THIS DEED made this 3rd day of July 1801 between Phillip Barton Key of the city of Annapolis of the one part and Susannah Gardner Bruce of the county of Frederick and State of Maryland of the other part. WITNESSETH that the said Philip Barton Key for and in consideration of the sum of $100 to him in hand paid, the receipt whereof is hereby acknowledged and in order to do away with the Trust _____ in him, the said Philip having held the said land herein about to be conveyed in trust for said Susannah, hath given, granted, bargained, sold, aliened, enfeoffed, conveyed and confirmed and by these presents doth give, grant, bargain, sell, alien, enfeoff, convey and confirm unto the said Susannah Gardner Bruce, her heirs and assigns forever, all that tract or parcel of land called WALNUT LEVEL now laying in Allegany County and patented when laying in Frederick County to John Ross, Esq. on the 10th of Aug, 1753, as will appear on references thereto. Beginning for the outlines of the said hereby intended to be conveyed at a bounded Black Oak standing on the head of a branch of Wills Creek about a mile from Nehemiah Collin's Road and running thence west 380 perches, North 10º west 320 perches South 60º east 280 perches South 50º east 100 perches then by a straight line to the Beginning tree containing 390 acres of land more or less Together with the advantages and appurtenances to the same belonging or in any wise appertaining and all the estate, right, title, interest in property and demand of the said Philip Barton Key in law and in equity with the rights, members and appurtenances to the same. TO HAVE AND TO HOLD the said tract or parcel of land and premises with the rights members and appurtenances to the said Susannah Gardener Bruce her heirs and assigns forever to the only proper use and behoof of her the said Susannah her heirs and assigns and no other intent or purpose whatsoever. And the said Philip Barton Key doth hereby for himself and his heirs covenant, promise, grant and agree to and with the said Susannah Gardener Bruce, her heirs and assigns to warrant and defend to her and them the land above mentioned to be granted against the said Philip Barton Key and his heirs and all persons claiming or to claim under him or them. IN WITNESSETH whereof I have hereinto set my hand and affixed my seal the day and year first above written. Signed, Sealed and Delivered in Presence of: Jeremiah Townley Chase. On the back was thus endorsed to wit: State of Maryland to wit: On the 3rd day of July 1801 came Philip Barton Key, the grantor within named before the subscriber one of the Judges of the General Court for the state aforesaid and acknowledged the within instrument of writing to be his act and deed and the land and premises therein mentioned to be the right and Estate of Susanah Gardner Bruce, her heirs and assigns forever. At the same time came Anna, wife to the said Philip and being examined by me privately and apart and out of the hearing of her said husband, relinguished her right of Dower of in and to the premises within mentioned unto Susannah Gardener Bruce and declared she did the same freely and voluntarily not being induced thereto through threats or from fear of incurring the displeasure of her said husband.
