and affixed their seals this day and year just therein before written signed sealed and delivered in the presence of Peter McClay Jacob Claimmer Signed: Christian Musser John Musser Nicholas Musser (his mark) John Winan Adam Deetz (his mark) Maryland, Allegany County to wit On this thirteen day of January in the year of Or Lord Eighteen hundred and twenty nine personally appears Christian Musser John Musser Nicholas Musser John Winan and Adam Deetz of Allegany County being the party grantor in the within, named before us the subscribed two Justices of the Peace and acknowledges the (his) written deed or instrument of writing to be their act and deed and the lands and premises therein mentioned and thereby bargained and sold to be the right and estate of the within named John Fike Jr party grantee. Also therein named, his heirs and assigns forever according to the expressed purport true intent and meaning of the said Deed of instrument of writing and the Acts of______ in such case made and provided and now at the same time also personally appeared Ann(?) Musser, wife of Christian Musser, Susan C Musser, wife of John Musser, Eliza Musser, wife of Nicholas Musser, Medley(?) Winan, wife of John Winan and Elizabeth Deetz, wife of Adam Deetz before us two Justices of the Peace as aforementioned and acknowledges the said deed or instrument of writing to be their own acts and deeds and the lands therein mentioned to be the right and Estate of the within named John Fike his heirs and assigns foreever, and the said Ann Musser, Susan C Musser, Eliza Musser, Medley(?) Winan and Elizabeth Deetz being by us apart from and out of the hearing of their husbands whether they do make their acknowledgements of the same willingly and freely and without their being induced thereto by fear or threats by their husbands or fear of their displeasure, acknowledge they do make their acknowledgement of the same willingly and freely.
