This indenture made this twenty sixth day of December in the year of our Lord one thousand eight hundred and seven Between Dickeson Simkins of Allegany County in the State of Maryland of the one part, and John Vallentine of Fredk of the county and state aforesaid of the other part Witnesseth that the said Dickeson Simkins for and in consideration of the sum of two hundred dollars current money of the United States to him in hand paid by the said John Vallentine of Fredk before the signing and delivery of these presents the receipt whereof he the said Dickeson Simkins doth hereby acknowledge, and from every part and parcel thereof doth hereby acquit exonerate and discharge the said John Vallentine fo Fredk his executors and administrators, he the said Dickeson Simkins hath granted bargained sold aliened enfeoffed and confirmed, and by these presents doth grant, bargain, sell, alien, enfeoff and confirm unto the said John Vallentine of Fredk his heirs and assigns all that piece or parcel of land lying and being in the county and state aforesaid being part of a tract of land called the Resurvey on the addition to Mount Pleasant, originally granted the said Simkins, Beginning for said piece or parcel of land, at the end of the fifteenth line of the whole tract, and running thence with it North thirty four degrees west twenty six perches, north twenty four degrees and one half degree East one hundred and ninety five perches, north seventy five degrees East sixteen perches to a black oak tree marked with six notches, South fifty two degrees East ten perches to the fifteenth line of the original, then by a straight line to the beginning, containing twenty nine acres and five eighths of an acre of land more or less Together with all ?, the buildings, improvements woods, ways, waters, water courses,, rights, privileges here? Aments and appurtenances whatsoever there with belonging or in any wise appertaining, and reversions and remainders, unto ifter? And profits thereof, and all the estates, rights, title and Interest whatsoever of him the said Dickeson Simkins, both at Land and in Equity of, in, to, and out of the said parcel of land and premises hereby bargained and sold or meant, mentioned or intended hereby so to be and every or any part and parcel thereof – To Have and to hold, the said parcel of land so as afore singular other the premises hereby bargained and sold, or meant, mentioned or intended hereby so to be and every part and parcel thereof with theirs and every of their appurtenances unto the said John Vallentine of Fredk his heirs and assigns, forever, and to , and for no other use, intent or purpose whatsoever And the said Dickeson Simkins, for himself, his heirs, executors and administrators doth hereby covenant, grant, promise and agree to and with the said John Vallentine of Fredk his heirs, executors, administrators and assigns that he the said Dickeson Simkins and his heirs the said parcel of Land and premises hereby granted, bargained and sold and every part and parcel thereof shall and will hereafter warrant and forever defend by these presents And said Dickeson Simkins for himself his heirs, Executors and administrators doth further covenant grant, promise and agree to and with the said John Vallentine of Fredk his heirs executors, administrators and assigns, that the said Dickeson Simkins and his heirs shall and will, at all time hereafter, whenever required thereto by the said John Vallentine of Fredk his heirs and assigns at the proper cost and expense of the said John Vallentine his heirs or assigns make, do Execute and acknowledge, all and every such further assurance or assurances deed or deeds, conveyance or conveyances devise or devises in the Land, as he the said John Vallentine of Fredk his heirs or assigns, or his or their council learned in the Land may or shall advise, devise or require for the more certain and effective assuring conveying and quietings? the possession of the said John Vallentine of Fredk his heirs and assigns of, in and to the said parcel of land and premises with the appurtenances forever. In Witness whereof the said Dickeson Simkins hath hereunto subscribed his name and affixed his seal this day and year first herein before written. Signed, sealed, delivered in presence of Dickeson Simkins (Seal) the word of Frederick being underlined between the ?their fourth line being on said deed was thus endorsed underlined before signing John Rice Thos Thistle Allegany County sct Recd on the day of the date of the aforegoing deed of and from the aforenamed John Vallentine of Fredk the sum of two hundred dollars current money of the United States, being the consideration mentioned in the said to Witness John Rice Thos Thistle Dickeson Simkins Maryland ? Be it remembered that on this Twenty sixth day of December in the year of our Lord one thousand eight hundred and seven (actually written on deed) personally appeared Dickeson Simkins of Allegany County the party grantor herewith named before us as two of the Justices of the peace for the county aforesaid and acknowledges the within deed or instrument of writing to be his act and Deed, and the land, premises therein mentioned to be bargained and sold, to be the right and Estates of the within named John Vallentine of Frederick party grantee also therein named his heirs and assigns forever according to the purport true intent, and meaning of the said deed on instrument of writing and the acts of assembly in such case made and provided. And now at the same time came Christina Simkins wife of the said Dickeson Simkins before us Justices as aforesaid and acknowledges the said deed on instrument of writing to be her act and deed, and the lands and premises therein mentioned to be the right and estate of the within named John Vallentine of Fredk his heirs and assigns forever. And the said Christina Simkins being left to remained apart from and out of the hearing of her husband whether She doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of, or ill usage from her Husband, or fear of his displeasure, acknowledges she doth make her acknowledgement of the same willingly and freely and without being induced thereto by fear or threats of or ill usage by her husband, or fear of his displeasure.
