This Indenture made this twenty fifth day of May in the year Eighteen Hundred and fourteen Between Michael Kershner of the Town of Cumberland Allegany County and State of Maryland of the one part and Samuel Thomas of the same Town, County and State of the other part. Witneseth that the same Michael Keshner for and in consideration of the Sum of One thousand Dollars Current money to him paid at and upon the Sealing and Delivery of these presents the receipt whereof is hereby Acknowledged hath granted, Bargained and Sold and by these presents, doth grant, bargain and Sell, unto the Said Samuel Thomas his heirs and assigns all that piece or parcel of Land Situate lying and being in the Town of Cumberland, County and State aforesaid, which said Piece or parcel of Land and premises as known and Distinguished, on the plat of the Town of Cumberland by Lot Number thirty one as by reference thereto being had to the Land records of the County aforesaid, will more fully and at Large appear together, with all and Singular the Buildings and improvements rights, priviledges, Hereditaments and Appurtenances, to the same belonging or in any wise appertaining and all the Estate right title and Interest both at Law and in Equity of him the said Michael Kerhner, of into and out of the aforementioned, Lot and premises, hereby Bargained and Sold or intended hereby So to be and every part and parcel thereof To Have and To Hold the before mentioned and Discribed piece or parcel of Land and premises Known and Distinguished on the plat of the Town of Cumberland, by Lot Number thirty one, situate Lying and being in the County and State aforesaid together with the Buildings and appuenances and all and Singular other the premises hereby bargained and sold, or intended hereby so to be, and every part and parcel thereof with their and every of their appurtenances, unto the said Samuel Thomas, his heirs and assigns forever, to the only proper use behoof, of him the said Samuel Thomas and to and for no other use intent or purpose whatever - Saving and Reserving Nevertheless to Thomas Beall of Samuel his hears and Assigns One Spanished Milled Dollar as an annual ground rent on the Lot aforesaid to be paid to the said Thomas Beall of Samuel his Heirs or assigns on the first day of January forever hereafter, And the Said Michael Kershner for himself, his Heirs, Executers and Administrators, doth hereby covenant, promise and agree to and with the Said Samuel Thomas his heirs, Executors and Administrators and Assigns that he the Said Michael Kershner and his Heirs the said piece and parcel of land and premises hereby granted, Bargained and Sold and every part and Parcel thereof with the Appurtenances, thereunto belonging to him the said Samuel Thomas his Heirs and assigns, Against him the Said Michael Kershner and his Heirs, and against all and every person claiming or claim any right, title or interest in or to the same or any part thereof, Shall and will hereafter warrant and forever defend by these presents, In Witness whereof the said Michael Kershner hath to these presents, Set his hand and affixed his Seal the day and year first herein before written. Signed, Sealed and Delivered in th presence of us, Michael Kershner (seal) John Scott, Geo. Hoffman Maryland, Allegany County to wit Be it remembered that on this, twenty fifth day of May in the year Eighteen hundred and fourteen, pesonally appeared Michael Kershner, party, Grantor, named in the within Deed before us the Subscribed two Justices of the peace of the State of Maryland in and for Allegany County, and Acknowledged the within Deed or instrument of writing, to be his Act and Deed and that Lot and premises therein mentioned and thereby bargained and Sold, to be the right and Estate if the within named Samuel Thomas, party, Grantee, also therein mentioned, his Heirs nd Assigns forever according to the purport, true intent, and meaning of the Same and the Act of Assembly in such cases made and provided, And know at the same time appears Anna Maria Kershner wife of the aforementioned Michael Keshner befoe us teh Subscribed Justices as aforesaid and aknowledges the Said Deed or insrument of writing to be her title and Deed and the Lot and premises therein mentioned to be the right and Estate of the within named Samuel Thomas his Heirs and assigns forever And the said Anna Maria Kershner being by us privately examined apart from and out of hearing of her husband Whether she doth make her acknowledgement of the Same willingley and freely and without being induced thereto by fear or threat of or ill usage by her husband or fear of his Displeasure.
