Examined and delivered to Samuel L. Wagoner August 5th 1851 At the request of Christopher Wagoner the following Deed was recorded December 28th ____ This Indenture made this seventeenth day of December in the year of our Lord one thousand eight hundred & fifty between Griffin Twigg Senr & Elizabeth Twigg his wife of the one part and Christopher R. Wagoner of the other part, all of Allegany County and State of Maryland. Witnesseth that the said Griffin Twigg Senr & Elizabeth his wife for and in consideration of the sum of one thousand & fifty dollars, and all his the said Cristopher R. Wagoner and his wifes interest in The Land purchased from Lenox Martin Esq. by Cristopher Wagoner Senr deceased, whereon the said Cristopher Wagoner deceased resided up to the time of his decease as also his interest together with his wife’s in the Land lying west of Old Town, and nearly adjoining Tracy’s Land, and commonly known & designated as Frog Hollow, in hand paid and conveyed by the said Cristopher Wagoner and his wife to the said Griffin Twigg & Elizabeth his wife, at & before the Sealing and delivery of these presents the receipt of which the said first named parties do hereby acknowledge the said first named parties ____ bargained and sold, aliened & enfeoffed, and by these presents doth give grant, bargain & sell, alien, enfeoff, release convey and confirm unto the said Cristopher R. Wagoner his heirs and assigns, all their right title, claim & demand, both in law & equity, of into the following tract of Land called “Noon Tide” beginning for the outlines of the whole at a marked Hickory, a red oak & chesnut [sic] oak bushes standing at the end of the first line, it being also at the end of the eighth line of a tract of land called “Chance” surveyed for Thomas Gasaway, the twenty ninth day of May seventeen hundred & seventy two, they being also the beginning of “Eleventh Hour”, the original & running thence, with the first line thereof, South thirty four and one half degrees East seventeen perches, to a bounded pine, then leaving the original South thirty five degrees East fourteen perches, North twenty three degrees, East one hundred & four perches, to a white oak marked with two notches, North eleven degrees, West twenty eight perches, to a chesnut [sic] oak marked with three notches North forty six degrees East seventy two perches to a Chesnut [sic] oak marked with four notches North thirty four degrees West thirty eight perches to a white oak marked with for five notches. North forty nine degrees. West one hundred & fourteen perches to a white Oak marked with six notches, South sixty seven degrees. West one hundred & sixty eight perches South eighty six degrees, West eighty five perches to a pine marked with seven notches. South twenty five degrees West one hundred & ten perches, South seventy five and one half degrees East sixty one perches North sixty eight degrees East forty six perches North thirty six & one half degrees East eighteen perches to a white oak marked with nine notches, North sixty six degrees East fifty nine perches to a bounded hickory tree, the beginning of (__wick) surveyed for Lewis Crabtree In the twenty sixth day of November eighteen hundred & thirty two, it being also at the of the eleventh line of “Eleventh Hour” the original and running with the lines thereof South fifty degrees East ninety six perches. South sixteen degrees West one hundred and ninety seven & one half perches. South twenty three degrees East forty one perches, to a white oak bush and a pine sapling marked with four notches each standing on the side of a hill, North fourty [sic] seven degrees East fourty [sic] four and one half perches to the South line of “Chance” and reversing the lines of “Chance” and still running with the lines of the original. North seventy three degrees West ten perches. North seventy perches. North twenty two degrees West twenty six perches. North thirty three degrees East sixty perches to the end of second line of “Chance” and reversing said line by a straight line to the beginning containing three hundred and thirty two acres and five eights [sic] of an acre more or less acending [sic] to the certificate of resurvey thence of taking and returned unto the Land office bearing date of the Fifteenth day of February eighteen hundred & thirty eight. Saving [?] and excepting one hundred acres of the aforesaid tract of Land conveyed by Griffin Twigg Senior to George Slicer, which said one hundred acres lies adjoining one contiguous to the land of Daniel Crabtree John Hartly and Levi Twigg which said one hundred acres is to be deducted from the whole quantity of the Tract, leaving to the said Christopher R. Wagoner two hundred & thirty two acres & five eighths of an acre more or less also all his the said Griffin Twigg’s and Elizabeth’s his wife interest of and into the following tract of land, “Chance” containing ninety nine acres and one half an acre, as her reference to the Land Records will more fully appear and formerly surveyed Miss Milly Gasaway and recorded in Liber __ __folio 10__ also a tract of land called “Evening Tide” containing eighty two acres & three eights [sic] of an acre ore or less and patented to Griffin Twigg and recorded in Liber GG B No.5 folio 491. Together with all and Singular the buildings, improvements, ways, waters, water courses, rights, members, priviledges, advantages and appurtenances whereto belonging or in anywise appertaining, and all the estate right title & interest, trust property, claim and demand of them the said Griffin Twigg Senr. And Elizabeth his wife, of in and to the same. To have and to hold the said herein described premises, with the appurtenances thereunto belonging unto the said Cristopher R. Wagoner, his heirs & assigns, to the only proper use of the said Cristopher R. Wagoner, his heirs & assigns forever, In testimony whereof the said Griffin Twigg Senr. and Elizabeth his wife have hereunto set their hands & seals the day & year first above written. Signed Sealed and Delivered in the presence of Jno. W. Mountz Griffin Twigg Samuel L. Wagoner Elizabeth Twigg State of Maryland, Allegany County ___? Be it remembered and it is hereby certified that on this seventeenth day of December in the year one thousand eight hundred & fifty, before the subscribers two Justices of the Peace of the State of Maryland in and for Allegany County aforesaid, personally appear Griffin Twigg Senr. And Elizabeth Twigg his wife they being known to us to be the persons who are named and described as & professing to be the parties to the foregoing Deed or indenture and do severally acknowledge the said Indenture or instrument of writing to be their respective act & deed, the said Elizabeth Twigg having signed & sealed The said indenture before us, out of the presence & hearing of her husband, and the said Elizabeth Twigg being by us examined out of the presence & hearing of her said husband “whether she doth execute & acknowledge the same freely & voluntarily and without being induced to do so by fear or threats of ill usage by her husband or by fear of his displeasure” declareth & saith that she doth. In Testimony whereof we hereunto subscribe our names on the day and year aforesaid Jno W. Mountz J.P. Samuel L. Wagoner J.P.
