Martin his wife of Allegany County and State of Maryland of the one party and Christopher Waggoner of the Same place of the Other part Witnesseth that the Said Lenox Martin and Ann his Wife for and in Consideration of of the Sum of One thousand dollars Current money to them in hand paid by the Said Christopher Waggoner before the Sealing and delivery of these presents the receipt Whereof is hereby acknowledged have granted bargained and Sold aliened enfeoffed and Confirmed and by these presents do grant bargain and Sell alien enfeoff and Confirm unto the Said Christopher Waggoner his heirs and assigns the following Tracts and parcels of Land lying and being in the County aforesaid near Old Town To wit “Hobsons Choice” Containing Forty two acres Beginning at a boundenWhite Oak tree (the tree is rotten the Stump remains round which Stones are piled and a Small hickory Sapling with Twelve notches On it Stands near Said Stump Which is On the Side of a hill in the meadow just below the Old barn in an easterly direction and running thence with the Courses distances metes and bounds Contained and Set forth in the Patent of Said Tract of Land Which patent is herewith given up also a tract of Land “Success”[?] Containing Eighty Eight acres and One quarter of an acre Beginning for the Same at the Begining [sic] of “Hobsons Choice” as a book described and running from thence With the courses distances metes and bounds Contained and set forth in the Patent of Said tract of land Which patent is herewith given up, also So much of a Tract of Land Called “Shepherds Path Resurveyed” and a part of “Annas Retirement” as well be Contained in the following Courses distances metes and bounds + Begining [sic] for the Same at the two Large bounden White Oak trees Standing on the north side of a run (“about twenty perches to the right hand of Crabtrees old road to Old town and about two miles north East from Old town and running thence South Eighty two degrees and an half degree East twenty perches to a bounden White Oak north Seventy two degrees East eighty One perches to a bounden White Oak South twenty Seven degrees East Sixty four perches to a bounden hickory Sapling (in a deep narrow hollow) North forty Seven degrees East twenty One perches to a Small bounden Beach [sic] (and a Stone) North thirty Seven degrees and an half degree West forty one perches to a bounden Hickory north four degrees and an half degree West Sixteen perches to a bounden Pine and White Oak north twenty One degrees East ninety perches North thirty Eight degrees East twenty One perches to a West Eighty three perches to a Stone near Some Closed pine Saplings Then leaving Said twenty first line and running across the Said tract South fifty four degrees East Seventy four perches to a bounden red oak Standing on the South East Side of the Old Crabtree road and just above Said Crabtree road thence north forty degrees East two hundred and Eighteen perches to the Second Line of Said tract and then with Said Second Line reversed South Seventy two degrees West Sixty perches to the begining[sic] thereof and then with the first Line of Said tract reversed north eighty two degrees and an half degree West twenty perches to the two begining[sic] trees of the Said tract named Shepherds Path Resurveyed Containing about two hundred acres of Land also one Other piece or parcel of Land adjoining Shepherds Path Resurveyed being the first piece of vacancy taken up by a Warrant of Resurvey on that Land and named “Annas Retirement” Begining [sic] for Said piece at a bounden pine tree Standing at the end of the Eighteenth Line of “Shepherds Path Resurveyed” and running thence north forty five degrees and an half degree East thirty Eight perches to the end of the twelfth Line of a tract of Land called “Success”[?] and reversing the Lines __ thereof north nine degrees East twenty perches North Sixty three degrees East twenty perches North fifty Seven degrees East thirty eight perches North Seventy Seven degrees West Sixty five perches North Seventy two degrees West forty perches North Eight degrees East Sixty perches to a Large forked bound White Oak tree then Leaving the Lines of “Success”[?] South twenty degrees West Sixty perches South forty degrees West forty two perches South Eighteen degrees East twenty Eight perches South fifty Seven degrees West ten perches to a bounden pine South fifteen degrees East fourteen perches to the north Line of a tract of Land called “Theodore”[?] and reversing the Lines thereof North Sixty two degrees East fifteen perches South of “Theodore” then reversing the given Line thereof South four degrees West to a bounden Old pine Standing at the end of the twentieth Line North thirty five degrees East Seventy four perches then reversing the nineteenth Line of Said Land north Six degrees East twenty five perches to the Beginning Containing Sixty nine acres and an half acre of Land To have and to hold all the above four tracts or parts of tracts of Land as above named and described together With the buildings and appurtenances and all and Singular other the premises hereby bargained and Sold Unto the Said Christopher Waggoner his heirs and assigns forever and to and for no Other use intent or purpose Whatsoever and the Said Lenox Martin and Ann his wife for themselves their heirs Executors and administrators do hereby Covenant grant promise and agree to and With the Said Christopher Waggoner his heirs Executors administrators and assigns that they the Said Lenox Martin and Ann his Wife and their heirs the Said tracts or parcels of Land and premises hereby granted bargained and Sold with the appurtenances Unto them belonging to him the Said Christopher Waggoner his heirs and assigns against all persons Will forever Warrant and defend by these presents and they the Said Lenox Martin and Ann his Wife do grant and agree With the Said Christopher Waggoner his heirs and assigns that they Will forever grant them a road to Oldtown through their Lands to follow the old Crabtree road till it Comes to the upper and South East Corner of the Long Meadow then to run on the South East Side of Said meadow fence till it clears the Lands of the Said Grantors and they are also to have the Liberty of a Road from the top of the ridge Outside of the twenty Second Line of their purchase to run down a hollow in a north Western direction Just outside of Said 22nd Line till it enters a Large hollow then down Said hollow till it nears the upper crop fence of the aforesaid meadow then to Cross the point of a hill and the Little bottom Just above the upper fence of Said meadow till it intersects the first mentioned road and then to Continue in and with it and they are allowed also the use of a road to Oldtown through a tract of Land called Theodore to run Where it Will do the Least damage to the Said tract and to the owners thereof In Witness whereof the Said Lenox Martin and Ann his Wife have hereunto Subscribed their names and affixed their Seals the day and year first herein before Written Signed Sealed & delivered in presence of Jno. W. Mountz Jno. E. Offuth Lenox Martin Anna M. Martin State of Md. Allegany Count to Wit On this twenty second day of November in the year of our Lord Eighteen hundred and thirty nine personally appear Lenox Martin and Ann M. Martin his Wife being the party grantors above named and the Same who Signed the above deed before us the Subscribers two Justices of the peace for the County aforesaid and acknowledge the Within deed to be their act and deed and the Lands and premises therein mentioned to be the right and Estate of the Within named Christopher Waggoner party grantee also therein[?] named his heirs and assigns forever according to the true intent and meaning of the Same and the act of assembly in Such Case made and provided and now at the Same time also personally appears Ann M. Martin Wife of the Said Lenox Martin before us Justices aforesaid and acknowledges the Said to be her act and deed and the Lands and premises therein mentioned to be the right and estate of the Within name Christopher Waggoner his heirs and assigns forever And the Said Ann M. Martin being by us privately Examined apart from and out of the hearing of her husband “Whether She doth make her acknowledgement of the Same Willingly and freely and Without being induced thereto by fear or threats of ill usage by her husband or fear of his displeasure” acknowledges that She doth make her acknowledgement of the Same Willingly and freely and without being induced thereto by fear of threats of or ill Usage by her husband or fear of his displeasure Taken and Certified the day and year above written Jno.
